The student understand that registration payments for course tuition is to hold a space for the student in that class, and, as such, are non-refundable, and that in the event that the student fails to attend any Fidelity Investigative Training Academy course in which they enroll, that they forfeit the total class fee paid. The student understands that no student in any course is guaranteed a "Certificate of Course Completion", nor certification of any kind, merely as a result of having paid for any course. The student further understands that failure to pass prerequisite written and/or practical examinations, required by each course, will result in non-certification.
This policy is publicly posted and has been for years. The student did not show up for the class session that they paid for. No school or academy anywhere would provide a refund for simply not showing up to class. In the immediate weeks following the missed class date, the student had the opportunity to attend numerous class sessions, but did not. As with any school, over time the course offerings change.
This student missed the class session they registered for, missed numerous make up opportunities and is not entitled to a refund for a course they failed to take several months ago.
Initial Consumer Rebuttal /* (3000, 7, 2015/06/17) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I, the would-be student, understand that registration payments for course tuition are to hold a space in class. I also understand that, "in the event that the student fails to attend any Fidelity Investigative Training Academy course in which they enroll," there will be a forfeit of that class fee. This much has been understood, as is the general policy of no refunds.
However, I, as the student, did not miss the class I registered for, nor did I miss numerous opportunities to take a make-up class. As I mentioned, I registered to take a class on February 14 and 15. Due to scheduling conflicts, I needed to reschedule the training for June 20 and 21. In other words, the 'make-up class' was rescheduled from February for June 20 and 21. I did not 'miss numerous opportunities,' because June 20 and 21 was supposed to be that make-up opportunity. When I spoke with the Fidelity representative in February to reschedule, this information was confirmed. As such, I did not 'miss' the class session I registered for. I rescheduled it.
However, somewhere between February and now, Fidelity lost its CCW instructors and ceased offering CCW classes, thereby making it impossible for me to take a make-up class. If the class was still being offered, I would take it. But the class is not being offered, and therefore, I did not forfeit my class registration. Instead, I paid for a service that Fidelity no longer offers. Additionally, the termination of this service was not communicated, which seems dubious.
In other words, I made a registration payment in order to have a seat held in a class that never happened. If the class DID happen and I failed to show, I would not expect a refund. However, the class I rescheduled for DID NOT happen, and I expect a refund. If Fidelity was still offering CCW classes, none of this would be an issue.
Fidelity claims to record all phone calls, so if the company doubts that I rescheduled this class, I assume they have the ability to review calls made in early February, which would further corroborate the dimensions of this situation.
