Monday, October 24, 2016RE; ID#[redacted] - Fiesta Motors, Inc.[redacted]Trade Practice Consultant[redacted]Dear Ms. [redacted];I recently received your letter again regarding my complaint with Fiesta Motors and I am going to respond again by saying that everything that they are saying is not true and that they are trying to discredit me. I.) In the letter they say I had a male companion with me while I went on a test drive. I had my father drive me to Fiesta Motors in his own truck and he waited in his truck while I personally went on the test drive by myself. II.) The car started showing problems way before and during my 30 day use, which is why fiesta said they would try and put me in a different car before my next car payment.III.) The loaner which was  given to me for my car which at the time was in his shop being fixed, I was told that this car was strictly a loaner for all customers and that all I would have to do is fill the gas tank when I returned it in.Whatever damages were on the car I was never aware of, since it was only to be used while my car was being fixed. They did not call or say anything about whatever damages there were they never pointed out what was damaged, so how could I have knows what had happen.IV.) My schedule monthly payments with the finance company are being met on time or on the next business day, since I call them personally myself to make this arrangements with them. I have proof of this because  I ask for a print out when I pay at the office, so it shows the date it was paid or on the next day.I mentioned to Fiesta Motors that there is a code device which they can use to program the car for a 24 hour period until I can get to the finance company the next day, they used it once to move and check the car which I still don't understand why they are saying I never pay on time but I have proof on paper to say I do.V.) I personally notified them myself that there was something wrong long before my first months was up, when I did mention it to them they kept the car for a whole 2 months without even fixing or even looking at it. Whatever was fixed that was not the solution but more of a bigger problem. I did sign an agreement which he said if work on fixing the car was more then $200 in repair I would have to pay the other half.Ms. [redacted]:I am not trying to make excuses for my actions or try to get out of this deal, I have proof that this car is a lemon I have no transportation of any king to go anywhere it sits in front of my apartment, fortunately my ob is right across the street. I want you to weigh both sides of this issue - Fiesta Motors must have known that there was something wrong with car I didn’t want this vehicle I had my eye on something else when I first got there but they pushed it on my saying I would look better in this then in that one.Thank you again Ms. [redacted] for listening and reading my letter, I want justice true and fair I want my voice to be heard and not shut out. We believe Mrs. [redacted] concerns have been answered in our previous response but we would be more than happy to mention these points once again.I) Prior to her purchasing the car, she came in with a male friend of hers and took the car out for a test drive. II) The car ran fine until way after the 15 days and 500 miles implied warranty. Mrs. [redacted] acknowledged this fact in her statements.III) Mrs. [redacted] damaged our vehicle which was given to her as a loaner and caused damages exceeding $1000 but did not say anything upon bringing the vehicle back and would not acknowledge the facts when she was asked about the damages.IV) The scheduled monthly payment with the finance company was not meet on time and that is why the vehicle was shut off for a period of time. The finance company is not going to be able to finance another vehicle for Mrs. [redacted] due to her insurance being cancelled and other collection issues (copy of the letter issued by Central Loan Company is attached).V) As mentioned before, Mrs. [redacted] drove the car for more than a month and put more than 1000 miles before reporting any mechanical problems to us. She also signed an agreement with Fiesta Motors stating she would be responsible with all repairs needs of her vehicle and would not hold Fiesta Motors responsible with the cost of repairs (copy sent in previous response).Thank you for reading and reviewing our response.Fiesta Motors, Inc.

Greetings;Please let us start by stating that there is no basis for this customer complaint and this is why;This unit was bought by Mrs. [redacted] on February 20, 2016. The car was driven and inspected by her and a third party prior to purchase. We helped Mrs. [redacted] with financing the car...

through one of our local lenders. About a month later and after she had put well over 500 miles on the vehicle, she called and stated she was having problem with her vehicle. She brought the car to us and after performing a preliminary diagnostics we took the vehicle to a local repair facility to run further diagnostic tests and to repair the issues with the vehicle. The cost of repair was around $200 which was paid by us on a voluntary basis since our aim was for her to be satisfied with her purchase. A few weeks went by and we received another phone call from Mrs. [redacted] stating she still had issues with the car. We asked her to drop off the vehicle and use one our cars so we could see what issues she had.  At this point Mrs. [redacted] payment was due and since she had not made her payment on time, the finance company turned the car off, and made sure she could not use the vehicle until her past due payment was paid in full. This is the reason her car stayed with us for a while. When the vehicle was finally operational, Mrs. [redacted] signed an agreement that clearly specified her responsibilities for all necessary repairs and the cost on her vehicle (attachment is included). After this latest saga, we suggested to Mrs. [redacted] we were more than willing to take the car back and finance her another vehicle, but because of her past due account and other issues with her credit she would be denied financing and therefore we would not be able to help her. In the meanwhile, the vehicle which we lent her to use was damaged and brought back to us with the front fender broken and almost touching the ground. We have the repair estimate which is over $1000.00 and to our surprise Mrs. [redacted] did not assume any responsibility when we asked her about the incident involving our vehicle. Please keep in mind the original vehicle was brought back to us a month after it was purchased and we went out of our way to help our customer but due to numerous issues which had nothing to do with the automobile, our options were limited to none. It is very unfortunate that Mrs. [redacted] is dissatisfied with our product and service but she should also remember about her due diligent responsibilities as a consumer and a car owner.

I [redacted] , am responding to the comments made by Fiesta Auto. Prior to myself purchasing the vehicle, I only took it for a test drive around the block, I did not take the car to a third party as they said. That was my mistake not taking it to get inspected before buying the vehicle. Yes after a month the car started to give me problems. I then took the car back to Fiesta Auto, and was told they would check to see what was wrong. He then told me to pick up the vehicle that it was ready.  I was able to drive it and in two weeks the same problem started again. I then took the car to [redacted] to get a diagnostic test and was told it was the transmission. I took the results of the test to Fiesta Auto, and he told me it was not the transmission. Fiesta Auto stayed with the vehicle for two month. They called and told me the car would not start, because I have a gps on the car, if I am late with the payment it will not start. Central Loans gave me a device with a code so the car will start and work for 24 hours. I told Fiesta Auto to put the code and the car would starte.  He called me back and said the car did start with the code, I then went and payed my payment on the car the very next day. So no that is not the reason Fiesta Auto stayed with the car for two months. I would past by Fiesta Auto and seem my car parked in the same place, outside the lot. He then called me to pick up the car, that he could not fix it because it would cost to much. He told me it was my responsibility to fix it. He also told me he could not help me with another car because my credit was bad. I then spoke with Central Loans and was told that all Fiesta Auto has to do is buy the car back and they would help me with another vehicle. Fiesta Auto does not want to buy the car back. I am paying for a car that I can not Drive. All I am asking for is for Fiesta Auto to please buy the car back so that my credit is not affected. I also want the $1,000 I put down so I could buy a car I could drive. I am now walking to work and back home. I am very dissatisfied because I truly believe they sold me the car knowing it was not a good running car. Thank you[redacted]Please help me ask I feel they sold me a lemon knowingly.
