Initial Business Response /* (4000, 8, 2015/10/15) */
See attachment
This is my wife's and my account of what happened the day of delivery and the days to followBefore the delivery that day we called the client and advised them that we would be there in approxminThey knew we were
comingWe are a delivery service, the vehicle we used that day was a Fwith a 16-foot trailer connected to itWe drove up a long dirt road that lead to the delivery addressAs we were approaching the first turn-off we saw two dogs running down the hill to the left of us and far from our truckWe stopped shortly after when we came to the first driveway, not knowing which way to goAt this point we were driving very slowWe then saw a person at the second entrance and proceeded to meet herWhen we were approached she was not waving her hands or yellingShe did comment very rudely something in regards to where are my dogs (this was before anyone knew what had happened)I responded to her..." I think they ran that way" she made another rude comment and continued to walk beside the truck until we parked
We got off and unloaded the bouncer in the location requestedHer husband was with us, helping us with the extension cordsAt this time, we heard when they found the dog at the entrance of the second drivewayI stopped what I was doing and started walking towards the site where the dog was foundI did not get very far when one of the women there (not ***) aggressively started to come towards me and verbally attacked me, accusing me with comments like "what kind of person are you?!", "you killed our dog and pretend that you do not know...." All these attacks came at a time when she was very upset so I understand, however this woman made unfair accusations and assumed because she was never a witness to what had happenedShe came out of the house after we were parked and unloadingMy wife and I were very shaken by this also so we stopped what we were doingAt this time, we were asked to just leave by the other person who also came out of the house after we were parkedSo we started walking to get our supplies but *** came up to us and asked us to continue because the kids were expecting an inflatableSo despite the tension and feelings we continuedWhile getting set up we talked with the husband who said that the dog got caught by the trailer and that it was an accidentAt no point did we ever know that we might have ran over the dogWe had no idea that the dogs were even by our vehicleWhen we first saw them they were running down the hill and out of our sight
While we were getting ready to leave and getting the rental agreement signed, the person who has asked us to leave came out and we calmly talked to one anotherWe again apologized for what had happenedThe son said that accidents happen...we told him that we would not charge him for the remaining amountThen we left
When our staff went back to pick up the inflatable they were asked if the company was going to pay for a headstone for their dogOur staff told them they would pass on the messageWe then received a call from the son who was not present the day everything happened, demanding we refund the paid amount of the rental, pay for the dog and the dogs shotsI told him once again that we felt terrible for what had happened but that it was an accidentHe then asked me so you are not going to pay us anything?! I told him we had already given them half of the rental cost at this point he began swearing and I told him the conversation was over and hung up the phoneImmediately after hanging up the son left a message, which started with "Alright, here is exactly what's going to happen from here." Then he proceeded with his demand of us refunding him the deposit of the rental plus the replacement cost of the dogThen he threated "if you do not do that my parents will get a lawyer involvedThey will bring you to courtThey will winIt will be a big deal for youIn addition, I wouldn't be surprised if the media around here get some sort of inkling of that and that would be bad news for you." I did also get a phone call from law enforcement asking if I could provide some insurance information for ***When I told him our version of what had happened he stated that that was not the story he had gotten and that he would pass on the message
Emotions aside the facts are we had permission to deliver at this address, I called minutes prior to arriving, no speeding or reckless driving took place, and the home owners, knowing their dog's unfamiliarity with moving vehicles still allowed them to run lose at time of deliveryAnother fact is neither the woman who verbally accused us outside the house that day nor the son who called me demanding and threating me, were present at the time of the incidentJust like the law enforcement agent who called me they were given a description of what actually occurred
We have been in business for over years with hundreds of deliveries per yearOur delivery locations include family residence, farms, schools, churches, town festivals, etcwe are well aware of the risks associated with unsafe driving and take offense to the accusations by this family
Initial Consumer Rebuttal /* (3000, 10, 2015/10/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
There is so little truth in *** response we find it simply unbelievableThe simple truth is he came to our property to deliver a product, he killed our dog, it was not an accident nor was he assured that it was that day, even if it was an accident it is his responsibility to pay for the damaged propertyIt was his responsibility to navigate his vehicle safelyOur dog was run over 1/feet off the driveway on the drivers side of the vehicle which happened when Mr*** used an unsafe speed while taking the corner in our circle drive and was unable to keep his vehicle on the drivewayHe knew the dogs where there, he did not use his mirrors or a sensible speed and the result was the death of our beloved pet on what should have been a happy day at our homeWe want the name and phone number of his insurance agent so we can resolve this issue
Final Business Response /* (1000, 14, 2015/10/30) */
We feel that we have addressed the situation in a reasonable manner and have nothing more to addThank you for your time
