Mrs*** was not present during the time that Mr*** came into our businessHe did not come in requesting an itemized copy of the tow billHe, infact, already had two copies of the itemized tow bill in his hand when he came into our officeMr*** instead demanded we give him a copy
of our "police authorization to tow form." We directed him to contact the police department that had his son's vehicle impounded, so he could obtain copies of police paperwork from the police departmentAfter it was explained to him three times that he would have to procure copies of the form through the police department, he became agitated and verbally abusiveHe was then asked to leaveAdditionally, there were multiple witnesses present when this event occurred

We continue to deny any liability in this matter. Our position has not wavered or changed. We were and have not been cited by law enforcement. Had the plaintiff struck a human being and injured/killed them, we would be having a very different conversation. This is why the move over law exists.

I am rejecting this response because:I was not cited either. Indeed, the State Trooper who responded informed Fife Towing by phone and my insurance company and the insurance company for the semi driver that I followed the move over law, which says that a driver is to move over one lane if possible and if that is not possible then to slow down.  A semi immediately adjacent me and cars right behind the semi prevented me from moving over so I complied with the law and slowed down. The trooper stated that I followed the law.  The open door of the semi was not on the shoulder, it was hanging open over the lane of traffic.  The statement about if instead it had been a person who had been hit, given that the equivalent would have been the person was standing out in the lane of oncoming traffic and not in the shoulder, is a specious argument.Clearly the only way to resolve this is to have a judge rule on the matter. I have attempted to cause that to happen, but the president of Fife Towing repeatedly avoided service of the papers giving the date of the scheduled mediation, which is what the Pierce County Small Claims Court mandates. If the mediation proves unsuccessful then the matter is heard by the judge.  I have obtained a continuation and there is a new date.  Fife Towing is not the arbiter of the law. I want the registered agent for Fife Towing to provide a date, time and location for accepting service of the court papers.
