I had some work done on roof of my house. He got paid in full, but also sent my receipt in and collected $150.00 rebate from Menards which was not his
Back in September of last year, I had some work done on the roof of one of the properties (***) using a contractor name ***. His phone number is (***. The shingle materials we purchased from Menards had a rebate of $150.00 and I had given him my credit card to pay for and pick up the shingles. So he had the receipt and did not give it back to me at the time. He said I can get a additional print from Menards. I trusted that he will not send in that rebate with the original receipt the he never gave back to me. For the work that he did, I paid him cash as per our agreement, and to get my rebate, I went back to Menards and got another hard copy receipt, filled the forms and sent in for my rebate.
After numerous communications and phone calls to Menards, I learned just a couple of weeks ago that he had gone ahead and claimed that rebate and I finally received an email after much follow up with Menards and associated company that takes care of their rebates, confirming that he has received and cashed that rebate check. I called Mr. and asked that he should return that fund but after the first time that he replied and told me he will look into this matter and get back with me, he no longer even answers my calls. I asked the guy who introduced him to me to call and urge him to pay my money back, his message to that friend was to tell Mr. to "kiss my ***", forgive me for using his disrespectful language.
So, I would like to take him to a small claim court to hopefully get my money back and that way he will learn not to steal in a daylight at least, but I know it will cost more to do that than the $150.00 I am hoping to collect. Thank you.

Desired Outcome

I would like Mr. *** to give my money back. It was not part of our agreement for him to collect on that rebate and I have a witness that Mr., received cash for his work as per our agreement. He never returned my original receipt because all along he had in mind to steel my rebate money. Even though I got a receipt copy from Menards and files for the rebate, but he beat me to it, and received, collected and cashed that check. I have email from rebate company saying that my rebate was cashed. The $150.00 was not his money and he needs to return that amount to me. That is all I am asking for.

The agreement made between a former employee and Mr. mutual friend, Mr. was for $850 in addition to the cost of equipment needed to complete the job. This was $650 for a roof repair completed by my employee and $200 to clean the first and second story gutters, completed by myself.After the job was complete, a payment of $650 was made. Mr. failed to pay the original agreed amount after all of the work was completed and did not reimburse for the cost of equipment as stated by Mr.. Mr. states that his credit card was given to my company to make his purchase. This statement is not true. Mr. was in possession of the credit card. The receipt was given to me to pick up the roofing shingles. I did not intentionally keep the receipt from him nor did he call and ask me about it. I was never in contact with Mr.. I, as owner of the company did not ever have a conversation with this individual or intentionally keep his receipt. I did however send in the receipt for rebate after several weeks. I also kept the rebate for several weeks before cashing it.If Mr. is determining this is a business issue, he should have addressed it with the owner of the business and not an employee. If this was an issue pertaining to the business that I operate than I should have been notified that Mr. was not going to pay the original agreed amount. I would have not climbed a ladder 30 feet in the air to clean his gutters for him if I would have known I would not be paid to do so. I would have also been notified by Mr. or his associate Mr., who stated he would reimburse for the needed equipment that he had no intention of doing such a thing. I am providing information as it was given to me by the individual who completed the job in addition to my own personal experience with his client. If Mr. would like to pay the remaining balance of $200 and the $100 reimbursement of the equipment purchase, I would be happy to provide him with the store rebate.

I want to thank Mr *** for his response to my enquiry. Please find below corrections to his statements:1. Mr. contract with Mr. *** was for $650.00 and not $850.00. That $$ amount was agreed upon by Mr. *** prior to start of the work. Indeed we had another estimate for this job for the same amount from another roofer (Mr.) who was unable to come and only then Mr. called Mr. *** for this job. Mr. and Mr. have agreed to testify in court for all the matters expressed here.2. Cleanup of the gutters was included in the job from the beginning and was only in the section of the roof where he has done some work. Again, Mr. will testify to this at the court hearing, if we end up there.3. Purchase of equipment to do the job was never discussed with me nor I ever agreed to pay for equipment to be used only once on my job. 4. I paid the bill in full when the job was completed. Not having ever met or known Mr. Mr. ***, why would he accept $200 less than agreed upon cost? When the job was completed he asked if I was going to pay for his equipment but I told him that equipment is his, and as a professional roofer, he was supposed to have his equipment for the job he had accepted to do. So we agreed to his payment of $650.00.5. Yes, Mr. gave Mr. *** the receipt to pick up the shingles but we never agreed that he should file for the rebate. Mr. called Mr. *** that same evening and asked for the receipt and told Mr. *** that he needs to bring it to his shop on Central and 475, but that never happened. Mr. then instructed me to go to Menards and get a copy of that receipt and file for the rebate. When I did that however, it took a long time to hear back and the response was that a guest had already collected my rebate.6. Mr. indicates that I should have contacted him as the business owner, but I had no idea what business Mr. *** was affiliated with. The fact remains that I have paid in full for the work that was completed. The rebate was not his to collect and I should get that back, or I will seek legal advise. Indeed I have witnesses to all the claims I have made here and hope Mr. ***, and Mr. agree that the rebate fund was not theirs' to take. Thank you..
