Fine Point Finishes is responding to [redacted] compliant.

 

[redacted] knew what material was being used. We chose all colors from a [redacted] paint deck and we went through several samples and sheens before [redacted] chose a final color. There was no painting on the home prior to our start date because she did not have a color chosen. She had patched a few holes in the stucco prior to service. We advised her to not patch anymore due to quality of her patches. Prior to painting we:

Power washed home  

Patched excessive stucco cracks

Overhangs were scraped and patched

Paint application

Sprayed and back rolled home to cover repairs

At no time did I tell her [redacted] would repair her roof.

 

In the Spring of this year, [redacted] was called in due to [redacted] request for an inspection.  Fine Point Finishes was invited to walk the job as a standard procedure when an inspection is requested.   This inspection passed with normal wear and tear. In order to make a customer happy and for the best customer service my company offers, I offered to do a courtesy touch up which was completed.

 

Please note, upon my own efforts, we reached out to the [redacted] and requested an inspection of the property. This was declined due to the completion date of the job as mentioned in [redacted] letter in July, 2011. [redacted] standards finds this request out of realistic standards for warranty.

 We are currently awaiting [redacted] Certified Letter regarding the above mentioned inspection, noting Fine Point Finishes paint job meeting industry standards. We expect this to come on Monday, September 8, 2014 and will be forwarded to you for review.

Please consider, [redacted] had paint left on site at the end of the project for touch up.  After 6 months, she contacted Fine Point Finishes, requesting additional paint to paint her new patio addition. Out of good ethics and customer service, I supplied her with a gallon free of charge.

 

[redacted] received a bid and an invoice via email. I am sorry to say, all of our data was lost in 2012 due to an internet corruption.

 

In response to me moving, I still live in the same home and the office is in the same location. We welcome all customers to visit our office and/or call us if there is a question, concern, or issue.

 

All this being said, if a home was painted badly; why would it take 3 years to complain about? Why did [redacted] not bring up her issues at that time she requested a gallon of paint for her patio or when the free paint was delivered. If you think about it, she had no problem?

 

I have never had a Revdex.com complaint against Fine Point Finishes before this.  We appreciate our Customers across the [redacted] and look forward to a positive mediation to an unfounded complaint.

Approximately 3 1/2 years ago Fine Point Painting painted the exterior of the [redacted] residence.  The job was walked with [redacted]owner a description of work was discussed and colors were chosen by owner.  Fine Point provided her with multiple samples of colors...

and paint products.   At that time window was broken and brought to the attention of Ms. [redacted].  She stated she was not going to have it fixed prior to painting because it was too expensive.  Once the house was painted and all contracted work was completed the house was walked with Ms. [redacted] and [redacted].  Ms. [redacted] was happy with work at that time and Fine Point Painting was paid in full. 

Approximately 6 Months after we completed the job Ms. [redacted] contacted Fine Point and requested some paint in the same color(s) for a patio that she added on.  [redacted] supplied her with a complimentary gallon of exterior paint. 

In January 2014 Fine Point Finishes received a letter from Ms. [redacted] expressing concern for the painting on the residence.  An appointment was set with a [redacted] Paint Representative, [redacted], [redacted] and Ms. [redacted].  The paint representative did not find any failure in the paint and agreed the paint was holding up well.  Fine Point Finishes sent a painter to do some small touch up on rear of house and scraped and painted a small area at the overhang.  Even though she was past her two year warranty period we completed the work free of charge as a courtesy.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I had Fine Point paint my house in July of 2011.  The only walk around was at the time the estimate was given to me verbally and included  moving the dirt away from the house in the areas that I had not already done, painting the fireplace chimney's, the short wall in the front (glass side of the house), my water storage tank.  The repairs were as follows:  the normal caulk of all cracks, scraping of flaking paint, repairs to concrete that had chipped out at bottom of sliders, push speaker wires in and patch holes.  His brother who runs the construction portion of the company came and looked at the roof and leaks on the eves and said no problem he could fix that, as there were no leaks found in the garage-just outside under the eves.  We agreed to [redacted] Paint.  We agreed that the first coat was sprayed and the second coat was to be rolled on.  I also requested that any additional paint be left on site for future repairs and maintenance, as I was selling the [redacted] and wanted that available for new owners.  I told Mr. [redacted] that my previous paint job lasted 10 years and showed him the paint (5 gallon paint-at least half full/trim 2 gal.) left by the previous painter.  He said that his quality of work would exceed those standards and he would give me a 10 years on this paint job as well-with no problem it should last that long.  It may fade, as these darker colors do.  I agreed as my previous paint had faded by the 10 year mark, but was still intact. (No chipping, peeling, etc.)

I did have a window in my bedroom that the outer pane was broken and the inner pane was still intact.  That is correct.  However, after Fine Points left the scene, I had ANOTHER window-next to it with a hand print on it.  That window was not cracked - the seal had been broken from someone loosing their balance and falling onto it to steady their balance.  As soon as the temp. changed the window filled with condensation and I have the work order that states just that.  BOTH windows and a slider were replaced in 1/2014.

The roof got worse and had to be repaired as [redacted] would not return my calls and never answered the door at his [redacted].  I hired two roofers and they charged me 1500.00 when it was all done on 5/29/2014.  I have the receipt for that as well.

I have attached aprox. 50 photos of my house and the photos of lack of paint, peeling and chipping paint, non-repaired areas painted over, many photos of painted rocks, areas where the dirt was not pulled back and the ground was painted.

These are not ALL of the photos.  The holes where they poured the paint-one I shoveled it all out as it was right by my [redacted] and was embarrassing when the realtor was showing the house.  The other I will take a picture and send to you with the receipts from the work.  I am afraid to send all this info in one email as it will take forever to get to you.

I made my patio in December 2011.  It did not get painted until July 2012-when I got the paint after [redacted] dropped it and ran and my neighbor caught him speeding through his property.  He was speeding off because he dropped off [redacted] Paint-NOT what we agreed upon.  And that is why [redacted] never provided an invoice as his attachments would never open via email.  I called [redacted] in Sept 2011 because I noticed that he never painted a truss on the roof.  He tried to tell me that the contractor never painted it. No, it has green paint on it.  That was the previous color.  He gave me the paint for that in the speedy delivery for that as well - for ME TO PAINT IT.  ON the roof, for which I paid him to do.

I contacted [redacted] Paint to express my concern as I was told that the issue of it peeling off of my wood surfaces, cement surfaces and was taking all the previous paint with it.  This was the 3rd time this house has been painted.  This [redacted] Paint peeled off leaving a completely bare wood surface and the same with the concrete.  I had a professional painter look at it and he told me that is a paint issue.  THAT IS WHY I CONTACTED [redacted].  [redacted] and his boss got the directions to the house and set a date and time to view this mess.  When they showed up, [redacted] was with them.  When I pulled [redacted] aside and asked why he was there as I could never get him to respond before, Mr. [redacted] told me that they had contacted him to see if he used any additives and that Mr. [redacted] insisted on being there.  Told them that they would never find my house and would not be able to drive a car to to it.  LIES, LIES and more LIES.  I gave them directions and [redacted] said he could have found it without any problems.  Didn't comment on the road, but pointed to my Honda and said I see you make it OK.  Yes, and I used to drive a [redacted] up here(my bosses).

The [redacted] people said that the color was holding up and that some metaphysical something was the problem.  Meanwhile [redacted] is pointing out my patchwork - totally irrelevant to the situation.  And stories of how my neighbors and I don't get a long-another irrelevant issue.  As [redacted] and I were talking, [redacted] butted in and said , "so can I repaint it?"  And [redacted] told him we were just getting to that.

I did not want him to paint it.  I told [redacted] so.  Followed by an email to [redacted] and [redacted] offered to come back and look at it.  No follow up, and [redacted] has moved with no forwarding address.

The serious area that started this whole thing, my roofers repainted.  I have not looked at then nor have I looked at it since, as after [redacted]'s "crew" was here it peeled off again.  And the quality work they did was to paint OVER the peeling instead of scraping it.

I am still in the same boat, except all that horrible rotted wood has been replaced, and the problem of a exhaust vent that had come up from under a tile was fixed.  A simple little thing that [redacted] said he would take care of, turned into a 1500.00 repair.  At the time [redacted] pointed it out, it was two eve sections.  They ended up replacing almost every board around the garage.

Mr. [redacted] never gave me anything in writing with his signature-everything was verbal from the get go as I insisted upon [redacted] as that was what was used before.  I believe that is when the paperwork ended.  He could not even give me the name of the color because he didn't keep any paperwork.  No paper, no taxes.

Review: I hired this company with specific terms I outlined with [redacted] the owner of Fine Points Painting. I asked for a specific Paint ([redacted]) and [redacted] told me that his Brother was the construction portion of the business, as he looked over the exterior he notice I must have a leak as there was a panel that showed water leakage. His brother showed up and looked at it and said no problem he would take care of that.

I asked that the paint be applied via roller as there were cracks and the neighbor hired a painter that applied a paint with a sheen and rolled the paint and all the patches and cracks were hidden. [redacted] assured me that his paint would cover those - but not the areas that I had attempted to patch as I had intended on doing the painting myself, but changed my mind as I did not want to end up with paint all over the ground and my landscaping. He said I did bad quality patching, that they would try to straighten that out for me.

I told him the last paint job lasted 10 years and I expected the same from his as he was boasting about the quality of his work and the jobs he had going in [redacted] and up North at a huge project. That is great, but I am concerned with this project right here.

When I came [redacted] I loved the look from a distance as I picked an unusual color and I really liked it on the house, and I told him so. However as I walked around I looked up and they had completely missed an entire facia board on the roof. I called [redacted] to tell him because there was no paint left for me to do touch ups of to even match. And, when I started to look around and saw all the overspray-that is correct SPRAY on my [redacted] patio out in the middle of my yard I was very disappointed. Then I found more paint on my landscaping rocks, in the yard where they found a hole and used it as a drain. ANd more on my concrete. And as recently as yesterday, I found another area that they used as a paint dump site down by my water tank-under a cactus.

[redacted] guaranteed his work for at least 10 years as he boasted about all his jobs remember? Well when I told him about all the paint being all over the place, well he was too busy to come and look at it. Always going out of town. Or his baby was sick.

Shortly after that, I saw a big palm print on my bedroom window and I thought, hmmm, one of the painters must have done that as it was at the top of the window and only I and my dog live here and no one else had been on the property. Months later when it started getting cold condensation filled in between the double panes. They had broken the seal of the double pane window, according to the window people who came to look at it. He too could see the palm print. That window was 860.00.

And the roof, well it was never repaired. [redacted] kept saying his brother would be out this day and then that day. That leak turned into a huge problem. It was repaired for $1500.00.

I finally got the paint a year after the fact and he dropped it off and took off cutting through my neighbor's property who stopped him and told him to never drive through his property again at that rate of speed. The paint dropped off was [redacted] NOT [redacted] as I asked for in my contract which I never got in writing. He forgot it. Just email it to me [redacted]. My computer isn't working. Just handwrite one. I don't have anything to make one...and on and on. But, he couldn't make one, he was in violation of the contract from day one.

Two years after the paint job, I was walking around the house and looked up and there was paint completely gone off of the wood under the eves. No weather ever touches this area. No sun, no water -nothing directly hits it. Then I looked further and paint was coming off the stem walls and more places under the eves. It wasn't just the paint that [redacted] put on, it took the paint job I had done 10 years prior and the paint the Contractor had originally painted it. Raw wood. Like I had just gone to [redacted] and replace the wood. I contacted [redacted] Paint as I spoke with several other painters and they said they thought it was a paint issue. Two reps from [redacted] come out to look at it and [redacted] is with them! The main guy from [redacted] said they contacted [redacted] regarding the details of application and he insisted that they would never find their way to my house (after I gave them specific instructions) and that their car would never make it up the road. I drove my bosses [redacted] up it - if it makes it ANY car can make it. During the whole meeting [redacted] was taking these men aside and pointing out the patch areas I did-nothing to do with the issue, but trying to distract them. Enough of that. Apparently, the "arrangement" was made that if I allowed [redacted] to make the repairs all was good. Well, I did not want [redacted] to do the repairs but was put on the spot with him standing in my face.

He showed up painted one stem wall, brought two guys with him. They ran around with the paint and left. Two days later, I took pictures of the EXACT issues as nothing corrected, everything is status quo. Even the [redacted] people have not returned as they said they would. I am pretty sure he put something in that paint in order to spray. And the people he sent to do the job. His son and two others that really didn't know much about painting - after all his crack teams were at [redacted] and up North on the Big Jobs. What is this single stupid woman know about paint and what is she gonna do?

Nothing with the [redacted]. Over 2 years. Just because he came to re-work the project if he didn't charge me, the period doesn't start over-2 years that's it. Done. Over. Screwed.

[redacted] knew I was going to put the house on the market. He knew that when the problems started to develop I would be gone and so would he, therefore no 10 year warranty to keep. No contract to back me up as he NEVER provided me with one. BAD BUSINESS all the way around.Desired Settlement: I want my house repainted with [redacted] according to the outlined contract I gave him and HE agreed to.

I want a professional painter to do the job - NOT Fine Points Painting.

I want reimbursement for the roof repairs that developed into a major problem because [redacted] neglected to get his brother or one of his staff out her to take care of the problem when it was a small issue. [redacted] is the one who found it. [redacted] was the one who suggested his brother to repair it.

I want replacement for my [redacted] for my door entrances only.

I want reimbursement for my window I had to replace. It was his Son that did it. His son is big and overweight. The others with him were featherweights compared to him. The palm was huge - the size of his hand.

All I asked for was a good paint job. I got nothing we agreed to.

I got [redacted] Paint - not [redacted].

I asked for rolled paint - got sprayed.

Didn't expect spray all over everything - but got it all over.

Didn't expect them to clean their paint gear and dump in my yard-isn't that EPA violations?

Didn't expect a broken window - but got that at N/C.

If he didn't tell me that his brother was going to repair my roof, I would have had someone else do it - BUT, I PAID for it in my bid.

[redacted] received a bid and an invoice via email. I am sorry to say, all of our data was lost in 2012 due to an internet corruption.

In response to me moving, I still live in the same home and the office is in the same location. We welcome all customers to visit our office and/or call us if there is a question, concern, or issue.

All this being said, if a home was painted badly; why would it take 3 years to complain about? Why did [redacted] not bring up her issues at that time she requested a gallon of paint for her patio or when the free paint was delivered. If you think about it, she had no problem?

I have never had a Revdex.com complaint against Fine Point Finishes before this. We appreciate our Customers across the [redacted] and look forward to a positive mediation to an unfounded complaint.

Fine Point Finishes never cleaned the friable asbestos containing material (ACM) that was deliberately left behind. It appears Fine Point Finishes that I hired to perform the asbestos abatement is not customary to performing asbestos abatements in compliance with the Federal standard CFR 1926.1101 of the Maricopa County Rule 370 and Federal NESHAP program. The following standards were not written for the residential industry but they are considered "best practices" when performing this type of abatement. However there is ADOSH who would regulate this activity and I was not provide a "standard of care" by the contractor.

To validate the above mentioned I hired a qualified industrial hygienist who understands the OSHA standard 1926.1101, and it listed several building materials as asbestos containing which would become friable during removal. Due to the nature and location of the ACM within the residence the area should have not been reoccupied since it would have not passed a visual inspection by a qualified industrial hygienist.

* Remove and dispose all visible debris that has been cross contaminated by friable ACM and is currently within the residence and is sitting on the concrete floor.

* HEPA vacuum all surfaces within the residence (not done)

* Wet wipe with amended water and clean rags all surfaces within the residence.

* Walk around the exterior of the residence and properly bag all visible emissions that appear to be ACM. Since there is comingled waste around the residence that appears was in contact with ACM inside the residence a lot of this may need to be treated as ACM waste.

* Dispose of all visible emission as asbestos containing waste material (ACWM)at an EPA approved landfill that accepts friable ACWM.

* Once the area has been properly cleaned a qualified industrial hygienist who understands the OSHA standard 1926.1101 should evaluate the effectiveness of the cleaning process for completion.

Fine Point Finishes was also in charge of completing the inventory list of property within the house. The inventory list supplied to the insurance company by Fine Point Finishes was not done properly. My insurance company replied to me stating that Fine Point Finishes did not follow the instruction given to them. The insurance company rejected the list due to they don't know what's in items listed as 10 bags full of clothing, 5 boxes full of car parts, 2 bags full of blankets, and towels, and the list goes on. These are just some examples of the poor quality of inventory submitted by Fine Point Finishes to my insurance company.
