I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint First of all let me clarify something. The property referred to in your attachment is the wrong address. The complaint in question is for the property located at: *** *** *** *** ** ***. The fact that the home inspection is only valid for days, only limits the inspector's liability and is of NO benefit to the client. The sole purpose for a home inspection is to be made aware of any potential problems with the subject property prior to purchase, which can then be used as a bargaining tool during negotiations with the seller. The home inspector failed to point out potential/costly defects with the windows which in turn breached his fiduciary obligation to myself, the client. The sole reason the home inspector was not contacted about this problem upon discovery, was because the home inspector was extremely rude and in personable during the initial home inspection process back on 08/25/14. I immediately contacted my agent during the inspection and expressed my displeasure and asked her not to use Finegan Inspection Services on any future home inspections. For a fee of $510.00, I definitely did NOT get what I paid for

Finegan Inspections Services blatantly refuses to accept any responsibility for their shoddy work and has never made any good faith effort as an ethical contractor to amicably resolve this matter. They obviously don't care what potential customers think of them. Once again, Finegan Inspection Services is dragging their feet and continues to skirt around the obvious by hiding behind their standardized form filled with industry jargon. Finegan Inspection Services has NOT addressed my initial issue and has NOT performed as an honest, reputable and professional contractor throughout this process. It is obvious from their previous response, that Finegan Inspection Services operates on the slimy theory of "Take the Money and Run" and is hell-bent on accepting any moral responsibility as to the quality of their work and/or business practices This matter is far from over as far as this consumer is concerned. Finegan Inspection Services has messed with the wrong customer!!

*** *** was told by the inspector that there were several windows in the home that have failed sealsThere were two homes we for *** ***The first one had some window seal failures, these were pointed out by the inspector and noted in his first reportRelative to the home *** *** eventually purchased, Finegan Inspection Services, Incinspected that home as well and like the first home, this one also had seal failures in the window glassAll windows that had obvious fog or moisture between the glass panes at the time of the inspection were pointed out to *** ***All window glass seal failures that were obvious at the time of the inspection were also listed in the inspection report with photos of the specific windowsFinegan Inspection Services, Incnever claimed that every single window seal failure would be noted, indeed we stated in the report that seal failure many times cannot be determined during a warm dayThe moisture simply does not show up between the glass panes until there is an elevated differential in temperature on each side of the glassIt is at that point where the dew point is raised and the condensation becomes more obvious in those windows with seal failures We did what we could with window glass inspection on the day of the inspection for the to hours it took to complete the inspection protocolsAs a member of ASHI I encourage the Revdex.com and *** *** to read the Standard of Practice for ASHI home inspectors on the ASHI web site as it pertains to windows and window glassAn ASHI home inspection is a visual inspection of the building components such as the windowsThe inspector pointed out those windows with seal failure to *** *** at the time of the inspection and then again the seal failures were noted in a very detailed inspection reportThe Revdex.com needs to ask *** *** for a copy of that report to see the level of depth and detail that is provided in our reportsThe fact that other windows may have developed seal failures after the home inspection was conducted or there were a few window that had failures that were not obvious at the time of the inspection is not our fault*** *** wants Finegan Inspection Services, Inc to give him $400+ dollars for a problem that either was not there when we inspected the home, or was not obvious when the home was inspectedEither way the answer is no, Finegan Inspection services, incwill not give *** *** any moneyWe are not going to say any more or do anything else on this matter

It is unfortunate that the buyer of this property has experienced a problem with our service and with *** *** the inspector of the propertyWe would have been willing to discuss the issues that the Buyer says were evident with the window sashes in his new home had he simply called usIn the
inspection agreement which he read and signed at the time of the inspection it is stated that if a problem arises with the property after the inspection we will return to site and review that itemWe ask that he allows us to do this prior to any repair so that we can work out a solutionOur phone records show that the buyer has never call Finegan Inspection Services Inc after the home inspection was accomplished.The inspection was accomplished in the month of July The complaint was filed in early November of Seal failure in windows in this neighborhood can occur within months and in fact a home I recently inspected in that same neighborhood had failed seals develop in one month from the date of the inspection to closingThe windows are at the age where these things develop and at the change of seasons the seal failures become more pronouncedMost importantly in the inspection report, *** *** did point out that there were failed seals in windows on the day of the inspectionHe also stated that there could be additional seal failures but due to the atmospheric conditions these may not become evident until latterThe summary of his report will be attached to this letterIn all honesty there is no perfect way to determine if a window has seal failureBecause all inspections are visual, we checked the windows both for glass condition and for operationWe did our best to help our clientWe never made any statements that we will be able to note every single defect in the property*** *** followed all applicable protocols by our professional Standards of Practice,(ASHI Standards of Practice) during the course of the inspectionIf an item was not visually evident at the time of the inspection or if an item was not defective at the time of the inspection we can not be held responsible for that item
