Like most health clubs, Finest Fitness has several different memberships to choose from, therefore, our staff must explain the terms of each to assist potential members in making an informed decision as to the type of membership they wish to sign up for. Members are then asked to sign in 3 separate areas of the contract acknowledging that they understand and agree to the terms of their chosen membership.On 3/**/14 the member signed a 1 Year Automatic Debit membership agreement with our club. This particular agreement requires 12 consecutive monthly dues payments. When the 12 payments are met, the contract automatically converts to a month-to-month membership requiring 30 days written notice of cancellation to stop the automatic debit payments. This is a standard health club membership agreement used by most health clubs. Our agreements, however, have the automatic renewal information as well as our cancellation policy in bold type so it clearly stands out from the rest of the print in the agreement.The member emailed me on 5/*/15 stating she had been at the club that day to cancel her membership. She requested a refund of 2 months membership dues because she did not realize her membership converted to a monthly contract. I reiterated the terms of the agreement she chose and emailed her a copy of her signed contract so she can see the conspicuous terms regarding the automatic renewal and her signature acknowledging them. I explained that I could not issue her a refund, however, I did waive the 30 day cancellation requirement so she would not be billed any further dues. She continued to insist on a refund and stated she would dispute the charges with her credit card company, file a complaint with the Revdex.com and discourage her friends and family from joining our facility.In fairness to all our members, we hold each to the terms and conditions of their chosen agreement. We cannot afford to issue refunds to members who claim they did not know certain terms of their contract when they signed in 3 separate places that they did.
