Please find my response to the above referenced matter below. I of course would prefer that this matter and Mr. [redacted]'s letter is not posted on your website as it obviously does not state the whole story. In addition, the proceeds have been distributed to Mr [redacted] as he has now finally satisfied...

his obligation of payment to me. However if that is unavoidable, then the facts I state below are expected to be posted as well. Thank you very much for your help in this matter. Mr [redacted] failed to fulfill his obligation of our arrangement in which rent he owed the gallery for his display space was overdue for 6 MONTHS. I went above and beyond in up holding my end of our arrangement by extending  his leased space while awaiting payment AND continually exhibiting his work in my gallery in the midst of his non-payment. I even exclusively presented his work to new economic developments within our area to add to their public space and therefore support his art and grow his proceeds. After ending our business arrangement and all inventory was removed AND his 6 MONTHS of past rent was finally paid up. Mr. [redacted]'s proceeds were distributed to him, in less time that it took him to pay his rent, in full once he fulfilled his obligation to me. Brett Utter

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
In the matter of the non-payment for sales at Finger Lakes Gallery and Frame in [redacted], NY, I have received the response from the owner that you forwarded to me on October 5, 2016. The owner completely misrepresents the facts that occurred relative to the rental fee. In brief summary please note the following:   In the Fall of 2015 following the first six-months of our business relationship, I made a number of inquiries and visits to the gallery with the request via email or with the representatives at the gallery (who were not the owner) that we should meet to determine if we wanted to continue exhibiting my photographs at their business following the arrangement that we had for the previous six months where I prepaid $200 a month for six months. I receive no responses. On December 4, 2015 I finally received the following response:   Hi [redacted],So sorry for my delay but I have missed some work due to health. Terrible case of bronchitis and just now getting back into things. I will look into your last list of questions regarding your artwork and reply shortly and take care of any payments you questioned. Thanks for your help and patience! Best, Brett. In late February 2016 I still had no additional response from the owner and when  I visited the gallery and found that most of my inventory, produced at considerable effort and expense, was no longer on display and was stored in a back room. I decided to discontinue my involvement and sent an email with that decision to the owner on February  23, 2016. The owner responded on February 26 agreeing to discontinue and committed to make payment to me for the previous sales of my photographs. Although the owner did not request it, on my own initiative, I decided to pay for the final six months of my time having work on consignment at FLG&F and based on the previous agreement of $200 per month, on February 27, 2016 I mailed a payment of $1,200 check number [redacted] that was deposited on March 2, 2016 in an account for Finger Lakes Gallery & Frame at [redacted] National Bank. I had noted on the front of the check #[redacted] “Payment in full, Display Space rental September 2015 – February 2016”. I had to make numerous requests to arrange a time to pick up the inventory that was stored at FLG&F and it took until late April for them to allow me to pick up the remaining photographs. Based on my careful inventory sheets, that I had shared with FLG&F, four photographs were not returned and were sold at FLG&Frame. I mailed an invoice totaling $1,285 on April 26, 2016 to FLG&F. As mentioned in the original complaint, I have send the invoice a number of times, including by certified mail, and made phone queries on the status of the payment due to me. I received no response and the only response now is the response to the Revdex.com complaint. The owner’s response is bogus suggesting that I owed him money for the rent, noting above that I made that payment on February 27, 2016. As of today, I have not received payment of the $1,285 that the owner claims to have made.   [redacted], If you have any questions, please let me know. Revdex.com spoke to Brett at business and the following was relayed: The business stated that they were waiting for confirmation that the resending of the check was acceptable. A check is expected to be sent out on or before Monday and sent certified.
