Complaint: [redacted] I am rejecting this response because:I did not agree to a two year contract at $a month, it would not make sense for me to sign a contract for MORE than I had agreed to pay The VERBAL agreement I made with the GM was for a month to month membership The contract is not valid as there is no date by my name for me to know when I physically signed it, my address is outdated and the credit card information on the contract is outdated; all of which were not valid at the supposed time I signed this contract IF the employees at Finneys were to have me sign a legal document would they not make sure that my information is updated and that the credit card information is correct I believe that my signature is on the contract either as a digital signature that has been transferred to the document from an old contract I held with Finneys or when I signed after having my new credit card ran to establish the new $a month, month to month membership Also, the bottom half of the contract which authorizes Finneys to withdrawal automatically from my account each month is NOT signed I am disappointed that Finney's has been so unwilling to work with me in this manner and the unprofessionalism of the staff I am currently paying on a fraudulent contract so that it will not become a negative factor on my credit report, I plan to take the matter to small claims court if I am not refunded by Finneys for the balance owed to me and all future payments are cancelled Sincerely, [redacted] ***

Complaint: [redacted] I am rejecting this response because:I was paying the $a monthly SOLELY based on a VERBAL aggremebt becuase I was using the gym facilitiesWhen I decided I no longer wanted to use the gym facilities and that I would not be returning I decided to cancel my MONTH TO MONTH agreementFinneys made the cancellation process excessively difficult, jumping thru hoops, meanwhile continuing to charge my account after several attempts and several months after I had cancelled my membershipI have paid the monthly amount, even as of this month, after threats from ABC financial (Finneys contract company) that my account was in default and that I was being sent to collectionsI will not allow this matter to negativity affect my credit rating and will be receiving a full refund from Finneys or I will be taking the matter to small claims court Sincerely, [redacted] ***

I am rejecting this response because:I did not agree to a two year contract at $a month, it would not make sense for me to sign a contract for MORE than I had agreed to pay. The VERBAL agreement I made with the GM was for a month to month membership. The contract is not valid as there is no date by my name for me to know when I physically signed it, my address is outdated and the credit card information on the contract is outdated; all of which were not valid at the supposed time I signed this contract. IF the employees at Finneys were to have me sign a legal document would they not make sure that my information is updated and that the credit card information is correct. I believe that my signature is on the contract either as a digital signature that has been transferred to the document from an old contract I held with Finneys or when I signed after having my new credit card ran to establish the new $a month, month to month membership. Also, the bottom half of the contract which authorizes Finneys to withdrawal automatically from my account each month is NOT signed. I am disappointed that Finney's has been so unwilling to work with me in this manner and the unprofessionalism of the staff. I am currently paying on a fraudulent contract so that it will not become a negative factor on my credit report, I plan to take the matter to small claims court if I am not refunded by Finneys for the balance owed to me and all future payments are cancelled.

Again, member's data was lowered to $80.00, we were billinghim the amount verbally agreed to after the original membership (for $100) was forst agreed amd set-up. The member had no problems paying the amount ($80) as agreed upon afterwards and that iw all we have billed. If the agreement was not signed by member, why did he pay for months of the month agreement and then decide it was not correct? There are not refunds due at this time because the memebr has already disputed the charges with his credit card company. We will discuss with our billing company the remaining dues payments that are still owed

Member enrolled on a year membership plan for $per month. Start date was 6/6/2016, expires 6/30/2018. Member's contract rate was lowered to $per verbal agreement. Contract was not changed or altered, just made less costly for member. (see attached) Members can
cancel only due to permanent disability or relocation. Member has not provided any documentation to cancel due to those reasons. membership cost is not based on usage. The facility is open and is offering and providing it's services
