I'm writing this letter to response of complaint # [redacted] I'm [redacted] Eyer and here is what happenI sign a contract to build a patio cover attached to back of house and apply new roof to the houseI was to frame in the new patio cover and have it ready to install roofThat way it could be completely roofed at one timeI had the patio cover ready to roof and since it was attached to house I had to tear into existing roof to build patio coverOnce I got to the point where the job was ready to roof which was the very next day the roofers would start I only had the patio temporary dried in to protect from weatherI watched the weather forecast at 6pm the night before we would start roofing the next dayThe report showed no rain till next day around noonThat would have gave my roofers time in morning to professional dry in the new constructionMy crew that built the structure isn't a professional roofer they are framers so we did the best we could on temporary dry in areas that the new construction tied into existing houseWell it ended up raining very hard that night and leaked into houseI do have insurance to cover damage but to this date 6/3/they haven't settled with homeownerSo that's the first thing that happened to get the work relationship off to a bad startAlso the way the back of house was designed there was two roofing styles to build the coverI usually build what I think would look the bestI told the home owner when we get to the point where we needed to select roof design it changed what I hoped I could build itI have text messages where the night before we had to decide the homeowners couldn't really decideBut they told me most importantly they wanted it to give them the most ceiling space underneath so I built it that wayShe even brought her father who is a retired contractor to look at itHe made some minor suggestions and told me in front of the daughter that it was built very wellAnd the homeowner was satisfiedOn the contract it stated I would be done my April Well there is always rain days you have to allow forAlso on the contract it states that homeowner supplies the stone for column and the ceiling fanNeither was there by April so I couldn't have completed job in time anywayShe text me on the 4/that she had company coming in on the 5th of May thru the 8th so no work would be done during that timeI have text stating I would be done on my part by the 4th of May minus what the homeowner was to supply me which wasn't there at the house at that timeSo on the day of the 4th of May I was there to finish my part and even had my gutter people who was there to install guttersIt's at this date is where the problem started that lead to both parties agreeing for me not to finish the jobSince the insurance company hasn't paid her for the damage to the inside of house yet she broke off paying me according to the patio cover contractAt this point she owned me $to completeBut there was only maybe $dollars of work remainingAccording to the contract to finished it would take $for gutters / $electrical / $for stone workAnd of course little touch up and misc small things which are minorI have many texts stating to her from the time we stated having problems from the early roof leak that I would finish this job for her and not to worryI went out off my way to do many things to help herEven the night it leaked she called me in the middle of the night and my helper and I was there at 4:in the morning on her roof in the rain just trying to get the area where we tied into house fix to where it wouldn't leakYou have to understand when you tie into a house with a new structure there is a time between when it's framed in and when you can get it properly dried in with shinglesIt was only one night and it happened to rainIn my plus years of building patio covers I have never had any issues with leaks during constructionI take pride in building my covers and I did everything in my power to work this out with herAgain I have many dated texts during construction that my attentions was to complete this job and and give her a quality patio coverDuring construction of the cover she quit giving me my proper draws of money according to the contract until she got a decision on the insuranceMe being a trusting person kept working on project even thou she broke away from what the payment installments wereAgain there was only a small amount of work left even thou she owed me so much moreSo why wouldn't she ask me to get off the jobNow she can have someone else finish it and she saves a lot of moneyAgain I reassured her that I wanted to finish this jobShe forced me to get off the job even thou I was there that day to finish everything that was possible to finishI have many texts to back up my storyI feel I did my bestI truely believe this is all about the moneyAnd how she is saving so much money having me not finishI knew I couldn't have quit working on job even thou I wasn't getting Since the insurance company hasn't paid her for the damage to the inside of house yet she broke off paying me according to the patio cover contract. At this point she owned me $3675 to complete. But there was only maybe $1000 dollars of work remaining. According to the contract to finished it would take $450 for gutters / $200 electrical / $300 for stone work. And of course little touch up and misc small things which are minor. I have many texts stating to her from the time we stated having problems from the early roof leak that I would finish this job for her and not to worry. I went out off my way to do many things to help her. Even the night it leaked she called me in the middle of the night and my helper and I was there at 4:30 in the morning on her roof in the rain just trying to get the area where we tied into house fix to where it wouldn't leak. You have to understand when you tie into a house with a new structure there is a time between when it's framed in and when you can get it properly dried in with shingles. It was only one night and it happened to rain. In my 30 plus years of building patio covers I have never had any issues with leaks during construction. I take pride in building my covers and I did everything in my power to work this out with her. Again I have many dated texts during construction that my attentions was to complete this job and and give her a quality patio cover. During construction of the cover she quit giving me my proper draws of money according to the contract until she got a decision on the insurance. Me being a trusting person kept working on project even thou she broke away from what the payment installments were. Again there was only a small amount of work left even thou she owed me so much more. So why wouldn't she ask me to get off the job. Now she can have someone else finish it and she saves a lot of money. Again I reassured her that I wanted to finish this job. She forced me to get off the job even thou I was there that day to finish everything that was possible to finish. I have many texts to back up my story. I feel I did my best. I truely believe this is all about the money. And how she is saving so much money having me not finish. I knew I couldn't have quit working on job even thou I wasn't getting paid because then she could sue me for job abandonment. I do know my rights. Again I did everything I could to work this out with her.
