opportunity to respond to the complaint filed by *** *** regarding calls made to him regarding his mortgage loan. *** *** and *** *** applied to purchase a property at *** *** ***, StLouis, MO with FHA financing. The loan funded May 12, The Home Loan Consultant (HLC) who worked with Mr*** is a former employee, and is no longer with First Bank. After closing the loan, and when First Bank applied to insure the loan with FHA, it was discovered that FHA shows Mr*** owns another property (*** ***) with an open FHA loan serviced by *** ** ***(On the application itself, Mr*** had indicated that he was renting the property at *** ***.) FHA does not permit a second FHA loan except under very specific circumstancesMr***’s circumstances are not one of those reasons. In order to properly resolve the issue of two FHA loans, *** ***, First Bank Mortgage Sales Manager, contacted Mr*** to resolve the situation by offering to refinance the *** *** property to either a conventional loan or perhaps FHA in ***'s name aloneClosing costs would be paid by First Bank, with no out of pocket or other expense to be paid for by Mr*** It appears that the former employee (HLC) continues to give Mr*** incorrect information in terms of Mr***’s obligation to the loan at *** *** as a result of a prior bankruptcyMr*** refuses to speak to us without our former employee on the lineA recent phone call between Mr***, Mr***, and the former HLC ended without resolution Mr*** has been advised to seek legal counsel to verify that bankruptcy in itself did not extinguish the debt or the FHA lien. Mr*** stated he continued to live in the house and made payments to *** ** *** after the bankruptcy discharge - apparently keeping the current FHA open and active. (The *** property did not appear on the credit report due to non-reporting by *** ** ***, we believe, related to the prior bankruptcy status.) We are not aware of any short sale, deed in lieu, or foreclosure that has taken place. Upon receipt of this complaint, another call was made to Mr*** to discuss this matter. We, again, apologized for any misunderstanding and explained the issue of not being able to have two FHA loans. He would not discuss until our former employee was on the call. Mr*** called back later in the day with the former employee. This former employee continues to lead Mr*** into believing that he has no obligation the loan at *** ***We asked Mr*** to have the bankruptcy papers sent to First Bank for reviewThey have been received and we have verified the loan was not reaffirmed First Bank wishes to assist in resolving the situation by attempting to refinance the *** *** property to a conventional product or perhaps to another FHA loan in ***'s name alone - which would eliminate the second FHA loan issueWe believe this can be done with little, if any, inconvenience to Mr*** and would prefer to do that rather than to take legal action in order to comply with FHA regulations or seek all remedies permitted under the loan documents First Bank welcomes the Revdex.com’s involvement as a disinterested third party.
