I am writing concerning the complaint from *** *** concerning non-sufficient fund charges on his checking account with First Class American Credit Union.Mr*** accesses his account via use of his debit cardHowever, by Mr*** admission, he does not use a register to keep track of when
he uses the card, for what amount, and what the remaining balance should be in his accountThis causes him to lose track of purchases he has made causing overdraftsThe attached history of activity on his account, beginning with January 26, shows the activity of purchases/deposits, as well as each time Mr*** accessed his account checking on the balance, and any "holds" placed on his account from pending purchases.Mr*** has overdrawn his account frequently from this type of handling on the accountWe have refunded his non-nsufficient funds charges previously from this activityHe continues to overdraw his account, and then request the refund of the feesWhen he called after this instance, based on his activity, the charges, and that he was fully aware of the pending purchases he had made, his previous activity/refunds, having been told previously we would not continue to refund his fees we did not refund his fees.In addition, Mr*** had written - $checks to *** ***Mrs*** came to the credit union each day since mid-December to cash the checksEach day they were returned to her as non-sufficient because Mr*** kept the balance in the account under $so that the checks could not be cashed or deducted from his account. Additionally, Mr*** refers to the $service charge on his accountMr*** was sent notification on November 21, 2016, and again on December 7, that beginning January 31, we would begin charging a $service charge on checking accountsHe was aware that the monthly service charge would begin on January 31, 2017.If you need any additional information please feel free to contact me. Re: [redacted], Dear Ms. Ramirez:I am writing in reference to the complaint filed by Mrs. [redacted] about First Class American Credit Union (FCACU). Mrs. [redacted] took out a loan on July 27, 2016, in the amount of $24,881.78, at an interest rate of 4.1 1%. Mrs. [redacted] was refinancing a...

vehicle she had originally financed at a rate of 5.61%, paying off Capital One Auto Finance. FCACU frequently refinance vehicles financed elsewhere with a lower rate to help our members with lower payments, and lower interest rates. At the time of the loan, Mrs. [redacted] had a credit score of 591, which is considered subprime. We have a program for financing subprime auto loans which require a GPS unit be installed on the vehicle. Mrs. [redacted] was fully aware that a requirement of the loan, based on her low credit score, she would be required to have a GPS unit placed on her car. FCACU paid for the GPS unit. (paperwork attached). In Mrs. [redacted] letter she states that we refused to "make more than one payment at a time." As you can see from the payment history Mrs. [redacted] made her monthly payments, as well as a large principal payment twice during the loan, September 13, 2016, and October 12, 2016, and then again when she paid it in full on February 23, 2017. Mrs. [redacted] made large payments, which we accepted. Mrs. [redacted] stated that we did not get a copy of the insurance card at the time of the loan. Mrs. [redacted] signed acknowledgement at the time of the loan that she had to have full coverage insurance and list FCACU as the lienholder on the vehicle. Mrs. [redacted] received a letter stating that we had not received proof of the insurance with FCACU as lienholder. As you can see from the insurance cards/notice received Mrs. [redacted] did not change the lienholder until August 1 9,As you can see from our notes, on March 7, 201 7, FCACU released its lien on the vehicle and had a title released to Mrs. [redacted]. DMV notes indicate they mailed a paper title to Mrs. [redacted]. Once we release the lien then the state (DMV) sends the title to Mrs. [redacted]. Mrs. [redacted] notified us on April 10, 201 7 that she had not received the title. FCACU verified that the lien was in fact released, verified that the correct mailing address was on the title. At the same time we requested a duplicate title to be sent to Mrs. [redacted]. DMV requested a power of attorney, which we sent to Mrs. [redacted]. Since we are no longer a lienholder on the vehicle we cannot go directly to DMV and get a duplicate title as we no longer hold an interest in the vehicle. The fee to obtain a duplicate title is $6.00. I have mailed Mrs. [redacted] $6 to pay for the duplicate title, as well as the paperwork required to obtain a duplicate title. Mrs. [redacted] can mail in the information, which the fee will then be only $2.00. Il' Mrs. [redacted] goes to a DMV office in person the fee is $6.00.Il' you have any further questions concerning Mrs. [redacted] account please feel free to contact me.Sincerely. [redacted]President/CEOWorkstation: **Teller ID: **Account: [redacted]Name: [redacted]Date: 7/5/17 8:30 AM
