Contractor’s Statement of the Problem:? A treated pine fence with cedar tone prestained pickets and one walk gate was installed for this customer? The customer was informed by me of the advantages and disadvantages of the types of fences being offered as well as the warranty and materials guarantee? Customer disputes the warranty? I know that the Revdex.com will see that I am exactly the type of business it wants to promote to potential customers.? Customer Relations Prior to Construction:? I explained the Labor Guarantee which reads “Should any damage occur as a result of incorrect installation, AFHI will repair the affected area at no cost to you for the first yearsAll treated lumber comes with our year no rot guarantee.” ? I specifically pointed out in the initial consultation that treated lumber has a propensity to warp and is not listed as warrantied or guaranteed against warpage? The customer elected to proceed with the treated posts and assumed the associated risks despite other post optionsI cannot and do not offer a 100% guarantee whether Mother Nature wants a treated post to warp or not? It is simply out of any fence builder’s controlTreated lumber is inspected both at the time of purchase and at the point of installation to insure quality? The time frame is less than 24hrs between the time of purchase and installation? We specifically do not buy treated lumber in bulk to store on hand for this reason, which is to minimize our loss on treated lumber that may warp over time and would not be sold to future customers? I want to make clear that treated lumber is not a subpar product and is a good option to use in many applications, i.efence posts? However, potential warpage is a drawback.? I also informed the customer of the potential for unusual / difficult digging? Fence companies in Central Texas expect rock and caliche as part of digging conditions? However, should I need to bring extra equipment and spend an unusual exceeding amount of time to dig through rock conditions, the price could change? ? Upon Completion of Construction ? ? The customer had purchased and was renovating the home for resale? He expressed that renovations were more costly than projected? It is for this reason that I did not charge him extra for the added time and expense of jackhammering out approximately 70% of the holes at the time of completion? I chose to eat the cost of this required added expense due to our previous discussions of his overall renovation costs being more than he had anticipated? He was appreciative? Again, I just wanted a happy customer and potential future fence business? The written off dollar amount for rock digging is $540.00.? ? Customer Resolution Efforts? The customer called to inform me that the gate was warped? I sent an installer to address the issue? Initially, the installer believed one of the cross pieces on the gate had warped causing the gate to not close with an equal reveal at the top and bottom? He replaced the cross piece and documented his work with pictures which showed no real improvement? I updated the customer? We scheduled a second visit to readdress the problem? I purchased and replaced the gate pickets in the hopes that the original pickets were warping and causing the problem? Again, no visible improvementI updated the customer? After the second attempt I was almost positive I knew what the problem was and informed the customer of the potential additional cost.? For the third visit, I personally traveled to Temple to examine the gate, and determined the exact cause of the problem? I found that the hinge post of the gate had warped considerably which confirmed my suspicions and my previous conversation with the customer concerning additional costs? Minutes after determining the cause of the problem, the customer called for an update? At this point the customer stated he had consulted a lawyer and I would be hearing from him? That’s when I made the statement, “Bring It.” Since that time, this customer has mounted a campaign to discredit me on Yelp, Yellow Pages and other sources concerning the quality work I do? Some of these sites do not even offer the contractor the ability to respondFree labor and materials devoted to correcting the unwarrantied warping of the treated pine gate at this point amounts to $? ? ? ? ? In summation, not only have I freely invested $in labor and materials that is not covered under our labor guarantee, but also freely discounted $in additional dig time for a total of $1,for the customer? Despite all my phone conversations, logic and reasoning with the customer, the customer repeatedly ends the conversation with the statement, “I simply want the gate to look and work as it should.” ? Great! My response is, “How about paying for the unwarrantied gate post replacement for the bargain price of $300.00.” ? The easy thing to do, would have been to just replace the post and be done with the customer? However, the financially smart business decision with regard to the added cost for labor and materials, as well as the time that had already been schedule for other jobs, was to stand by my warranty?
