11/20/Dear ***,I am in receipt of your letter from our member, *** *There were rmultiple untruths in *** *'s Complaint statement*** * voluntarily signed up for our home banking product, First Class Anywhere on 5/12/For eight and a half years *** * has enjoyed the free
service that he voluntarily signed up forAll members of First Class FCU receive a free physical account statement and *** account Statement unless they sign up for home bankingIf a member voluntarily signs up for home banking the signed agreement states the member shall receive electronic versions of all regular and credit card statementsThey are imbedded inside the member's home banking account where twelve months of statements are available to the memberWhen monthly regular and credit card statements are generated, an email notification lets the member know that the statement has been created and available inside their home banking accountThe system has been working fine for *** * who has paid all of 2014's *** payments via home banking and they were all on time until his November payment.Per our credit card agreement, our members get a day grace period and payments are due by the 16th of every monthNovember 16th was a Sunday and we even gave our members until we posted our mail on Monday the 17th at noon to make their required payment*** * had not made a payment as of thenOur *** statements were processed and an email notification was successfully sent to the email address that *** * verified that was on our systemSince no payment was made *** *, his account was now delinquent and in accordance with our card agreement a $20,late charge was applied to his account.Delinquent notices were run and a notice was generated for *** * and all other members who were delinquent*** * was now delinquent and his delinquent payment due was $Under our right of setoff $was transferred from his savings account to bring his delinquent account current.It is most unfortunate that *** * could not take responsibility for his failure to make a timely credit card paymentHe has voluntarily used and enjoyed our free home banking service and even logged on to his account on November 17th to transfer money from his savings to his checking to pay other bills and yet did not pay his *** card bill with us! The late fee is applicable and standsThe $payment made on his delinquent account is legal and it standsFirst Class FCU has an eighty-two year history of helping our membersI take offense to the deceptive narrative about this incident which was a total failure on *** *’s part and also take exception to the lies presented about my loan officer who has a sterling twenty-six year history at the credit union*** * wanted to blame anyone other than himself and was curt and huon my loan officer*** * is entitled to his own opinionHowever, he is not entitled to his own set of facts.Sincerely,

Review: I was charged a $20 late fee on my credit card, I have not received a billing statement in months, when I called the credit union to complain they said I was transferred to E-Statements, I checked my E-Mail, I have never received an E-mail from the First Class Federal Credit Union, they also made an unauthorized $20 payment from my savings to the credit card account, when I spoke with Joe at the credit Union who handles the [redacted] accounts he told me its my problemDesired Settlement: I want the charge reversed and were any laws broken thru these deceptive practices

All members of First Class FCU receive a free physical account statement and [redacted] account Statement unless they sign up for home banking. Under our right of setoff $20.00 was transferred from his savings account to bring his delinquent account current.It is most unfortunate that [redacted] could not take responsibility for his failure to make a timely credit card payment. He has voluntarily used and enjoyed our free home banking service and even logged on to his account on November 17th to transfer money from his savings to his checking to pay other bills and yet did not pay his [redacted] card bill with us! The late fee is applicable and stands. The $20.00 payment made on his delinquent account is legal and it stands. First Class FCU has an eighty-two year history of helping our members. I take offense to the deceptive narrative about this incident which was a total failure on [redacted]’s part and also take exception to the lies presented about my loan officer who has a sterling twenty-six year history at the credit union. [redacted] wanted to blame anyone other than himself and was curt and hung-up on my loan officer. [redacted] is entitled to his own opinion.
