Punch list#spackle job on some areas I will be more than happy to correct it #waves in the wall cannot be corrected because of the original structure the way the house was built#pink paint in the corners of the shower area looks like manufacturers defect will also correct that#the
toilet was placed in its original spot the vanity can be replaced for a Smaller one#paint on the tile we did not see it we can remove it.The window was on back order as soon it will be delivered at the warehouse I will call you and set up a date to install it also the floor saddle.we would be more than happy to fix the problems

I am not sure if [redacted] read my prior and latest response.  We can not take any additional time to rectify his mistakes.  No one mentioned emotions.  If the bathroom could not be done properly after all this time, it is apparent and clear that he will not do a satisfactory job any other time.  I will not subject my father to any additional work by this contractor.

We cannot extend this time period any longer for my father’s sake. [redacted] said he was experienced and would get done within five days. Now, it has been an unreasonable amount of time yielding faulty results.  This is especially true under the current circumstances.  [redacted] wants to go into next week with this, which is one month for a bathroom.  Due to my father’s health concerns, he cannot be around anymore noise, disruption and chaos. He needs his normal routine back to avoid confusion.  I cannot extend this period of time to fix the contractor’s mistakes.  [redacted] has had more than ample time to complete the job correctly. This cannot drag out any more than it already has.  A correct spackle job takes days, then painting again to follow.  The toilet area should have been measured the first time. There were no waves in the original structure.  He also had no intention of doing the window, and now, all the molding and sheetrock would have to be removed.  A window gets done first, then you finish the area around it.  Also, not all of my concerns have been addressed.  For example, what about the poor sheetrock job, the garbage removal from this project, scratched tiles, the back light, shower placement, etc.  When the time is right, I will get an experienced contractor to come in and complete this job in an appropriate timely manner.

This case is against:

My father's floor caved in and I was looking to patch the area. I called [redacted] from Pennysaver and he said he could do the entire bathroom for $2900 within five days- all new supplies and materials that he would supply. I would not have agreed because I knew that my father could not be without a bathroom due to his health issues, but [redacted] said he was in danger. It was promised to be quick and inexpensive. Work began 1/**/15. Today is 2/* and no bathroom. His ad reads that his work is guaranteed.

Additional details are below.

Work not done in contract and as promised- new custom window, rot removal, lighting, plastic lining under showing basin, shower placement, also and a problem to do the ceiling as he promised (total gut). He changed his mind and was going to paint over mold and drooping ceiling. My husband, [redacted], spoke to him about this and he said he would do it. However, he changed his mind when he saw me.

Work done incorrectly/poor workmanship- sheet rock was a mess with big gaps, ceiling is a patchwork job, cement board for shower was cut wrong and too short, shower floor liner that goes under basin was not used, wall was not cut and installed properly – it should sit behind lip and not have a big gap. See all pictures. He also promised he would install a new shower where I wanted it, and then he wanted to paint a 40-year old shower to avoid the work. I paid for all shower costs. The only thing I wanted him to do was to stick by his word and install a new one where I wanted it. I got a new one, but not where a wanted, not the one I wanted, and it was done incorrectly. He said I could not get the one I wanted because it would be in stock on 1/**. Meanwhile, it is now February and the bathroom is still not done.

Damaged product/supplies- Tiles at the entrance of bathroom- cracked and chipped (not sure if toilet dragged on tile). He also changed his mind and wanted me to get all supplies. He asked me, as a woman, to pay and pick them up. That is not what the contract reads.

Time frame- Week 3 and Day 16 (not within five days as promised). This is not a normal person that he was dealing with and should have made this a priority for an elderly man with health issues.

Threats/Harassment- “Do not ask for time frame again” and to answer him when he is looking for a $12 bag of grout that I had to buy. He also demanded balance be paid in full before job done or else. See texts.

I feel he took advantage of me as a woman and the elderly. He said it was a danger if floor was left and that he could start ASAP and be done within five days. I even gave him crawl space access for accurate estimate. He saw the rotten beams under the house. I feel like he gutted the bathroom, then jacked up the price.

Price/estimate/ guaranteed- changed many times and no addendum or revised invoice as promised. Original invoice is $2900 and includes all supplies.

1/**/15 was the only day I signed a contract. Work began 1/**/15.

*He never once said it could be more money or extra time when doing the contract on 1/** (work to begin 1/** and complete by Friday)- let alone trying to get more than double after gutting it and taking three weeks rather than one.

He also requested all cash.

I am abiding by my original contract and paying the $2900 plus the cost of shower basin as I did agree to. Therefore, I feel he is entitled to $3,000 (already paid to him) after dealing with the above issues. I also paid for all shower materials including tile in the amount of $300. I decided to pay [redacted] by check. It was cashed in less than 24 hours. Check #: [redacted] (Capital One).

I am not satisfied with finished job and it is not what I wanted. I even asked for beach theme in the beginning. I wanted driftwood tiles in particular. He said no because it would bevel, but [redacted] said it would not become so if a plastic material lies under it. He was not experienced in floor tile and ended up sending in a worker. He wanted 12 X 12 and I had to pick out something that easier to use.

[redacted] was told on 1/** that my dad had [redacted] and was on [redacted] for [redacted] which was causing him [redacted]. He promised he would only be without a toilet for four nights. I bought the commode as requested and paid for extra 24-hour care for my dad due to the confusion created coupled with [redacted] and no bathroom. Still no rush to get this done for my elderly parent. Promised work hours 9-5 Monday-Friday. [redacted] showed up 12:30-1:00 except 1/** and 1/**. He also took two days off. He also changed our original plan for shower because he said it would take too long and be too much work. He promised a new custom window and that all rot would be removed. He still left it old and covered up the rot despite requests by myself and my husband to abide by his words and contract to remove all rot (see also text).

Total gut promised including new ceiling due to mold and buckling. [redacted] then said no new ceiling, then said he would do new ceiling when my husband came, then again no ceiling when I was alone, then he did patchwork job on new ceiling upon requests based on our original agreement (see contract stating total gut).

Two tiles by the door look cracked and scratched. Was the toilet dragged on tiles upon installation? Bad tiles put right by entrance?

Original contract $2900- includes total gut, all new materials and supplies and labor

The contract/agreement was made based on [redacted] stating that my father was in immediate danger of the floor collapsing. Based on his safety, and [redacted]’s pricing and time frame provided, I agreed to the $2900 to be done by 1/**. I feel like I was taken advantage up as a woman and alone with my elderly father. See Day 2.

Day 2- After gutting the bathroom (except for ceiling), [redacted] more than doubled the price of the estimate. I gave him full access to the crawl space for an accurate estimate and he did go down and look at wood/beams. He said did not know he needed extra wood. My husband, [redacted], heard what was happened and questioned his pricing (which took a couple of hours of work to complete beams), and [redacted] stated that he did not have to justify his pricing and said, “It is what it is.” He then came down $1,000 to $4900. He never gave an addendum or revised invoice as promised on 1/**. On 1/**, he asked for my invoice back and he crossed out numbers. I never signed again, except on 1/**.

He is not entitled to any additional monies based on poor quality of services, no work done as promised, faulty/damaged supplies, incorrect time frame, extra home care costs amounting to thousands to help my father with commode, and harassment (even asked for balance before completion- see texts). Shower was left where it was despite our original discussion because [redacted] said it would put him behind and be too much work. I had to agree because it was 1/** at the time and I wanted to be sure my father had his toilet ASAP. Now, there is a shower in the way and we will not be able to get washer and dryer past the space. It is not where we wanted it. He also took away the back light- said that was too much work now as well, although the wire and old light was still there. Unethical business practices. Everything that was guaranteed and promised was false.

My father smells from [redacted] and asks for a shower. He has also urinated on himself and throughout the house due to work being done and for being without a toilet that he is used to (long-term memory) for so many days. It was distressing for all. I want him back to his normal state.

Pictures show poor quality work and work that was not done as promised and no new materials. See his contract for work guaranteed.

[redacted] did not remove any garbage, although he promised and I also requested before the snow storm. He told me no (see also text).

Undue stress and anxiety, yet I get I text from Him stating that all I do is give him grief. He then demanded the balance be paid in full before the job was done if I do not stop asking him questions. In fact, all I have been doing is trying to take care of my father and plan accordingly for his care if I cannot be there while this is going on. I question who, as a businessman, talks to a client like this. I also do not need to know that he supports is 25-year old girlfriend still working on her bachelor’s. There were other unprofessional and inappropriate as well. I see this man as a predator.

Caregivers are witnesses to all of this- [redacted] and [redacted] will all attest to what has gone on. He would be sitting in the van for hours instead of working when he did finally show up. This project was so important because we are dealing with an elderly person with health concerns.

Contract- verbally changed over four times.

He also wanted me to get all supplies including tile, vanity, toilet, etc. All supplies are included in contract. He went back and forth with this.

Work was promised to be done by 1/**, 1/**, 1/**, 1/**, 1/**…… It is Day 16 as I type this.

Instead of my dad celebrating his [redacted] birthday on 1/**, he was urinating on himself because of no toilet.

[redacted] said he could not work due to flurries.

1/**- [redacted] asked that I get all supplies. No a.m. work again. It should be urgent with storm approaching.

[redacted] lost paint swatch and we went back and forth with this. He then told caregiver to tell me to buy my own paint.

Mental turmoil and confusion for all involved. It takes over an hour to have Dad try and urinate in commode and often accidents.

[redacted] makes you feel like all work that was guaranteed is an inconvenience and that you are bothering him to do work he promised- including shower, window, lights, garbage removal, etc.

[redacted] left and covered rotten wood although written up in contract and requested that it get done during course of work when I saw it not getting done (see text).

Then, he was giving us a blue or charcoal toilet when I told him I wanted white on 1/**. I e-mailed him supplies as he requested because he said he would get them and pay for them (he later changed his mind a couple of times). See text. I finally got a white toilet for my father.

I bought bathroom lights/fixtures; all shower supplies including tile, grout, mastic, all miscellaneous bathroom items, etc. (see receipts).

Sheetrock job also a mess (pix).

Shower wall done incorrectly- should fit behind lip (see pix).

I felt “corned” each time I came alone because he would make demands on me- changing prices, changing who get supplies, etc.

I expected to pay for extra 24-hour care for Dad from Mon.- Thurs. because those were the only nights promised without a toilet. The care is now costing thousands for Dad and into Week 3. This entire situation has thrown my father off and I hope he adapts when [redacted] is out of the house.

[redacted] attempted to make it like it was my fault he was behind behind. I told him that maybe he should show up on time, send in crew, and do whatever it takes to get the job done at this point. See my text.

I could not even get the type of shower I wanted because he said he would be out of here by 1/** and shower would be delivered 1/**.

Late hours working bad for my father. He wants to go to bed. It is not right to start a job some days at 2pm and work til 8pm. I explained this to [redacted], but nothing changed.

The little things matter…he could not pick up a $13 light fixture.

Senior Helpers invoice- see extra charges while this was going on.

Pennysaver ad says all work guaranteed.

No addendum, no revised bills.

He started adding the cost of a plumber to the bill. Then said we will “barter” and I get all supplies.

See text- I gave him grief therefore he wanted balance paid in full (all cash requested) before job done. I gave him grief by trying to plan accordingly for my dad’s care.

I gave supply info many times- see also e-mail. I did what he said and picked the very next day after estimate. They were inexpensive items. This was not a pricey bathroom. We just wanted the basics.

I do realize that some information is redundant, but I wanted to provide additional details and not leave anything out. I trusted this man to do the right thing. It did not happen. Please see contact me if you need additional information or documentation (e-mails, texts, pictures, invoices, medical records, witnesses, Power of Attorney, etc.). Thank you.Desired Settlement: I would like him to abide by his original contract stating that we are now paid in full in the amount $2900 and to finish the job. I signed to nothing else except this on 1/**/15. I also never received an Addendum or revised invoice. I am not even sure of the disputed amount at this time. [redacted] has verbally changed his mind so many times. At this point I am going to guess that he is looking for $2000 or possibly $3000. He tripled the time frame as far as job completion goes as well. I would have never accepted his offer if I had known he would change the price and time frame without any discussion at time of contract. He gutted the bathroom, then tried to take advantage. We are dealing with someone with serious health issues. My father has suffered enough and just wants his bathroom back. Note: I also paid him $100 extra or the shower basin. I have my receipts totaling $500 for additional bathroom costs ($300 for the shower materials alone). I also would like him to finish his work and to be out of our home. Tomorrow will be Day 17 for a small, basic bathroom. [redacted] is dragging this out. He told me that I bother him by asking questions, so at this point I think this is the best way to go. Please help.
