First Class Process Service

Review: I retained this company to make personal delivery service of certain court papers and dealt with someone named [redacted]. I paid for his company to make three attempts at personal delivery. They were unsuccessful in the first two attempts which were made before 12/**/13. I told [redacted] that the latest date that timely personal delivery could be made, according to my lawyer, was 12/**. [redacted] told me that the company would attempt delivery on that date. I called him several times on 9/**, both at the office and on his cellphone to learn whether personal service delivery had been made. I left messages for him to call back as soon as possible, because if he was unsuccessful, I would have to make arrangements to attempt personal delivery service using someone else. He never returned my numerous phone calls that day or thereafter, until I was finally able to reach him on 1/**/14 when he told me that no attempt at delivery was made on 12/**because they were too busy. This was despite the fact that I had been promised that an attempt would be made that day. He told me, though, that they attempted delivery (unsuccessfully) on 12/**. I reminded him that even if delivery had been made on 12/**, it would have been untimely, and that he had told me that the company would try delivery on 12/**,the last day that timely delivery could have been made. Also, he did not give me any reason why he had repeatedly failed to return my telephone calls. Because I had not heard from him on 12/**,I was forced to get someone else to make personal delivery of the documents that day. I had paid First Class to attempt personal delivery three times before it was too late, but they failed to do what they had committed to do. The fact that they had tried twice is of no consolation to me, since they did not try on the date that if was imperative that they do so. They also were supposed to have completed and returned a notarized statement setting forth their attempts at delivery, which they have not done.Desired Settlement: A refund of all of the monies that I had paid ($75.00), or at a minimum, half the monies. My offer of a settlement of half is very reasonable, considering that I had to make other arrangements to have personal delivery done, which it was, on 12/**, when First Class was paid to make delivery on that date, they promised to do so, and they could have and should have done so.
