We have concluded our investigation
into the claims brought forth in the consumer complaint submitted through the Revdex.com’s Web PortalIn case number *** Mr*** claimed: 1. The required assigned consultant is potentially related to the contractor. He contacted the FGMC Draw Administrator to inform him of the consultant’s relation to the contractor, but was told we’ve been working with that consultant for a long time2. He paid out of pocket for many items and was told to send the receipts to FGMC for a refundHe was told by FGMC he would not be refunded3. He feels the lender is trying to force him to use the entirety of the renovation fund, which he doesn’t need at this point First, we would like to apologize for any inconvenience and frustration Mr*** has experienced as a result of this matterIn our discussions with Mr*** regarding his concerns, we have discussed the following steps we are taking to find a resolution: 1. In regards to the relation of the consultant and contractor, the contractor was chosen by the borrower and a third party lender chose the consultant. Since then, Mr*** has terminated the contractor and FGMC has terminated and blacklisted the consultant. FGMC has since hired a different consultant2. In the matter of the refund, we ordered an appraisal to be completed by an independent appraiser. The appraisal will us a value and indicate any items needed to be done to meet minimum FHA standards. Any remaining funds in escrow can be reimbursed to the borrower based on receipts as long as the loan is current3. The renovation fund amount was determined by the HUD consultant. It is based on the contractor, HUD consultant, appraisal and scope of work We will continue to work with Mr*** toward resolution and, again, we would like to extend our apologies for any inconvenienceFGMC’s Consumer Complaints Department works to maintain the rights of consumers through an independent and impartial resolution process. First Guaranty Mortgage Corporation

Thank
you for contacting First Guaranty Mortgage Corporation (FGMC). In your updated
Complaint filed with the Revdex.com (Revdex.com) on November 4th
you expressed
·
that you have
been requested to provide the same bank statement several times and were
concerned that your sensitive information were finding their way to the wrong
hands;
·
you were provided  a short list of conditions that has grown;
·
you would like
the matter resolved ASAP.

On
November 5, 2015:
·
We conducted a
conference call with the mortgage broker – your loan originator. We confirmed
that he had asked you several times for the June bank statement which had not
been delivered with the other bank statements provided. Your Broker had not
forwarded the documentation to FGMC but he did have all items in his possession.
He also confirmed that the documentation had not found their way into the wrong
hands.
·
We confirmed with
you that the reason for the additional conditions is that the manner that your
loan was submitted did not have all factors evident and as we received
conditions additional items were needed in order to get the loan to closing:
o
Permits received
identified that there would be multiple properties on the land;
o
An additional
appraisal would be needed;
o
An FHA approved
engineer cert would be required.
·
We agreed to pay
for the new appraisal to compensate you for the delays you have experienced.
·
We confirmed our
team is still working to expedite your loan to closing.

We
will continue to monitor your loan and work with you toward your loan closing. We take your concerns seriously and appreciate the opportunity to better serve you. If you have any additional
questions do not hesitate to contact me, Kelly K[redacted], at ###-###-#### or toll
