Hello, My name is [redacted]. I filed a complaint on 6/11/2014 against the First Senior Financial Group, LLC.  We have met with [redacted] and and have resolved our differences. The whole thing was a misunderstanding. We did not understand that we could change our accounts each year. We were not told or we just weren't listening. The [redacted] team was very cordial and took the time today to go over everything. I am glad we had a happy ending to the problem.

Review: I was dealing with this agency regarding purchasing an annuity contract. I was told by the agent that I could not see the actual contract verbiage until after I had consummated the purchase via transfer of the funds being invested in the annuity. I was told I then had 15 days to rescind the contract. This seems like a shady way of doing business and presented an added hurdle for me, the consumer, to have to rescind after the fact rather than being able to view the actual contract verbiage beforehand. I feel this agency were created a situation wherein adequate disclosure was not achieved. I refused to proceed and transfer money without seeing the contract verbiage. They, in turn, refused to provide the contract verbiage.Desired Settlement: First Senior Financial Group should change their sales practices so that the actual annuity contract verbiage is fully disclosed prior to the consumer consummating the transaction.

This letter is our initial response to the complaint filed against [redacted] & First Senior Financial Group on 3/12/2013

I would like to introduce myself, I have been the CEO of First Senior Financial Group since January 2012. The insurance Agent that the consumer met with was [redacted]. [redacted] is an independent contractor who does business for First Senior Financial Group.

I have enclosed all of the email correspondence between the complainant and [redacted] and they speak for themselves.

Here are the facts:The consumer states in his alleged complaint:“I was told by the agent that I could not see the actual contract verbiage until after I had consummated the purchase via transfer of the funds being invested in the annuity.”Our response:[redacted] (the independent Agent) did in fact give him the contract verbiage in the form of all disclosures & insurance company brochures including the “preliminary contract summary” and the statements of understanding. The preliminary contract summary includes the verbiage that the contracts would contain. Enclosed is the signature of the complainant documenting that complainant received and read said documents.

The fact of the matter is Pennsylvania insurance statues dictate a Free Look Provision of 15 days, 20 days and in some cases 30 days.

The consumer states in his alleged complaint:“I was told I then had 15 days to rescind the contract.”Our response:That is incorrect he was given 20 days in writing on both the [redacted] and the [redacted] contract verbiage paperwork that both state 20 days. The complainant signed these papers and disclosures (which are attached and highlighted).

The Consumer states in alleged his complaint: “I feel this agency were created a situation wherein adequate disclosure was not achieved.”Our response:This is a false statement, I have included documentation of the complainant’s signature on all contract verbiage that he read and was given to him with his signature proving he had received everything.

Additional response information: The Product listed on the complaint form is listed as a: “Variable Indexed Annuity”

This is incorrect because that would be a Security and we do not sell Security products nor are we licensed to sell them.

These were guaranteed fixed class of assets and not Securities.

As we want to resolve this alleged complaint we have attached all of the documentation that pertains to this situation all of which were given to the complainant.

Mr. Cannella was not involved in the process nor ever sat in on any meetings with the complainant. We are confused why [redacted]'s name is even in the complaint his name should be removed.

I am rejecting this response because:

My complaint is that they would not provide the actual contract verbiage prior to my transferring funds and the insurance companies "issuing" the annuity contracts, First Senior Financial Group's response stating that brochures and a "preliminary contract summary" were provided is NOT adequate disclosure. It is impossible to understand why the complete contract verbiage would not be disclosed prior to requiring transfer of funds. No one should have to consummate an agreement and transfer funds for ANY product or service prior to being provided the FULL ACTUAL contract verbiage regardless of the ability to rescind the contract after the fact. Also, we were, in fact, informed by the agent that we would be shown the actual contract verbiage prior to funds transfer but when the time to transfer funds came about, we were then told a different story; that is, the actual contract could not be made available until after funds transfer and the contracts were "issued"

Review: This company advertises every week on the radio. We can get you 8-12% interest with your retirement money. That's the hook. They get you in there and brag about all the wonders of their company. Pressure you to sign the contracts. Give you all this bonus money. Then give you pies split with the next 15 years worth of lies of how much you will make and how much you can take out. They even make big mistakes with your money when you tell them how much you want liquid and then forget and add it to the invested amount. Oh well, you don't get it now.Desired Settlement: I want all my money back out with not penalty's. They have my money invested for 15 years and I can't take it out for 11 unless I pay the 18% penalty/
