In response to **'s complaint: On Wednesday December 16th, ** joined our gym as a single member by signing a membership agreement. When she joined and signed the agreement she agreed to adhere to the terms and conditions of the agreement and pay $262.34. My employee offered to split the...

payment for her to make it easier on her budget. ** agreed. On Monday, December 21st, 2015 ** delivered a hand written letter requesting to cancel her membership. In her hand written note she cited that she was basing her written request within the third business day of the agreement. My staff member called me and asked how she should handle and I explained that the 3 say right to rescind was within 72 hours after singing the agreement and the third day was the 19th. I said I would be happy to call the member to convey the information. I personally called ** and shared with her that the membership agreement she signed states 3 business days and the third day was Saturday, December 19th. I told her I would make this a win-win by not charging her the balance of what she owed, $131.17 as she agreed to pay $262.34 when she signed up. She was only charged half of the sign up fees, the balance was going to be collected the following month. I informed ** she was past the deadline for the three days right to rescind by 2 days. She conveyed she thought Monday was the "3rd business" day. I expressed that we conduct business and we are open for business Monday thru Saturday and she was past the three day right to rescind. When I shared I was creating a win-win it was from the perspective I was not going to charge her the balance since she was at 5 days for turning in her request to cancel versus the three days. ** was displeased with my response and threatened to take her complaint to the Revdex.com and the Washington State Attorney General. She continued to argue the point she has three business days, and again I expressed the third business day was, Saturday, December 19th. ** then stated, well your employees told me I would get a refund and you should honor what she told me. I shared my employee was human and as human's we make mistakes. ** agreed that as human's we make mistakes. ** stated she was disappointed that I was not honoring the agreement. I then expressed again I am following the guidelines of the "right to cancel" and she brought in her letter on day 5 versus day 3 (72 hours) after signing the agreement. ** was disgruntled by my decision and I stated I was not going to continue to argue the point as she wanted me to provide a different response. NOTE: Members who join our club sign a membership agreement agreeing to adhere to the terms and conditions of the agreement. The terms and conditions of the agreement are in alignment with Washington State Attorney General's guidelines and rules. Based on **'s response, she did not want to be held to the terms and conditions of the agreement she signed. The membership agreement that  ** signed specifically states under: 
"Members right to Cancel- If I wish to cancel this Agreement, I may cancel by delivering or mailing a written notice to the Club- The notice must say that I do not wish to be bound by the Agreement and must be delivered or mailed before midnight on the third business day after I sign this Agreement. The notice must be delivered or mailed to the address indicated above. If I cancel, the club will return, within 10 days of the date on which I gave notice of cancellation, any payments I have made. All refunds will be by credit or check: there are no cash refunds." In addition, the Washington State Attorney General's website http://www.atg.wa.gov/health-clubs, under health club tips, 1. ** could have called or inquired on Friday or Saturday to state she wanted to rescind her rights, however we did not receive a phone call or inquiry prior to the 5 days of ** providing the hand written letter requesting to cancel. Based on her complaint to the Revdex.com I can only surmise she did not want to be held responsible for adhering to the terms or conditions of the agreement she signed. With that said, on Tuesday, December 22nd I sent an e-mailto ** expressing to her, although her written notice was delivered on the 5th day from the date of signing the agreement, I took the time to process her request, I researched the WA State Attorney General's website on the 3 day right to rescind rule, and reviewing our past history with prior members who adhered to the terms and conditions of the three day right to rescind I wanted to ease her frustration and annoyance and I was going to send a refund. A refund was mailed on December 22nd, and ** cashed the check on December 24th.
