Warning to potential buyers - Fischer Homes has engaged in dishonest and deceptive sales practices. In short, they changed the price of the home we were planning to build with them (an increase of by $20k) right as we were about to go into contract. I wish I could give them less than a one star rating.
My husband and I had an initial brief meeting with a Sales Counselor for Fisher Homes regarding a new build in *** Village (*** Neighborhood), Plain City, Ohio on Sunday, August 9, 2020. We set up a second meeting with the same consultant on Monday, August 10, 2020 and had a detailed discussion about what floor plans and features would work best for us. Following our meeting, that same day she emailed me additional information about site fit options and included a detailed document pricing out the "Mitchell" floorplan with the options we discussed. We reviewed this information and met with the consultant for a third time the next day (Tuesday, August 11, 2020) to ask additional questions about the plan. She conveyed to us that she was still waiting on final site fit approval for the garage and driveway on one of two lots. She also stated that if we wanted to secure the home we wanted on the lot we wanted, we should make a decision by Friday, August 14. On Wednesday, August 12, 2020, we met with the consultant for a fourth time (at 1pm), to finalize details of the build and site fit options. At that meeting, we told her it was critical for us to understand the price and options of building this home because we were serious about making an offer on an existing home and needed to do so by 5pm (deadline for submitting offers to the seller). It was at that meeting that I, independently of the sales consultant, noticed the price appearing on her computer screen was significantly higher (approximately $20k) than the price we had discussed the day before. The sales consultant stated that she did not know why that number was higher and thought it must be an error in the computer. She stated she would look into it with her manager after our meeting. We proceeded with the rest of the meeting and obtained the contact info for the preferred financing company for Fisher Homes so we could sign with Fisher by Friday. We contacted the lender as soon as we left the meeting (left voice message, which was never returned). At 4:36pm on Wednesday, the consultant called and left me a message that the price was not a mistake and that in fact would be the new price. Obviously, we could not make an offer on the existing home by the 5pm deadline and therefore gave up that opportunity based on the deceptive sales practices by Fisher Homes. I immediately called the sales consultant and expressed our complete dissatisfaction, and insisted on speaking with her manager. She would not provide me with her manager's full name or phone number. At approximately 6:45pm, we received a call from the sales consultant and her manager and were told that the price increase was announced earlier that morning, allegedly without prior notice to the sales team, and effective immediately. We were also told the price increase was due to labor and material shortages in the industry, and that certain floor plans were now more costly to build, while other plans were somehow less costly to build. Suspiciously, we were told all of the plans we had considered would be at the higher price - not just the Mitchell. We were also told a "fact" that belies the validity of the price increase justification: if we wanted to build the same home, the Mitchell, in one of their other nearby (and apparently less popular) central Ohio communities, the price would not reflect the increase (even though the labor and material costs would be exactly the same). We were also told that customers with floor plans that were now reduced in price (evidently their less popular plans) would automatically receive the benefit of that price reduction, but we would not be afforded the same accommodation.
The proposed solution by Fischer was for us to "split" the price increase with them and we had to close the contract by the end of the day. It was already after 7pm and we had never heard back from their lender. Obviously, this was completely unacceptable.
Fischer changed the price of their home, in just the one Central Ohio neighborhood we were looking in, while we were: (1) waiting on a final site approval by them, and (2) waiting for their preferred lender to call us back. Not only did we waste hours working through the plans over the course of 4 consecutive days, but more significantly, we missed the opportunity to purchase an existing home in a housing market with extremely low inventory of comparable, quality homes. We're quite relieved that we are not going to be building our dream home with a company that has such deplorable customer service and that they'll never get a dime of our money.

Upon purchase of the home, an independent inspection found structural issues with my drainage system (specifically that water would need to run uphill to reach the sump crock). Fischer was notified at that time (Nov 2015) but did not believe this to be an issue. My sump pump has not run since I've lived in the home, which is the result of the drainage issues found during the inspection. I had a certified contractor review my drainage system, and they found (which is in accordance with the original inspection) that the pitch of the drainage system is not conducive to proper water drainage. This will ultimately lead to a flooded basement if nothing further is done. I have notified Fisher, and they are not willing to resolve my issue.

Dear Revdex.com,We understand our customer’s request and appreciate the
opportunity to respond accordingly.The sump pump is installed to remove excess water that does
not find its way away from the home through gravity or other channels. The
water table under and around the home is a key factor in this. If there is a
low water table the drainage around the home would be quick and efficient
without the need of a sump pump. There are manmade and natural trenches the
affect the drainage as well.

Home builders install sump pumps in homes that do not have a natural
daylight, but that does not necessarily mean they have to run. The sump
crock is buried low under the basement slab with gravel and a perforated drain
tile above it. Water always finds the path of least resistance to the lowest
area. A sump pump that doesn't need to work to get the water away from the home is a good thing.

We respectfully disagree with the contractor that the customer
is basing his opinion on. The home is five years old and we’ve not had a report
of water in the basement or hydrostatic pressure issues. There’s been no damage
nor a report of water intrusion in those five years that we’ve been made aware.
We have had some of the wettest seasons in that time frame and no reported
issues.

Fischer Homes is not inclined to perform a repair on something that
isn’t a problem. We differ in opinion of the theory that it will someday lead
to a flooded basement.

We built our home and moved closed in November 2019. When spring came we noticed large amounts of standing water that never drained. In April we started communicating with the warranty department several calls and emails went unanswered. Eventually the superintendent over our community came out and looked at it , told us what would have to happen and left. We thought that meant a plan would be an action to move progress quickly because we made it very clear we had to stop our plans and fencing our yard because of the issue. Couple weeks go by and I get a response that because of the rain they hadn’t been able to do anything mind you in my opinion it wasn’t raining all that frequently. Today is June 19 and the problem is still not resolved. Wow they did come in and start laying a new drain pipe in they covered it back up with dirt we were told they were not finished and they would be back. The drainage problem sits between My yard and the neighbors yard and they have left part of the French drain hanging out of the ground and we were told the sanitation District stop them from tapping in to the water basin.my yard and the neighbors yard and they have left part of the French drain hanging out of the ground and we were told the sanitation District stop them from tapping in to the water basin They were waiting on approval to move forward. Today I contacted the sanitation district who confirm a permit has never even been requested and they have nothing of our issue with the builder. They have left a large ditch that is holding and retaining water mosquitoes are in high volume on really hot days in the health department came out to treat the water because of the mosquitoes. This has been two months with no resolution. In addition construction began on the lot next-door and the construction crew being used cut into a buried utility line cutting off our Internet. I contacted a superintendent over the community Asking about the information they obtained from 811 call before you dig which is required he did advise me I could get that information from corporate or from the utility provider but stated the utility provider probably installed it in an incorrect location because they didn’t see that they crossed the easement into my yard (The utility box sits in front of the neighbors yard and My yard. And there is a centralized access point so my assumption is part of the line had to be where it was). When the technician came out to repair he stated from the information he had available no one called to have the utility line marked prior to them digging. Furthermore we heard our outside water Spicket being turned on when we went outside we found the construction crew using our garden hose attached to our water Spicket to fill up 5 gallon buckets of water to use to mix the concrete they were pouring for the foundation next-door. Assuming this was probably not the first time I called the local water company to inquire if our usage has increased and they confirmed over the past few weeks the usage has almost doubled and our water bill stayed consistent every single month from the time we moved in. This experience was supposed to be a great experience. You go through a process of picking out your light picking out your home how do you want it to look watching it step-by-step be built assuming any issues that came up along the way would be quickly resolved but I found the moment you close on that house good luck getting a warranty department to follow through anything. It took several calls and emails to get my $150 refund because we did not have warranty come out and fix anything at 90 days my neighbor has been here six weeks longer than I have we have lived here for seven months and she still has not received hers even after requesting it. Since October she has been waiting for the warranty department to fix her issues. it’s a slick game that is played because you’re stuck in a house with a mortgage at the mercy of somebody else fixing what they should be fixing. And while many people feel they have no options there is a process to formally put the warranty department on notice through legal action and that is the step we have taken.

My husband and I closed on a newly built home (through *** Homes), 31 December 2019. Because we closed during the winter season, *** homebuilders could not complete the outside; the sod, caulking and painting on the outside of our home. After we moved into our home, 1 January 2020, we were informed that Fischer Homes brought ***. We received a letter from Fisher Homes stating that nothing will change and they will honor all contract and warranty requirements that were recently agreed-to through ***. In May 2020, the company came and laid our sod, but we have not received any information on when our outside caulking and painting will be scheduled. I have emailed and called *** Warranty department and Fischer Homes customer care manager multiple times and continue to get the same excuse. The excuse has been, we are working to get all backlogged homes on schedule to complete and that the COVID pandemic is why they are backlogged. However, Fisher Homes are currently building new homes down the street from us, there is a newer home across the street, that was recently completed, to include sod and outside caulking and painting. This home was completed the week of 8 June 2020. My husband and I are also concerned about our 60 day warranty issues that were submitted at the end of February 2020, these are issues within our home. We spoke to the customer care manager about one of the issues with our stove, *** installed a scratch and dent stove that we paid full price for and was told it will not be replaced. I asked why, and have not received an answer, this was approximately over three months ago. Nor have we received confirmation on when our 60 day warranty submissions will be completed. We are thoroughly dissatisfied with the level of customer service Fischer Home has provided. We also spoke to several neighbors that are having similar issues with Fischer Homes. We kindly request Fischer Homes honor their agreements and close out all delayed contractual work and our 60 day warranty submissions.

Fischer Homes did assume all the warranty obligations for
those homeowners that contracted with *** Homes and are still within
their one-year warranty period. We are and will continue to honor all the warranty
repairs that are agreed to.

The COVID-19 situation did in fact postpone a lot of
services that were either in progress, scheduled or received just prior to the deferral/postponement period. This spring and early summer has been a
challenge, but we’re working through the deferral/postponement time period services as
quickly as possible. We’re a home builder that is diligent about contacting, scheduling and completing warranty service work. We maintain a customer satisfaction rate of over 95% year after year.

The customer’s home has been caulked and painted and our
Customer Relations department has updated them on the time frame of their initial
warranty service.

Thank you for allowing us to respond to this matter. We’re performing
all the interior service work with an extremely safe protocol, so both our
customers and our associates are comfortable with the process. We hope everyone
understands that this entire situation has increased the time to complete interior
warranty items and remains patient as we work through it.

I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Our outside caulking and painting has been completed. However, on 8 July, I sent another email inquiring about scheduling our initial warranty inspection. After learning that several employees left the company, one of which is the customer care manager, the administrative assistant did schedule our initial warranty inspection for August 12th, and I was informed, this date is contingent on the company hiring someone to fulfill the customer care manager’s position.

Based on a “contingency” date in hopes the company can and/or will fulfill the customer care manager position, until the initial inspection is completed and the issues resolved, this complaint remains open.

My husband and I built our home with Fischer in March 2019 at the *** subdivision. we have had numerous issues with this builder addressing our concerns and with repairing our warranty services issues appropriately. We have worked with the construction manager Devin A from day one of our home being built (he was the construction manager who was put in place to oversee our new construction) as well as with our service requests for our 90 day and 1 year service warranty. On many occasions he has told us that our requests are not required to be fixed/addressed (ex: such as cracking/holes on concrete on and under our porch and in our garage and in basement, concrete driveway discoloration, cracks in foundation etc.) We have had a 90 day service which most of our concerns were not addressed and we were told that they would be addressed at our 1 year final service. We are now addressing these concerns at the final 1 year service. My husband was told by the construction manager that our requests repairs would take place within 2 business days. My husband took off work to be available, only to see that bits and pieces of our service were completed. The construction manager did not show up to oversee our repairs by the vendors. We have been told by our surrounding neighbors that the process for them has not been the same for us ( ex: we were told that the construction manager would not be handling our service repairs and that the warranty manager would be handling but this is not the case for us) We have reached out Fischer's warranty service dept. on several occasions regarding our issues. We have also reached out to the warranty manager. We have expressed that we want someone who has the time and experience to oversee our requests. We were told that Devin has been assigned to handle our requests and no other solutions have been offered. We are seeking to have our home requests completed and overseen appropriately by someone who has the time to do this the way it is done for everyone else. We purchased our home for $320,000 and we are being treated as if it was a gift. We are asking for our investment to be treated appropriately.

Fischer Homes sent the division Construction Manager to meet with our customer and review their concerns. The meeting went very well and the Field Manager took the lead again and completed all of the warranty items that were outstanding. He still has one item on the rear exterior of the home, but the customer does not have to be home for this small project to be performed.

We appreciate the opportunity to regain the trust and satisfaction of our customer. The Revdex.com is a valuable tool in making sure that both the business and the customer reconnect when these situations occur.

The Fischer Homes Warranty department works very hard to communicate additional items to the initial list to the Service representatives when they come in. These additions can sometimes lead to additional scheduling dates and times.

It is always our goal to reach 100% customer satisfaction and the Revdex.com continues to play a pivotal role in doing so. We believe we've resolved all concerns with this matter.

I purchased a Fischer home new construction in 2016 and have had literally non-stop issues with the quality of construction since we signed our mortgage documents. Fischer rarely returns emails or phone calls, but when they do it is to either make excuses or state that after the one year warranty they will not resolve any customer issues.

Below is a detailed breakout of the issues we have had with our Fischer home since we
purchased the home in May 2016. I have tried rectify the issue with Fischer
repeatedly with either no response or excuses trying to avoid fixing the issues. This is
not a complete list, but hopefully demonstrates that significant issues exist and the
failure of the HVAC and roof rot has led me to this point.

1 Heating and cooling replacement: In Late 2018/Early 2019 our Fischer
installed *** Heat pump unit suffered a complete failure. Our electric bill
was extremely high during the winter months of 2018/2019 suggesting the
system was relying on backup heat and the unit had failed much earlier than
detected, but was unnoticed until the weather warmed up requiring AC use. As
soon as I noticed the issue I contacted Fischer with a detailed description of the
issues and requesting their assistance given the very new condition of the
system. I was told the warranty only covered a year and that any issues were
the responsibility of the home owner or manufacture of the unit. I sent a copy of
the picture attached to Fischer demonstrating that something had occurred
during construction that potentially contributed to the failure, but was told it was
likely nothing. Neither Fischer nor the installer of the original system could tell me what led to the repair as they only show an
install and nothing noting why the technician would have to remove an ac unit
and move/replace. I contracted with a local company *** heating and
cooling to repair the unit. After discussing with the *** representative who
stated that repairing the unit was not recommended given the high probability of
failure again we purchased a new unit from ***. This cost my family nearly
10,000 dollars on a home that was less than three years old. Approximately one
month after our new HVAC system was installed the unit had a power failure
which tripped the breaker on the unit. *** adjusted the unit, but the
technician stated that the breaker box might need to be replaced in the near
future. I am just noting this for the record as a certified electrician has not
examined the issue of the breaker issue.

2. Roof rotting in parts and leaking due to incorrect builder installation: In April of 2020
after a heavy rain storm I noticed two sections of my upstairs ceiling had visible water
damage. These sections are directly below the attic which required me to enter the
attic for a closer observation. Upon entering the attic I noticed two sections of the roof
had begun rotting from heavy water damage and water had for a significant period
entered the attic. The damage was not visible to the home owner until water had
worked through the insulation to the drywall ceiling below the attic. Given the home is
less than four years old and roofs should last a significant period longer than four years
I again attempted to contact Fischer. I was told by their warranty department that they
only cover damage for a period of one year and that anything damage related was
between myself and my insurance company. In an attempt to avoid further damage to
the home I immediately contacted my insurance company (***) and filed a claim.
After an inspection by a roofing company (*** Roofing) the cause of the issue was
determined to be likely attributed to builder error likely during the construction process.
Given their assessment that the builder was at fault my insurance company denied the
claim citing that the builder is responsible for all defects during the construction
process. I again tried to reach out to fischer on multiple occasions with no response
resulting in me turning to your office for assistance. The lack of response and given
the critical nature of the roof damage I have been forced to once again pay out of
pocket. The roof repairs are going to cost my family over 2400 dollars not counting the
repairs that will be needed to the ceiling and potential replacement of attic insulation to
remove the moldy portions. Below are pictures from the inspection demonstrating the
rotten sections and the companies assessment. A separate assessment by an adjuster

3. Ground level floors creaking: During the warranty period I reported significant issues
with the floors on the ground level creaking and even movement in the floor in the
ground level study. Fischer partially shored up the study floor to fix the movement, but
stated the noise is a normal floor occurrence. I have been in multiple homes of the
same age as our home and have never heard creaking to the level that occurs in our
home suggesting that other issues underneath the flooring exist, but is covered up by
the hardwood flooring and carpet preventing and visible inspection. A representative
of the installer came out, but his solution was to pound nails in the hardwood to
mitigate the sound, obviously this is not possible for the entire floor and does nothing
in the event a building defect is the cause.

4. Master bedroom floor uneven - During the one year warranty we noticed that the
threshold of the master bedroom has a significant bump suggesting that the joint
between the hallway and bedroom has issues. I contacted Fischer requesting they
take a look at it during the one year period, but was told this is a normal issue and that
they would not repair anything. The master bedroom floor also creaks further
suggesting an issue with the floor in this room.

5. Lawn and landscaping issues: Shortly after we moved in and continuing up to this
day I have repeatedly reached out to Fischer regarding their employees driving over
our lawn while constructing other homes in the neighborhood. Fischer has stated they
will have a discussion with the employees, but no solution is ever presented. In
addition to this damage the subcontractor hired by fischer was significantly negligent
when installing our grass as nothing was graded or rocks removed. The employees
driving on our lawn has made the issues worse and clear indents and uneven spots are
visible on the street side of our lawn from repeatedly being driven on by large vehicles.
In addition to this issue I was forced to hire another landscaping company after it was
determined that Fischer installed a pine tree too close to the foundation of our porch
which would eventually cause cracking issues as the tree grew in size. The landscaper
I hired removed three of the four trees Fischer installed either as a result of the
foundation issue or damage to the trees were leading to death of the tree. This cost
me thousands of dollars in issues that should have been correctly handled by fischer
during construction.

6. Related to the landscaping issues our front sidewalk began cracking almost
immediately and was not addressed by Fischer. Given they have multiple
complaints regarding quality of concrete work by their subcontractor I am
unsure if this is an issue in our neighborhood or not.

7. We have had a significant number of plumbing issues in the home. I have been
forced to turn off the sink in the laundry room as it leaked. Kitchen faucet has been
replaced do to leaking, master bathroom sink was repaired due to leaking in the
cabinet. The upstairs guest bathroom sink continually drips and I have had two toilets
repaired in just the four years we have lived in the home. One issue resulted in my
calling a plumber (A Able) after we lost hot water, the plumber stated that he had never
seen the set up that Fischer installed in our home before in the house of our size
leading to a bill of several hundred dollars to remove Fischer’s install and replace it
correctly.

8. Cabinet issues: During my warranty period I reported portions of the cabinet facing
was coming off in the kitchen and guest bathroom. Fischer solution was to use
a nail gun to reattach the cabinet facing which was a temporary fix and resulted
in visible nails on the cabinet facing.

9. Drywall issues: From a routine observation of the walls a person can see significant
defects in the finishing of the dry wall requiring someone to repair the mistakes
before painting anything. Nail pops are a normal occurrence in any new home,
but unfinished patches should never be painted over. This is exactly what it
appears the subcontractor hired by fischer did during construction.

The above list is just the most glaring issues with my Fischer home that I believe will lead to short and long term issues with the home and are not common in a home of this age. I highly recommend that no one ever buy a fischer home given the customer service and unwillingness to address customer concerns even within the one year warranty period.

Thank you for your alerting us
to the concerns of Mr.. We appreciate this service as a valuable tool
to facilitate communication with our customers when challenging issues arise.
Fischer Homes’ goal is to achieve 100% customer satisfaction, however, there
are times when parties simply cannot reach an agreement. Below is the response
of Fischer Homes. Our customer submitted an
initial service request on July 29, 2016. However, this initial warranty
request did not raise any issues relating to the HVAC system or roof. Buyers
elected to decline the Final warranty service.

It was reported to you that
they had concerns with the HVAC system and roof. Regarding the HVAC system, they
describe replacing the HVAC system in 2019 at the advice of their independent
contractor. Fischer, nor its trader partner, were advised of the issues,
provided a right to cure, or an opportunity to offer suggestions and/or
guidance. Upon information and belief, the original HVAC manufacturer provides
a 5-year warranty and an additional 5 years if the system was registered. It is
unknown whether Buyers’ contacted the manufacturer to discuss the warranty
procedure or exercise same. Our customer also raised
concerns with the roof structure. As indicated above, upon information and
belie that this was the first time that Fischer was made aware of the concern.
Unfortunately, we’re almost three (3) years past the warranty period, which
expired June 3, 2017. Also, exterior components such as roof, ridge-vent,
flashing, and caulking are susceptible to naturally occurring conditions and
require regular homeowner maintenance. It is unknown the what caused the repairs
to be performed by their independent contractors or their maintenance regimen
since closing over four years ago. Thank you again for
facilitating dialogue regarding our customer’s concerns. Fischer Homes does not

Feb 27 2020 we decided to go forward with a Fischer homes New Construction build. Shortly after that due to COVID19 everything started to fall apart. On March 16, we contacted Fisher homes to ask about our options for cancellation of the contract due to the extenuating circumstances with the economy etc. As of this date we had NOT completed any final selections or signed off on the final blueprints. No ground breaking had started , Fischer had not started any of the build process.

We advised we would like to cancel the contract and a return of our deposit of $3000 ($1000 was to hold the lot, $2000 deposit on the home. We were contacted by our sales agent who said he had to forward the cancellation on to Christy his sales manager.

Christly contacted us , she ask that we take 2 weeks longer to think about it. She offered that maybe since this was the beginning the the COVID issues and that things would likely get better in a couple of weeks she ask us to wait. We said we would take the weekend however we had been going over everything that had been happening for the last couple of weeks before making this tough decision. However as things have went with all the the changes with COVID, everything became shut down, the economy took a significant hit, we went under lockdown etc. We personally were impacted.
Monday March 23 we advised Christy we were requesting to go forward with the cancellation and return of our deposit of $3000.

Many people are facing uncertainty and we at Fischer are doing our best to honor the commitments made and work through situations as they become firm. We are asking our customers to do the same but understand that you in this moment are not comfortable continuing the process. We hope that once things settle down you will return to us and build the home you were wanting.
We will cancel the agreement and retain your deposit to be used with us for a purchase up until 9/25/2020. Our hope is that within 6 months you will be able to take advantage of whatever our opportunity is at that time (pricing, site availability, etc.).
If you decide you would rather remain in the agreement and we pause the situation for 2 weeks we can look into that option as well. I know it's difficult to give anyone peace of mind in a time like this but we do believe as the days go by things will settle down."

Of course things have not "settled down" things have only gotten worse. This is really not an acceptable practice at this time.

With so much uncertainty within our state, our country we cannot commit to the purchase of a home today or in 2 weeks - 6 months. This has taken a toll on our financial situation and we don't see a quick turn around. Placing an arbitrary 9/25/2020 date for us to make another purchase or forfeit our deposit is not within reason - we have no idea where our country will be in September, - we have no idea where you will be building, if we will like the communities, the models available.
We would like to cancel the purchase agreement with the full return of our deposit.Please amend the contract to include the return of our deposit. We would like this resolved as this is adding undue stress on our family.

This situation going back and forth with Christy at Fischer homes was causing additional stress on our family. Having to deal with a company being so stern on a contract during such a difficult time. We ultimately signed the cancellation, with them retaining the $3000. This was not something we wanted to do but Christy was not understanding the gravity of the situation going on. I did not want the stress of having this valid contract for build hanging over our heads. I no longer trusted this company.

We have sent all correspondence to Christys Manager "Brian J " 04/07/2020 his response is "I appreciate you reaching out. It is our goal in the next several weeks when things return to normal for us to pick up where we left off on your new home purchase. We understand your concerns which is why we have provided a short term solution without having long term penalties, per the terms of Purchase Agreement we were in . We look forward to earning your business in the near future. Please stay safe and healthy and we look forward to working with you in the near future Sincerely Brian J Market President"

Brian obviously did not read all the correspondence. We responded to Christy , Brian and several exec at Fischer homes, as of today we have not gotten any responses.

We would like the return of all of our deposit. Fischer will sell the lot and another home on the site. As they indicated business for them is booming they are not experiencing an issue in the economy even with covid 19 shutdowns.

It is very discouraging to have Fischer homes standing so strongly during such a difficult time

Fischer Homes would like to acknowledge that a request to cancel the contract
was received and executed under the terms of the Construction and Purchase
Agreement. Fischer Homes had many processes already in place when the cancellation
request came in, but rather than simply deny their request per the terms of the
contract we extended their start time out six months. We fully understood their
need to see where the current situation was going to go prior to starting back
up with home build.Our Sales Manager explained how well the sales of previously
owned homes and currently pending in the Cincinnati MLS as well as our new home
sales. The home building industry was standing strong and realtors needed
inventory to sell due to the demand. The interest rates were at all time lows and
our area was taking full advantage of them. Again, we understood why they had some concern, so we gave them
multiple options to consider. Unfortunately, they chose to execute an Acknowledgement
of Cancellation without refund of their deposit. Fischer Homes had incurred
expenses at this point in the process that the actual deposit did would not offset.
We did try to make numerous offers with the six-month extension being the most
opportune for them, but they chose not to accept any of them.It’s unfortunate that this situation came about and we wish
they would have opted for the six-month extension. We know now that would for
sure have been the most opportune scenario given the current home sales and the

Our Fischer home has several major problems. We have sewage back up in our basement because they used incorrect piping underground. They also used pvc pipe rather copper for our water pipes.

My Fischer Home has been a nightmare, from flooring that was an upgrade was lifting and wavy took months to resolve. Roof was a mess, shingles lifting and flapping in wind a week and half after moving in, was patched and reattached several times. My insurance company came out to take pictures of the house and put my roof as highly unacceptable and gave till June 5th 2019 to fix or replace, well after months of going back and forth roof was replaced. Numerous electrical issues, *** rewired my garage door because it wasnt wired right, 4 times either garage door wouldn't open or close, not had a problem since. Plumbing issues, sewage backing up in house, they said it was my *** toliiet paper, I have resorted to putting pee toliet paper in garbage can and only poo toliet paper goes down because last time it backed up about 2 weeks before my warranty was up they said they weren't covering it because the replaced the toilets but they didn't clear the line . There is an issue under vanity in master bedroom that the paper is getting stuck at the tee. This home is our forever home and we built it the way we wanted it. My other home we were in was built in 1900 and I never had a sewer back up and all this issues there. I wouldn't recommend Fischer Homes to anyone. RUN AWAY FROM FISCHER HOMES.

On Sunday, January 12th, 2020 my wife and I met with Fischer Homes' sales counselor, Andrew C, at their *** community to finalize pricing for their Wyatt floorplan. In that meeting, my wife and I upgraded quite a few pieces of the floorplan and came to a comfortable total of $311,350 (base price $287,990). A few hours later, Andrew called to inform us that Fischer Homes would be executing a market price adjustment on January 15th, he explained that these adjustments are usually a couple thousand dollars to make up for pricing changes in building materials (drywall, contractors, lumber, etc). We didn't like that, but understood and agreed to return on Sunday, January 19th, 2020 to sign our contract.

On Sunday, January 19th, my wife and I met Andrew at the Fischer model home in the *** (***, ) community. After exchanging pleasantries, Andrew explained that Fischer's market adjustment was $26,000. Taking the base price of $287,990 to $313,990. To say we were shocked is an extreme understatement. Later that evening, I emailed Andrew laying out our complaint, and citing personal experience with honoring quoted pricing.

Andrew then called us on Monday, January 20th and explained that Fischer was willing to take of $12,000 of that "market adjustment." We told him we still found that unacceptable, and asked that he provide contact information for his superior; he did so and my wife sent an email for Emily Murray explaining our issue and laying out our case for an adjustment.

On Wednesday, January 22nd Emily scheduled a call with my wife and I. During this phone call Emily explained that the price increase was due to an error in initial pricing by Fischer. They hadn't expected the market to rise as it apparently did within their building communities, and with the Wyatt floorplan specifically. She offered numerous apologies and said she'd be just as upset if she were in our shoes. However, she said there was nothing she could do, but as a consolation she wanted to provide us a $3,000 GE Profile refrigerator. A measly consolation compared to the $14,000 over initial quote we would still have to cover.

We find this practice to be deceptive, outside industry norms, and acting in bad faith.

***On Monday, January 20th, thinking we wouldn't see any reduction in price, we spoke with *** with *** in the *** community. We designed a comparable model to what we designed with Fischer, and came out to almost the exact same total price. We asked *** how long that quote would be honored and he told us all of their pricing is good for 30 days. He explained that time frame is pretty standard for home building in the area.

Homes would like to respond to the allegation that our practice was deceptive
and outside the industry norms.

We believe our sales team was as business transparent as it could
be. They relayed that an increase in base cost was coming due to the current
cost to build the home. The Sales Counselor was not using this as a pressure tactic
just being perfectly honest that the home was set to have an increase on
January 15th. Once the prospective customer requested to speak with our Sales
Manager she did apologize and shared that because our product/service is
complex and involves many parts and trade partners, we need to be able to
adjust our pricing to build at today's fluctuating costs. This is why
we don’t guarantee pricing until it’s locked in with a Construction Purchase Agreement
and our Agreement Check List is watermarked for discussion purposes only. We do have price
increases that the Sales Counselor spoke of to cover the rising cost of
construction and the dollar amount varies depending on market
conditions/trades/materials. However, this increase was a higher due to our
base price being out of line with our cost to build the home. She understood why
they were upset and apologized for any negative experience they may have incurred. While there wasn't anything she could do regarding our cost
to build the home she offered the GE Profile French Door Refrigerator at no
cost to them should they decide to decide to proceed.To conclude the original pricing was for discussion purposes
there was not a contractual number. When it was learned that a base cost increase
was due it was immediately communicated to the prospective buyer. They opted
not to move forward prior to the increase.We apologize that the amount was a bit higher than
anticipated, but an increase was clearly communicated. The Sales Manager tried
to offer a no cost appliance for this reason, but it was not accepted.

While my wife and I disagree in the strongest terms with their response, we are no longer interested in working with Fischer Homes.

I spoke with the *** Market President on Tuesday, February 4th. He wanted to reiterate to me that he was deeply sorry for the increase in price and wanted to ensure this was in no way his sales team's fault; so we shouldn't be upset with them. He then explained that on January 3rd he recognized the estimated cost to build the Wyatt floorplan was entirely too low and they would need to execute a base price increase of $26,000. Though he didn't explain who he did communicate that with, he did say our Sales Counselor was not one of them; the Market President admitted that perhaps he should be more transparent with his sales staff when price increases are that high in the future.

Obviously we understand businesses must have the ability to adjust their pricing as needed for fluctuating costs (though, those costs never seem to decrease). But when that increase isn't communicated to staff that shows at minimum a lack of transparency within the company, and perhaps even a level of deceit. An increase that high is more like a bait and switch, rather than a simple adjustment of costs as it was explained to us prior. To have that increase then be passed on to a customer mid-process simply seems to be deceptive pricing, at least to us.

We were in no way suggesting our Sales Counselor was pressuring us, simply that had he known the price increase was going to be that high he would've let us know. His statement that the price increase "shouldn't be more than a couple thousand" was totally understandable. We lay no blame on him.

Their apology "that the amount was a bit higher..." is laughable. When someone is expecting an increase of "a couple thousand" and instead hears a number nearly 13X that; that's more than "a bit."

We want to thank the Revdex.com for allowing us this opportunity. My wife and I will be moving forward with our home buying process with another builder in the area and won't be conducting business with Fischer Homes at any point, now or in the future. We'll be advising others to do the same.

In the Fall of 2019 a new house was built behind my home and ever since the yard was graded/landscaped my yard began taking on large amounts of water. This water has no place to drain and just sits idle for weeks/months. I’ve contacted Fischer homes who is the developer of the neighborhood and they attempted to fix the issue by installing a drain at the edge of the fence. During this process the landscaper cut my internet lines and didn’t’ notify me and did not even call 811 dig before coming out. The installed drain has seemed to help part of my yard but I am still collecting large amounts of water on the other side. I have hired a professional to tell me what needs to be done to drain the water from my back yard. They explained I need French drains/catch basins all along my back yard to move the water. I communicated this to Fischer homes supervisor several times and they keep ignoring my messages. Several of neighbors are having similar water problems in their yard and Fischer Homes will not accept that they need to do something about this water drainage. My fence in the back of my yard is beginning to rot because of all the pooled water and some of my newly planted trees are in jeopardy of getting root rot. In addition to the fence and tree problems as a result of this water, it is highly unsanitary to have large amounts of standing water in any residential neighborhood. At this point, it is winter where mosquitoes are not a concern. However, in a few short months this amount of standing water will attract mosquitoes and be a hazard.

With the lack of action from Fischer homes I figured I’d get the Revdex.com involved.

out to the Construction Manager and the community Field Manager and found that
they have both been working on a resolution to the drainage matter. I
questioned the allegation that they were ignoring the situation and received a
lot of screen shots showing continued communication. The weather has been the

team has since met with all of the affected homeowners and devised a plan that
should rectify the matter. We’re going to install the French drain system
rather than ask to have some sections of the fences and trees removed that are

We have an outer valve leak outside. Our home is only 2 years old and there is nothing that we could have done to cause this. I have tried to reach out to Fischer multiple times to have this addressed and I am either told to call back, it’s not our problem, or to call a plumber. I have built multiple homes with them and recommended them to friends and family. They use poor subcontractors and have multiple Revdex.com claims. We may get an attorney involved.

Thank you for allowing us time to research this matter and resolve it. We did request one of our plumbers to investigate this out of warranty claim as a courtesy to our customer.

The plumber reported back that the bleeder valve inside the water meter pit had had become very loose and was the source of the leak. He tightened it and the leak has ceased.

The original installation of this component was performed by the utility company and it’s typical for the valve to be loosened to ensure water flow.

We appreciate the opportunity to resolve this situation with a valued customer. We’re fairly confident that his matter has been settled amicably.

We just closed on our house in maineville ohio and we couldn't have been more disappointed in the entire process. Our realtor and several friends recommended Fischer so we decided to build with them. From the design center consultant, sales consultant, superintendent and their management team, their only focus was the closing date. Their customer service was some of the worst we have experienced. The design center didn't even offer us any opinion or help to designing our entire 3000 square foot house. The superintendent promised weekly updates, more times than not we had to ask for the update. His communication was terrible throughout the 5-6 months of the build. Many issues were brought to his attention throughout and he ignored most until the home orientation, at which time they were discussed. But when we put a little pressure on him to repair things correctly he shut down and left the room. Our 'luxury shower's tile was horribly laid, not flush, level, multiple colors of grout, when asked if it would be replaced the superintendent wouldn't answer so we spoke to his boss, well he made the same excuses as the superintendent and wanted to know how we got his number! He also criticized us having a final inspection of the house. He said industry standards are sometimes different than customer expectations. Prior to the final walkthrough we received a call from the sales consultant telling us to play nice because things go better with a better attitude! We were scheduled for our final walkthrough but the shower wasnt ready in time so my husband called corporate and we met at the house with a team of 3 corporate managers and were told that the house would be ready by the following week. Well we showed up the following week and the shower was still not fixed as promised and there was still drywall that hadn't been painted, when we called corporate at this visit the manager was rude and again threw industry standards as the reason the shower was the way it is.
She told us that "we would have to agree to disagree as the shower was complete and nothing else would be done to it". This was after being told everything but the floor tiles would be replaced but that didn't happen. We have been lied to by every member of Fischer's staff. We would never build or recommend Fischer with the customer service they provided. We are still not happy with the shower but they won't make it right because it meets industry standards.

Fischer Homes takes reviews of customer dissatisfaction very seriously. We research the allegations thoroughly with all of the associates that were closely involved prior to responding to these matters. We work extremely hard to maintain our customer satisfaction rating of 97% and higher year after year.
While some of the allegations of our associate’s statements and other events were either unable to be verified or deemed out of context we did find that the master shower was not up to our standards. The Market President did meet with our customer and agreed to have it reworked. Once this was completed it was re-inspected and the workmanship met our quality requirement.
Again, Fischer Homes takes our customer’s concerns earnestly and makes every effort to accommodate anything that doesn’t meet our standards. We feel that we’ve complied with this matter and fulfilled our commitment to deliver a quality home.

On 10/6/19 My wife and I visited sales associate Sheena *** at Fischer Homes Arcadia in ***, . We reviewed the process to build a home, what we were looking for and requiring in a home, and looked at 3 lots. One of our must haves was a lot with back yard privacy. We didn't want to look into our neighbors yard but we wanted trees. Shenna mentioned that lot 244 was the only lot they had left with the privacy we were looking for that they could build the floorplan we wanted. During this meeting we asked about the walkout conditions of the home, was it an upper or a walk out basement. We were told it was an upper and that we could add on a cement patio and the basement would be underground. This would allow us to walk out of our morning room onto a patio to grill out and use our yard. We knew lot 244 was the lot we wanted. We had our pre-qualification but we were waiting on my father to get pre-qualified to buy our other home. On 10/11/19 my wife met with Sheena to do a trial selections process and build out the home to see if we could get all of our must haves in our budget. They also walked lot 244. We were on budget to proceed. We proceeded with the bank running our credit to complete the final mortgage application and also paid the bank $310 for an application fee. On Tuesday 10/15/19 we got word from the bank that my father was pre-qualified and that we could proceed with our contract with Fischer Homes. The loan officer stated she would call Sheena to let her know. Sheena contacted us and stated we could put a 24 hour hold on lot 244 for $1000. We gave her permission to do this and we paid the $1000. We set up an appointment to meet with Sheena that night to sign our contract. We met with Sheena and took another trip to the lot to take a picture with the sold sign and look at the lot again verifying everything was what we were told. We went back to Sheena's office to review the lot grade which was quoted to us as a 1a full grade lot on all sides (the basement was underground). We proceeded with the contract reviewing all the clauses in the contract and rereviewing the selections that Shenna and my wife made. In the upper corner of the selections portion of the contact it lists the grade of the land at 1a as we were expecting. We added a couple items in our selections section including increasing the size of the patio to 12x16 for $1085. Myself, my wife, and Sheena all signed the contract and scheduled our final selections appointment at the design center for 10/29/19. During this same week we called and made another $9000 payment to Fischer Homes to go toward our down payment. On 10/19/19 we met Sheena at the design center during open hours to sit down and chose all of our details of the home before our final selections appointment. 10/23/19 we received a phone call from Sheena stating that Fischer Homes made a large mistake and told us the wrong grade of the lot due to it being entered into their computer incorrectly. She said the basement would be above ground and be a walkout basement and that the land was actually $8500 instead of the $2000 quoted. She said Fischer Homes would eat the extra cost of the lot due to their error but if we wanted to be able to walk out of our morning room we would have to add a 12x14 deck costing $5940 and if we wanted to be able to walk out of the basement the sliding glass door would cost us $1165. She said our other options were a different lot, different floor plan, or canceling the contract but that they needed to know by the next day because they had to complete paperwork for our selections appointment on 10/29. This gave us no time to discuss our options in detail or travel down to *** to look at other lots. We asked her for a little bit to discuss. My wife and I came to the agreement if Fischer Homes paid for the deck and patio door that we would proceed with the build of the home. We did out homework, asked all of the questions, and had a strict budget and because of their error we were going to have to spend over $7000 to live with the lifestyle and layout we had planned. We didn't have an extra $7000 in the budget. On 10/24/19 my wife called the corporate office and was transferred to the construction supervisor, Daniel who stated that the grade of the land was only an estimate because they didn't take the grade shots on the land until a couple of days after we signed our contact. I explained that it wasn't an estimate because it was listed in the signed contact as well as on 3 other documents we have. This same day Sheena took our request to the sales manager, Emily ***. Emily stated Fischer Homes wasn't willing to accept our request. I asked for Emily to call me. Emily called around 5:45 pm on 10/24/19 and we spoke for over an hour while I explained the situation. She still refused to meet our request. Before speaking to Emily I called and left a message for her boss market president, Jason ***. I asked for him to return my call due to a customer escalation and that it was time sensitive asking for a returned call either that evening or the next day. Jason failed to return my call and has refused to listen to our situation. Since they told us we had to have a decision by that day we were forced to end our contract because our selections appointment was supposed to be 10/29 and had to be completed within 14 days of signing our contract so if we were not able to keep that appointment we would be in breach of contact and our contract would be terminated with no refund. So on 10/25 we signed to end our contract with an agreement of a full $10,000 refund. This doesn't change the fact that we had our credit run, paid the bank, took a penalty on our retirement losing a large chunk of money which wouldn't have happened had we not signed a contact, and took PTO from our jobs for this process, and put a lot of time and effort into this process of building our first home. Emily was quick to throw her sales associate Sheena under the bus stating that Sheena should have had the grade shots before going into contact with us and that Sheena should have known the grade of the land by walking it with us (which she did 3 times total). We have photos and text messages of them admitting fault. We also have copies of the signed contact singed by both of us and Sheena who is a representative of Fischer Homes. This signed contact shows the grade of the land as a 1a (which is what we were prepared to build and pay for). We feel Fischer Homes is in breach of this contract since they can't complete what was legally agreed upon. *** and Emily reviewed the contract and nowhere does it list that they have the right to change the grade of the land.

Fischer Homes has reviewed the entire complaint that our customer submitted and unfortunately the initial lot was in fact incorrectly labeled. However, since the Construction Agreement was officially cancelled by both parties Fischer Homes is not in breach of contract.
The lot in question was initially designated as FG1A (full backfill upper level condition) and should have been designated FG1C (walk-out lower level condition). This was an honest mistake and not labeled for any deception for sale as walk-outs are considered premium lots over full backfill.
Once the error was discovered Fischer Homes apologized for the situation and immediately gave our customer multiple options to choose from. These options included, building the home on the original site without charging the $8,500 cost increase paid by other customers to construct the lower level walk-out or build the home they chose without the walk-out on a number of other available sites in the community. As a final option Fischer Homes made it clear the customers could choose to cancel the contract with the return of their entire deposit. Our customers countered that they would build on the original lot but wanted Fischer to include a free deck and walk-out door in addition to Fischer’s offer to forego the $8,500 price increase. Fischer Homes rejected this counter offer and the customers ultimately decided to cancel the Construction Agreement with a full refund of their deposit.
There was never any pressure to make a decision in a day or lose anything. Our Sales Manager offered to walk other sites if the customers wanted to explore this option. If the customers wanted to build on the original site and maintain their previously scheduled selections appointment they were advised that decision would need to be made promptly so a field file could be created for the selection appointment. This was for their convenience as they had already taken off work for the appointment and not to pressure them for a decision.
The customers did make an early $9,000 deposit on October 17th instead of the $2,000 deposit that was required by the Construction Agreement. The voluntary payment of the additional $7,000 would not have been due until November 8th. Fischer Homes returned this entire deposit when the customers chose to cancel the Agreement
Again, Fischer Homes is sorry the lot designation error occurred and offered what it considered to be a very generous offer of $8500 to make the situation right. At the end of the day, Fischer Homes and our customers signed a cancellation of the Construction Agreement thereby legally ending our mutual obligations to each other and foreclosing any breach of contract claim by our customers.

The sales representative did in fact state that we needed to make a decision by end of day the following day after she called to notify us of the mistake. She stated that this was due to extra steps being required by their contractor for home site inspection to draw up plans for proper drainage on the property prior to holding our final selections appointment and the timing of that would need to happen by the end of day the following day for us to be able to keep our appointment for final home selections that following Tuesday 10/29/19.

She mentioned two other home sites as options to switch to and also said that they did not offer the same level of privacy of the lot chosen in our contract. Due to the time constraints of the drainage draw up requirement we did not feel we had much of a choice in the matter of physically walking those additional home sites and I do not recall an offer being made to walk those additional homesites with us also due to those same time constraints of the drainage draw up. We ended our contract because we didn't have the opportunity to make this type of a decision within the time period we were lead to believe that we had based on our conversation with the sales representative and her sales manager.

We also have not yet received our refund of $10,000 despite Fischer Homes claiming to have initiated this refund via electronic funds transfer on 10/28/19. Regards

We purchased a home from Fischer homes on 6/29 in the ***. During the construction of the home we had several rains and being next to the detention basin I asked about water flow and silt mitigation. Our superintendent Charles *** promised us it would be resolved it was an issue going forward. On 6/30 we got another hard rain and their installed silt fence failed and my yard was flooded with silt and it killed my grass. About a week later they came back with equipment and removed an 8 foot wide by 200 foot section of sod and have not been back to replace it.

They have not provided any communication saying that they will indeed fix it and they were the ones that removed it without consulting me first.

Mr. noted a few interior cosmetic items and concern about establishing the yard. The Construction Team completed the interior items and sodded his entire yard prior to closing. The parties closed on July 29, 2019, and Mr. seemed satisfied.
Fischer is currently building other homes in Mr.’s neighborhood, and the presence of silt is inevitable during the homebuilding process. Fischer installed a silt fence around Mr.’s lot, and such fences do not always stay upright during the construction process. This week, the Construction Team reestablished the silt fence, re-sodded near his lot line and seeded/strawed the upper hillside beyond Mr.’s property to help mitigate silt intrusion.

After shocking myself by touching our front yard hose spigot, I had an electrician come out to discover the entire front of our house was electrified since day 1. He found the builders disconnected the ground of the outlet and wrapped the outlet in tape to prevent the circuit from tripping. He found a nail driven through the burned wire, causing 150 volts to run through our walls constantly. Luckily he fixed it, but Fischer won’t take any responsibility. They have been a nightmare since the process started. Thank god it was me that was shocked by electricity, not our 1 year old.

Since we began our process with fischer homes it has been nothing but issues and lies to get us to sign the contract.

The issue now is my driveway has concrete blanket marks throughout the whole driveway and sidewalk. I am the only house in the neighborhood that looks this way. I asked them to wait to pour my driveway until it was above freezing but all they were worried about is their quota. I even worked with them to move in before 2019 so they could meet their quota. This is how I've been re-payed.

I've tried to get Fischer to help me and the shrug me off like i'm nothing and they are trying to wait out there one year warranty so they do not have to help me at all. I wish I could upload pictures to show everyone. I have gotten two opinions from concrete professionals that have said once the moisture rises out of the concrete the top lair of my driveway will start chipping away and then I will be stuck with paying 12k for a new driveway. this is unacceptable!

And when they poured the driveway the brush marks are terrible. they did a horrible job all the way around

We purchased a new market home in November and quickly found out the construction was shoddy. We have had repairs to our bathroom shower twice since purchasing the house which was not prepared correctly and needs to be completely ripped out and redone because of mold coming from behind the tiles that were replace incorrectly. The walls are cracking due to lack of sister joints in the basement per structural engineer and cracking countertops due to the same, unlevel counters, weak flooring, missing garage remotes never supplied, a stove that does not heat al all,, exposed drainage pipes in the front yard and a deck that is already falling apart. The foreman Ron just keeps telling us that he will get back to us which has been more than 4 months with no answers. They clearly do not want to repair the less than stellar craftsmanship.

the countertops have not been addressed as it’s still cracked from when we moved in. All of these issues were sent to the foreman and we have contact proof of it. The shower has been repaired by the foreman and the companies tile person twice now but still a huge issue since mold is growing from under the tile where it was cracked when we moved in. When mold grows from a leave it must be remediated before repair to not cause further problems, I don’t recall mentioning downspouts at all. We have excellent records and have been advised by a structural engineer that sistered joints are required under the open air portion of the house to stop the floor from bouncing in turn causing the drywall over the beams and walls from cracking as the floor is unstable around the kitchen island due to the weight of the countertops, hence also the cause of the crack in the back counter under the stove which is also unlevel.

There are cracks in 3 of 4 walls and the drywall is beginning to crumble. Either Fischer homes resolves the issues that have been repeatedly reported to the foreman or we will take the contact records of report to our attorney. Your foreman does not follow through, he responds with I’ll get back to you which 4 months later is overly excessive for no response. Methods of repair are less than correct but more like a method Red Green would use as a duct tape virtuoso. Replacing tiles over wet and mold with caulk is unacceptable, a pooling shower with no bevel to run water to the drain unacceptable, mold growing from underneath caulk and tile dangerous. We have made multiple attempts to receive resolution but since our “brand new” house is crumbling it appears we will need to escalate this beyond a Revdex.com complaint.

Dear Revdex.com: This morning, Fischer’s construction team met with Mr. at his home to review his concerns. Fischer’s observations and response to the supplemental reply of Mrs. are as follows:

1. Bathroom shower: The shower structure and tile are in good condition and meet industry standard performance guidelines. There was minor mildew on the shower seat edge, and our construction team cleaned the area as a courtesy. Prior to the visit, Mr. properly re-caulked the shower pan as an item of standard homeowner maintenance.

2. Floor Joists: Our construction team confirmed that the floor joists are installed properly per the plans and building code. Our construction team explained the design and answered Mr.’ questions.

3. Garage Remotes: Our construction team provided 2 new garage remotes.

4. Stove: Mr. already initiated a warranty procedure with the stove manufacturer, and he will continue through the warranty process and advise Fischer of the resolution.

5. Front Yard Downspout: Per design, the drainage pipe in the front yard is piped under a mulch bed and sidewalk. Our construction team confirmed that the area Mr. originally thought was exposed pipe is actually raised dirt caused by a vehicle tire.

6. Deck: The deck is in good condition and meets industry standard performance guidelines. Fischer recommends that Mr. seal the deck to preserve the components and extend their lifespan.

7. Drywall: There are a few minor, normal cracks in the kitchen and family room drywall which will be addressed through Fischer’s standard one-year warranty procedure.

8. Countertops: As a courtesy, Fischer will fill any gaps in the countertops at its expense.

Thank you for your assistance in this matter and facilitating further dialogue. Fischer believes this warranty matter to be amicably resolved with no further action required at this time.

We started the process of building our Fischer Patio Home in August of 2018. From the beginning to the end it has been one nightmare after another. First we were required to get pre-approval through the bank Fischer uses even though we have our own mortgage lender. I was literally harassed by phone that we should use Victory and my guess is because Fischer gets kickbacks from them. When I held my ground, they still insisted to pull our credit and I'm not even sure that is legal.
Now for selections. I had to fight for a Farmer's sink and a combo convection oven/microwave? Why? We were willing to pay for it. We picked out a stone fireplace and backsplash in beige. What we get is this ugly brick backsplash and fireplace surround which had green and black in it. Christy told us there are variations in stone. Are there really variations in beige? They refused to fix the problem, and now we're stuck with the ugliest backsplash and fireplace surround which clashes with our granite countertops. Then when we had our first walk through and we get to the laundry room and asked where the utility tub was. The answer was that it is an upgrade? I have never had a laundry room without one. Not only that we met with our "Design Specialist" Amanda three times.Out of the $55,000 upgrades we picked out she never once mentioned a utility tub as an upgrade, and there were 3 people there, me, my husband (a physician) and our Realtor. Christy said JJ was going to look into how much it would cost to put one in and we never heard back or got one. Lastly, our siding on the East side of the house has been flapping keeping us awake. We were told by JJ it was industry standards to only nail down the top. JJ did have men nail it down, but they missed some and a piece went flying off. Today, 4/28 a piece is still loose and is so loud we can't sleep. If the siding isn't fixed correctly, it will all come off with the next storm and my guess is there is already water damage on that side. I have supporting e-mails.

Fischer Homes (“Fischer”) addresses Ms.’s claims as follows:

1) loan pre-approval: Fischer standardizes the pre-approval process with all customers to ensure timely and consistent contract processing. Ms. had 30 days to obtain a loan commitment from a lender of her choice,

and she exercised such right.

2) farmhouse sink: As explained to Ms. during her August 29 selections appointment, the farmhouse sink was temporarily unavailable due to a fire at the manufacturer’s plant. Fischer substituted the farmhouse sink as

soon as the product was available, and Ms. received a farmhouse sink as requested.

3) combination convection oven/microwave: Ms. chose a standard microwave at her August 29 selections appointment. Several months later, she decided that she wanted a combination convection oven/microwave,

and on January 6, 2019, the parties executed a change order for the same. Ms. received the combination convection oven/microwave as she requested.

4) stone fireplace and backsplash: At Ms.’s August 29 selections appointment, she visited our design center and chose the fireplace and backsplash stone. After Fischer installed the stone on Ms.’s fireplace,

she was unsatisfied with the stone pattern. In an attempt to achieve customer satisfaction and provide exceptional service, Fischer removed the completed stone work and re-installed fresh stone in her desired pattern. After

installation, Ms. was dissatisfied with the stone color variance. Fischer compared the design center stone sample to her fireplace to confirm that the proper stone was installed. Also, Fischer compared the product codes

to confirm the same. Ms. received the stone she selected.

5) utility tub: Ms.’s floorplan includes standard features, and she had the opportunity to choose additional features (including the utility tube) through our selections process. The utility tub is not indicated on Ms.

***’s selections sheet or design sketch which she executed at the time of contract on August 9. Also, she had the opportunity to review and modify selections and the design sketch at her August 29 selections appointment,

however, there is no indication of a utility tub. At her September 12 sign-off appointment, she reviewed and executed the blueprints, but again there is no indication of a utility tub. Regarding Ms.’s comment that Fischer

never responded with the cost to install a utility tub, by email dated March 21, 2019, Fischer advised Ms. that the utility room was already finished and past the point of modifications.

6) Siding: This is the first time that Fischer has learned of an issue with Ms.’s siding. The construction team will observe the siding and if necessary initiate a warranty claim pursuant to Fischer’s standard warranty

service process.

7) Responsiveness to Ms.’s concerns: All emails addressed to Executive Management were properly forwarded. Nonetheless, Fischer’s Market President and staff are committed to every customer and are in the best

position effectively manage and resolve Ms.’s concerns. Fischer has addressed each of Ms.’s concerns in person, by email and phone, and will continue to work toward a fair and amicable conclusion.

The matters that we brought up to Fischer have not been resolved because every person we talked to failed to offer any resolutions. We were ignored by the lowest person on the totem pole to the highest. They knew that a laundry tub was supposed to be included, and even supposedly talked to plumbers after the fact, but I guess they were not happy with the price and became more adamant about how it was an upgrade. It was NOT an upgrade, and if it were someone would have told us because they knew we purchased a lot of upgrades and would have done so again. They're about making money, which is fine, but don't lie to your clients. I'm attaching the sheet which shows all of the upgrades in the Wilmington model, and the laundry room isn't even on it! The other image shows where you can choose basic wired shelving or cupboards. We chose wired shelving, which they forgot to put up, but finally did. Since we paid over $55,00 in upgrades, and they plumbed the basement for a future bathroom which is standard, why would they not plumb for a laundry room tub? Our realtor is shocked and embarrassed by them not only not putting it in, but their rude and callous way we were treated. She will never encourage any of her clients to build with Fischer again.

Since Fischer is without a doubt covering up the truth by calling this an "option", we will accept nothing more than either putting a laundry tub in, or paying for it if we put one in.

Regarding the fireplace and back splash I am attaching a copy of the stone we picked out for the fireplace and a picture of what we received. Our picture also reflects the back splash which was supposed to be beige, but has variations of green and black. Those are not normal variations. Hopefully the pictures will tell the whole story.

Again Fischer denied we picked out stone for our fireplace, and I'm 100% positive my husband and I could walk into their design center and find it in two minutes flat. They would not allow us to do that. Our designer was very pregnant, looked uncomfortable, walked away for a half an hour, and I'm also 100% she did not write down what we picked out.

The only compensation we would accept from Fischer is to install what we picked out for both the fireplace and back splash. It's absurb when they tell you they replaced the brick on the fireplace when we walked in and all this guy was doing was taking the same bricks out and turning them in a different direction!!!! How they can blatantly lie should be illegal for the building industry.

Our 23 year old building supervisor finally came out with the truth that our siding that kept flying off was defective after putting band aids on it for months. They delivered the new siding, but only for that side. If the siding is defective, and they put it all up on the same day, wouldn't that mean the other side is defective as well? But no, they have no common sense and it's all about money. So the new siding is sitting in our yard and no one has lifted a finger to put it up. As my husband and I are sitting here, it is very windy and the siding is flapping so hard we know, yet again, it will be a sleepless night.

All we ask is to replace the siding on both sides of the house because Fischer admitted it was defective. Why can't they finish one house before they keep building new ones?

I see vans pull up sometimes with 12 Hispanics jumping out, doing different jobs on the hours, blaring music, and yet when you talk to them they deny they speak English. Yes they do!!! I used my Spanish skills to ask on a question, and by reflex he answered me in English!!! Are they told not to talk to homeowners?

So, to answer your questions Fischer has not tried to offer us any solutions. I suppose the Revdex.com can't make them do it, but we want this to all be a matter of public record, and if necessary someone should investigate their building practices, because we are not alone. Our neighbors have their own horror stories.

Utility Tub: As stated in Fischer’s May 7, 2019 response, the utility tub is an optional feature not included in the standard floorplan. Ms. selected several optional features, including the lower level rough plumbing, but not the utility tub.

Stone Fireplace and Backsplash: As stated in Fischer’s May 7, 2019 response, Fischer compared the design center stone sample to Ms.’s fireplace to confirm that the proper stone was installed. Fischer also compared the product codes to confirm the same.

Siding: Fischer’s Superintendent has been in contact with Ms. over the past several weeks regarding her siding. By email dated May 8, 2019, he advised that there were a few portions of siding on the right side of her home incorrectly installed and that his team would order new siding and install the same within a couple of weeks. The Superintendent inspected other areas of Ms.’s home to confirm proper installation. On or about May 21, 2019, Fischer installed the new siding and plans to paint the new siding by the end of this week, weather permitting.

Fischer has yet to show us where in their contract or discussions a utility tub was brought up. I am glad they mentioned the plumbing rough in down in the basement. That is a good example of what we were offered and agreed to pay for. If we were offered the utility tub in the laundry room they could have thrown out any number and we would have said yes. So tell me, if it isn't listed in their contract, and my husband, our Realtor, and myself sat in numerous meetings and it was never brought up, how can they back track and call it an "option" ? This is Fraud and it's disheartening that the Revdex.com doesn't even try to protect the consumer.

e asked Fischer if we could go back and show them exactly what stone we picked out for the fireplace and kitchen. No was always the answer. We could have done it in a New York minute, and to lie saying they tore down the entire fireplace and redid it is absurd. We were there! They turned maybe six bricks in a different direction. What really happened was our designer was very pregnant, had to take breaks, and my husband had to get the sample down for her. We changed our mind while she took a half an hour break, and said she would write it down and didn't. So the homeowner at the last sign off is supposed to remember each name of all the stone in the design Center??? That was her job pregnant or not!!!! We absolutely should have gotten what we wanted.

As for the siding, I find it incomprehensible that the Corporate Office didn't know that we had spent sleepless night with siding flapping so loud it felt like a tornado was hitting our house. When we told JJ *** about it his first response was that it was normal. That industry standards only require them to nail down the top of the siding. It wasn't until we sent him pictures of it flapping, a video of the noise, and a piece that flew off that he decided to get a crew in to nail it all down. It didn't work. It kemp doing the same thing, and he had a different crew come out to look at it and they told him it was installed incorrectly. So JJ sends me an e-mail telling me this and said they were going to replace it. I asked him about the other side, and he replied it was a different crew that did the other side. Really??? I was here!!!! The same dozen or so men did the entire house. They have replaced the left side of the houses siding, and guess what? The gentleman we talked to told us whoever put it up nailed it to the drywall, not the studs. He too tried to tell us another crew did the other side, I'm sure an answer he was encouraged to say, and I thought wait a minute. We had nails on both sides of the garage that went to the top of the house that stuck out about two inches. No one understood why they were there but I told them they had to be cut off because we have young grandchildren. So here we are, the new siding is up, nailed down to the studs and no new nails going into the garage. So I expressed my concerns to JJ today, and of all things he told me the nails were from putting the stone in. I'm like come on JJ the stone stops probably less than a quarter of the way up the house, and these nails went all the way up. I encouraged him to come over and look, and I assume by his silence he refused. So either they replace the siding on the other side as well, or refund us after we hire someone else to do it. And I would appreciate it if they didn't kill the grass on that side, like they did the other side.

So in the end, Fischer failed and used our money on things we didn't ask for and lied to us about their "options". I found out today that Fischer Homes is not an Accredited business and now I know why. In my husband's profession he has to be Accredited every year to practice medicine. Why aren't builders held to the same standards? Or is Fischer still not allowed to be accredited because they hired illegals in 2006 to work for them? I can guarantee that this practice is still going on. Any time you have a van full of 10-12 Mexicans jump out, work all day, and then get back in and leave together there is something that isn't kosher. If I see it again, even tomorrow, you can bet I'll call the authorities. Don't screw over law abiding citizens who pay your salary by trusting you to build a house they asked for, and turn around and hide the truth. The truth always comes out in the end.

So yes Fischer solved one problem by replacing the siding on the left side of the house but managed to kill our grass by doing so, but they still have four things to complete. The sink in the laundry room, the backsplash in the kitchen, the fireplace surround, and now the putting up new siding correctly on the other side of the house. JJ has promised me for about 8 weeks now that they would seal our driveway and patios. But nope, the house is now nine months old and it's not done.

1. Siding: As stated in Fischer’s May 29, 2109 supplemental response, Fischer’s Construction Superintendent and trim carpenter inspected Ms.’s home to review the siding materials and installation. There were a few portions of siding on the right side of her home incorrectly installed, and Fischer replaced and painted the same last week. The remainder of the siding on Ms.’s home is properly installed, in good condition and meets industry standard performance guidelines.

2. Grass: Fischer’s Superintendent spoke with Ms. and agreed to replace the affected section of grass with new sod. Fischer anticipates installation within the next several days, weather permitting.

3. Driveway and Patio: Fischer sealed Ms.’s driveway and patio last week.

In addition to the above items, Fischer has addressed all of Ms.’s concerns regarding loan-pre-approval, farmhouse sink, oven, stone fireplace/backsplash and employee responsiveness. Fischer will not address Ms.’s comments regarding employees who may be expecting mothers and subcontractors of different nationality or ethnicity. Fischer has participated in the dispute resolution procedure in good faith, accommodated Ms.’s reasonable requests and believes that no further action is required.

Fischer is deflecting my original complaints by bringing up what they have done regarding our siding. They weren’t even aware of the siding issue until I filed a complaint about the other issues. So let’s talk about the things they have not addressed.

Yes after many sleepless nights, and our Project Manager telling us the siding flapping was “normal” it wasn’t til it started flying off and I sent him a video of the noise inside our home, did he decide to have men nail it down more it didn’t work He tried again, and for the 2nd time it didn’t work. It wasn’t until after I filed my complaint did Fischer decide to replace the siding on the left side of our house my husband and I personally talked to the men who replaced the siding and told us they did not nail the siding to the studs, they nailed it to the drywall. This made sense because we had long nails sticking out on both sides of the garage all the way to the top of the house I told them they had to be cut off because it was a danger to our grandkids. So I e-mailed JJ and told him hey, if they nails it wrong on the left side then they nailed it wrong on the right side as well. His answer was no because they nail it to the stone. Now JJ is very young, but common sense would have to prevail here the stone stops at the bottom of the house The nails went to the top. Again, I invite anyone at Fischer to look at it to prove it. If not, I can have our son go up and take pictures of the shoddy workmanship. They put the siding up on the right side exactly as they did on the left side.

Fischer had nothing to do with us getting our convection oven or farmers sink. That was me correcting them right n their own contract How sad is that?

They did not address the stone surround of the fireplace or the backsplash. instead they refused to let us show them the stonework we picked out, paid extra for, and took advantage of us by refusing to change it. Fischer blatantly lied about the stone sink in the laundry room. It was not an option in their plans which I correctly pointed out and it was a lie of omission by not disclosing to us it was an option. When they backtrack and try to find out how much it would cost to put in after the fact, then decide not to do it probably because of cost, then it’s telling even more so that they lied.

I will never accept the substandard workmanship of this house We in good faith paid them $350,000 for a house that is falling apart, and upgrades that we paid for but were not installed In a court of law this is fraud and embezzlement. I will never drop this complaining not because they didn’t reply in good faith to our complaints and we are insulted that the Revdex.com sees any answer as replying in good faith. As a physician my husband took an oath when he became a doctor. First, do no harm. Fischer should be held to those same values

Lastly I said nothing about using pregnant women working on these houses As a woman I am insulted that I was misquoted in this fashion I simply stated that there were probably illegal immigrants working on these homes because a white van arrives in the morning, about a dozen get out, and at the end of the day they all climb back in the van and leave. They don’t want to address this because guess what? I was right since bringing it up they have not been in this neighborhood again. So in closing, if they refuse to work with us, which they have this entire time, then I want this put on the Revdex.com website as it stands. Fischer Homes needs to be made accountable for what they don’t do, and I want it known that they take your money and don’t give you the upgrades you ask for. Like I have said all along this is fraudulent and to you, the Revdex.com, my answer is a emphatic NO THAT Fischer has never even talked to us about a resolution of this problem. Our relationship ended as soon as we paid them.

I have a two story house and my second floor has been extremely hot in the summer and cold in the winter. I reached out to Fischer regarding the heating unit to which they told me the temperature was supposed to be this way. After further investigation I had an insulation expert come out to look at my attic as this could be a cause to the temperatures, and he found there was ZERO insulation in my attic. The technician that I called said he has never seen this before and that it was not acceptable. After my utility bills being high for months and still not helping I reached out to the warranty department . I have left a couple messages and have not received a call back. This is causing the upstairs to be almost not livable in the summer and winter months. This should not have passed inspection and needs to be fixed ASAP. I’m not sure how this was missed in the first place.
