I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
Regards,
*** *** Its sounds like *** wants to settle this through the courtsI had hoped that he would choose the high road and admit his mistakes regarding my 5th wheel camper. Thank you for your assistance to this point, but I do not believe there is anything you can do to resolve this matter. If there is , please call me direct at ###-###-####. I will be out of town for the next weeks....You know the funny thing about this situation is the Fisco website ....It is all about customer satisfaction....Thank you for everything,***

When the trailer was finished it was washed and taken
outside so Mr*** could pick it up.
Mr*** came in the next day or so to look at the repair. I showed him the repair and the back wall
issueSince there was no inside support to attach the window treatments we
installed a white trim moulding below the windows from corner to corner. At that time Mr*** seemed to understand
the situation. He was not really pleased
with the white trim moulding and asked if it was possible for us to use wood
trim so to match the existing trim and make it look like it belongs. I said I would. A short time after things changed. He started with his insurance that they
should cover it. They said no. The trailer was brought back inside at
Fisco. Than he was going to take
*** *** and Fisco Auto Body to court.
Then he called me and said I should call my insurance and tell them to
buy it for $10,He would give me the check and we would be good. He told me to think about it. Then I received in the mail from Mr*** a
copy of a statement from his attorney saying he was billed $for services
with a hand written note at the bottom saying, “***, I paid this bill and
told them that you and I have worked this out.
If this is not the case Please let me know by 10/12/14, Thank You in
Advance, ***” He also sent a copy of the *** *** Insurance check with
a note saying “I will turn this over to you once I received my check for the
unit. I called Mr*** and told him we
did not have an agreement. He said ok
and that he will not be the one talking to me any longer. The next communication was Revdex.com
We have made repairs authorized by *** ***. Remaining issues are not from the repair, the
inside storage, and are not Fiscos responsibilityIf payment for repairs of
$is not made by January 15, we will file a claim in small claims
court

[redacted]: Failure to properly fix in a timely fashion
my Fifth Wheel Trailer which was damaged by a tree falling on it during a storm
early in 2013.
Response:  Timely fashion; Owner dropped off vehicle to
be repaired and said it was not in a hurry.
We were very busy and he...

said it would be no problem to leave it here
through the winter.  Owner said free
storage.  Note: inside storage never
outside since the moment it was dropped off.
[redacted]: The damage included: a broken rear side
window, holes in the roof, major water damage, and the buckling of the rear of
the trailer under the weight of the tree.
Response:
Description fairly accurate.  There was
no structural damage.  The buckling was
the delaminated right rear side panel.
[redacted]: At the suggestion of [redacted]
Insurance, I took it in to be fixed by Fisco Auto Body. After almost 1.5 years
I received the call "My trailer was fixed".
Response:
We were in contact with the owner throughout the 1.5 years.  Again he said no hurry, free storage and I
will be selling it when it is done.
[redacted]: I believed by its current state that it was
stored wet, indoors for 1.5 years..
Response:
We removed the outer wall of the damaged area within the first two days to let
it dry out.  The other sections of the
trailer that have water damage were not related to the tree damage.  We are not responsible for the remaining
portion of his trailer.
 [redacted]: This
created major mold issues.
Response:
The only mold on the trailer was the new inner layer of wood that we first
installed.  Because of some remaining
moisture the wood panel shows some green mold and was removed.  There was no mold found on any areas of his
trailer.  Especially the repaired
area.
[redacted]: Even on the newly installed white paneling,
which should be tan, but tan was unavailable.
Response:
Owner was told at the start that the manufacture no longer has a matching
panel.  The owner was told and he was
okay with that.
[redacted]: I asked [redacted] Fiscal if the new water damage
was from roof issues? He said no and that the roof was great and the water did
not come from the roof.
Response:
True statement.  The roof had three very
small holes that showed no sign of water damage.
 [redacted]: He
told me that the reason there was current water damage was because one of his colleague's
washed the unit with the slides open. He said not to worry, that all trailers
leak in some way.
Response: Current
water damage as stated is a two inch water stain from washing the slide out
partially open to get all of the gaps and seal clean.  This is hardly water damage.
Not to worry all trailers leak is a false statement.
[redacted]: He then said there were major mold issues in
the walls that he had noticed when he had the unit apart..
Response:
False statement He was told that the walls were rotted not moldy, big
difference.
 [redacted]: I
asked why he didn't call me...He said he probably should have.
Response:
Owner was not called because the rotted areas were not part of the claim.  They are on the adjacent back wall that we
could see when the corner trim was removed.
Note; the rotted back wall was noticed within the first few days of the
trailer being here.  It is not uncommon
to have water issues in the walls of motor homes and trailer homes.  Mostly comes from windows.
[redacted]: Case and point: The trailer was in great
condition before the tree fell on it.
Response:
The trailer is in the same condition that it was when the tree fell on it
except for the repair.  Trailers do not
rot in a dry stored area in a year and a half.
They rot over years of neglect.
This is the main reason why insurance companies do not cover rotted
damage.  It is considered
maintenance.  The owner was previously
told by Hannah Trailer in Oak Creek, WI that he had a water problem on the back
panel two years prior.  They did come out
and look at [redacted]’s request and confirmed the same problem.
[redacted]: I carried insurance on the unit for many
years, to make sure I was covered in the event of an accident. 1.5 years ago I
questioned the estimate [redacted] submitted to Insurance Company, I thought it
seemed low. He said not to worry. I then called [redacted] and verified
that they would fix everything for the estimate submitted, and they said yes.
Response:
Estimate was written by [redacted] not by Fisco Auto Body and most
estimates are a preliminary estimate of what they could see at the time.  [redacted] they said they would take
care of any of the damages from the tree incident.
[redacted]: The Insurance Company now states that I did
not have my trailer roof fix years ago which has caused the current problems.
What they do not seem to get is that I have a vinyl expert go over the trailer
roof yearly. He finds no problems with the roof. [redacted] found no problems with
the roof
Response:
The issues between his insurance and how the moisture got into the back wall is
not my responsibility.  Yes the roof is
in good condition, but moisture is still in the back wall and other areas in
the trailer.
The
trailer does not have mold issues.  It has
rotted structure and delamination of the exterior panels.  Worst area is the back wall of the
trailer.  Other areas are delamination by
the windows on the side.  None of this
has anything to do with the damage from the tree.  As for the storing it in wet condition we cannot
take the trailer apart from front to back to dry out the interior walls.  Again not our responsibility.
Owner
is clearly trying to get his money for the trailer through other means because
with the water damage the value drops considerable.  His insurance company told him rot is not a
covered loss.  My insurance agent told me
that it has nothing to do with the repair and is not my responsibility.  He is using mold as a scare tactic that the
trailer is not useable.  He threatened to
call his attorney and sue [redacted] and Fisco Auto Body.  This is just another road he has taken to get
the maximum amount for his trailer he does not want.
There
is much more conversation that has occurred with the owner and Fisco Auto Body
and more if need be.  The water stain
that is there from opening and washing the coach is still there.  The work has been halted until a decision is
made if we finish the trailer or leave it as is.  We will finish it properly if asked and paid
for it.  We have not been paid for the
repairs.

The damage included: a broken rear side window, holes in the roof, major water damage, and the buckling of the rear of the trailer under the weight of the tree. At the suggestion of [redacted] Insurance, I took it in to be fixed by Fisco Auto Body. After almost 1.5 years I received the call "My trailer was fixed". Thank God I checked on the quality of the work when I went to pick it up. The idea that this unit was properly fixed was appalling. I believed by its current state that it was stored wet, indoors for 1.5 years.. This created major mold issues. Even on the newly installed white paneling, which should be tan , but tan was unavailable. I asked [redacted] Fiscal if the new water damage was from roof issues? [redacted] found no problems with the roofDesired Settlement: I cannot accept in good conscience the trailer with the mold and water issues, nor do I feel comfortable exposing someone else to these issues. I will except $13000 which is actually less then the value of the fifth wheel trailer when I took it in to have the work done. They can carry the guilt of selling a moldy trailer to an unsuspecting new owner....Ironically, Fisco has a web sight that talks about a lifetime warranty and customer satisfaction. Thank you in advance for your time.[redacted]
