We have received your letter and complaint dated November 15, on Case # XXXXXXXXFor purposes of this response and to promote confidentiality , we will refer to the individual filling a complaint against the
Neighborhood Christian Legal Clinic as named in your letter as "Complainant." Although we were very disheartened to receive your letter and complaint from Complainant, we are happy to provide a response to the complaint as provides below
First, we would like to briefly explain about the services offered by the Neighborhood Christian Legal Clinic ("the Clinic")The Clinic is a non-profit 501(c)(3) corporation that offers pro bono legal services and preventative legal education to low income members of the community who earn at or below 125% of the Federal Poverty LevelAs provided in the Q & A on our website located at the following link *** the Clinic, "does not charge clients for legal adviceIf [the client's] case is accepted, ]the client] may have to pay court costs if applicable in [the client's] case." What this means is the Clinic does not charge for attorneys' fees, but does not require clients to pay filling fees charged by courts and other governmental entities for a client's caseThe Clinic does not have the resources and funding to pay filing fees for clientsIn addition, although the Clinic seeks to help as many clients as it can, the Clinic's limited resources doe not allow the clinic to serve every clientRegarding the specific situation with Complainant, Complainant did in fact seek assistance from our Fort Wayne Office by attending an intake on August 8; Through processing we ask for 2-weeks to get back to a client after the initial intakeComplainant's information from his initial intake was reviewed on August 18th and a letter was sent out dated August 23rd requesting further information from him regarding his green cardIn order for the Clinic to help him further, he needed to submit certain documents along with the requisite filing feeAs mentioned above, the Clinic is a non-profit organization and while we never charge for our professional legal services (i.eattorneys' hourly fees)that we provide to over clients a year at the Fort Wayne office, it is, however, our policy to always require clients to pay for their own filling fees and court costs which can reach over $per case for immigration fillingsIt is really unfortunate there was a misunderstanding regarding the costs we were requesting from Complainant, however, several messages left by Complainant had seemed to dwell on the matter of him getting reimbursed for *** with years of interest from the type of situation is not an issue we can assist withSeveral of our staff at both of the Clinic's Fort Wayne and Indianapolis office did speak with Complainant regarding his issue, one staff member spending over minutes of her time in which she also could not gather a defined problem from ComplainantFinally, after receiving several calls from Complainant that appeared to be threatening in nature, because of the issue Complainant presented regarding being reimbursed from the federal government (which we do not help with), and because of the Complainant's refusal to pay the requisite filing fees for his immigration case, the Clinic felt it was best to close the Complainant's file with the ClinicAccordingly, a closing letter was sent to Complainant on September 14, Complainant's phone calls were not returned after the closing letter was sentThe Clinic sincerely apologizes to Complainant for any confusion about the requirement to pay filing feesWe wish him continued luck with pursuit of his legal issue with another organization in the future
