Dear *** ***, I have a few comments regarding the response from the Fish Market's response: 1.Counting the ER and tests, I was in the hospital for two daysWriting that I was "noticeably frustrated" is an opinion, and really has no meaning anywayI still maintain the original server said I could get the discount in the other room, however, this really is also meaninglessI had no problem, and still have no problem, with a Release of Liability, however, the wording of the non-disclosure portion was way too restrictive because I had already discussed the event with a few people, including an informal one with a DC attorneyThe most shocking part of this is that we're "still at it" after many months over $dollarsI'm years old and I have never seen management "desperately hang on" to avoid paying out $dollars for a legitimate purposeTo make this even more ridiculous, I want a Gift Certificate, so some people I know who just moved in the area, could dine at the Fish MarketTherefore, not only would the company get their $dollars back, they could possibly make two new customers(If this were a ***, or a ***, or most any other company, do you actually think this would be still a problem on October 30thThese are companies that are customer friendly.) *** *** *** dined at Fish Market on Friday, May His group initially sat down in the bar area where there are happy hour specials; however, some of his party found it to be too loud and they were moved to a quieter dining roomThere, *** *** preceded to tell Chris B***, a manager,
that a server said he could still get happy hour discounts in the dining room, which is against restaurant policy and MrB*** informed him this what not the caseManagement immediately spoke to that staff member who denied implying or telling the customer anything of this sortMrB*** advised *** *** about his inquiry to the still member and he still claimed the server told him that he could get the happy hour clams in the dining roomHe was noticeably frustrated and upset by the restaurant refusal to ignore its policy for him.Notwithstanding his request for a discount, *** *** ordered the raw clams, at full price, and everything appeared to be fine.Subsequently, on Tuesday, May 16", *** *** called the restaurant and spoke with MrW***, the General Manager, *** *** alleged the clams gave him food poisoningAccording to MrW***, *** initially claimed he was in the hospital all weekend and had just been released on the 16"MrW*** explained to him that there was no certainty as to which establishment or the food gave him the food poisoning, and that Fish Market does have a disclaimer or every menu that reads “Consuming raw or undercooked meats, seafood, poultry, or eggs may increase your risk of foodborne illness'MrW*** informed *** *** that the restaurant would document what he consumed and date of contact for reference in case we were advised of similar cases of similar illnesses as many persons had consumed raw clams that eveningWe were not notified of any other illnesses from this time period, and, as a result, the health department was not contacted as this alleged incident was isolated to *** ***l.*** *** then demanded a full refund of his SNotably, others in his party also ate the clams and no one else became ill.On Wednesday, May 17, *** *** spoke with MrB*** saying much of the same as he did to MrW***MrB***'s concern to the customer was the legitimacy of his claim after MrB*** had already experienced him Friday evening wrongly accusing the server of promising the happy hour priced clams in the dining roomIt was expressed to *** *** that if he could get some documentation from the hospital the restaurant would be happy to seek closure to the matterHe quickly emailed over a “follow up appointments' paper from *** *** Hospital in Baltimore, two hours awayHe then called an hour and a half later wondering why no one had contacted himMrB*** did see ***'s email and informed him that his paper proved nothing other than an appointment and did not address a concern regarding the clams or food poisoning to legitimize his claimHe sent another email containing the dates of admittance and actual cause for hospitalizationHis dates also changed when speaking to MrB*** on Wednesday, saying he was admitted on Monday the 15" after being in hospital most of Sunday, as opposed to spending the entire weekend in the hospital.As is policy with most restaurants, counsel for Fish Market prepared a HIPPA release form in order to gather further hospital documents to legitimize his claim which is standard practiceHe responded to the email, "I do not like what I just receivedI will sign a release of liability for my $credit.' Our counsel then drafted a standard Settlement and Release of Liability Agreement and it was sent to himHe claimed to fax it back but it was never receivedMrB*** reached out to him again to make Sure he had the correct number*** *** responded, “HmmmI sent itLet me make another copy and re-sendMaybe resend me the fax numberI'm not sure what happenedThen the next day MrB*** receive this email"I probably had the papers faxed using a wrong number, and never stayed around to get an error messageI think I'm just going to forget about the whole incidentI'll probably never be in Alexandria, Virginia againI really don't get into writing reviewsMaybe five people know about this, and I'm sure it's ancient history to themThe owners probably spent more than $dollars on the attorney writing up this documentSomeday, if they feel comfortable, the owners can surprise me with a $dollar "gift" on my credit cardWe'll see what type of character they have.'Never once in MrB***’s email discussions with *** *** did he mention or bring up the release of liability as being too restrictive.Then, on September 29, *** *** reached out to MrB*** asking for a “favor" in the form of a $gift card for his “friends that just moved to the area.” He claimed its a slam dunk proposal, Fish Market gains two new customers and makes him happy in the meantimeHe was offered a $gift card and he strongly disagreed with that decisionHe then proceed to try to negotiate Sbeing charged back to his credit card despite the fact he had reached out for a gift card “for friends.Now, four months removed from his experience with Fish Market, he is reaching out to the Revdex.com and posting his experience on ***A very different tone after the last conversation with him in May where he “doesn't write reviews” and he is going to “forget about the whole incident"He was offered to refund the whole amount of his table of guests back in May if he signed the Settlement and Release Agreement, which he suggested, and then we offered him a $gift card four months later on a sign of good gestureNeither of which ended up being satisfactory to him
