Fit 4 Life of Kinston, Inc.

Fit4Life has continued to charge my credit card for almost a year now and when payment was stopped they turned it over to a collections agency!I started going to fit4life in April with 2 friends. Those 2 friends moved away so I cancelled my membership early may 2014. The day I cancelled I spoke with[redacted] husband he said since we where only there 3 weeks not to worry about the $50 cancellation fee. well a month later I see the charges on my credit card for 29.95 and 49.95 so I thought oh ok they decided to charge me the $50. I started to dispute the charges around july. My credit card company could never get in contact with them and Fit4Life never returned a phone call so I received my money back. Then it started again charges again so I called never could get them. Disputed the charges again and did a stop payment this time. Then a month later I receive a notice in the mail from [redacted] a collections agency for an outstanding balance of $29.95 for fit4life and a $20 fee for them having TO SEND ME THIS NOTICE! I took the notice to [redacted] she said my membership was never cancelled so I Paid the $50 to her she gave me a receipt. Stupidly thinking this was over I lost the receipt and [redacted] has told the agency that she never received that payment> Which is a complete lie! My memebership number on my card is [redacted]!!! I will never recommend this business to anyone! I went to [redacted] before and to cancel my membership was $350 I would gladly paid that anytime versus having to deal with such unhonest people who own Fit4Life! And might I add that cancellation fee was paid in full!!!! Since this last notice from [redacted] Ive called and left a voicemail, to no surprise I haven't heard anything from them. Also went to see them in person, no luck there either. You can now only get in with a membership card and on the door posted was a paper that read "Attention" " If you have changed your credit/debit card number recently please let us know or the amounts owed will be sent to collections." So now I have no way of contacting them other that a certified letter which will be sent out tomorrow!Desired SettlementThe only settlement I am seeking is for [redacted] to let the agency know the truth! That she did receive payment and told me my membership was cancelled! And to cancel out this payment!!!! Business Response We have a very customer service oriented facility and treat everyone the same here. We are and have been here 7 days a week. And without a doubt return calls. A couple of issues I have with the complaint; 1-Again, we are here everyday and are readily available at anytime. 2- We require a signed cancellation form from all members that request to cancel. If in fact there is no form signed they member will be billed accordingly per the 12 month contract agreement. Which I have a signed copy of in my possession. In this particular case she would owe for the entire 12 months, due to the fact that there is no cancellation agreement. I will be more than glad to call the billing company if Ms. [redacted] will pay the a $150 early cancellation me, which reduced from the full amount we could seek. She can mail a certified check or money order to the gym. When received I will call the billing company and have her removed and given credit.
