I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below The one assistant trainer that I did like that is still at the gym is not a certified trainerI actually think that there aren't any certified trainers at the Hb location which I would normally go toThere are many reasons why I am requesting any kind of refundI have not been to boot camp in 6-weeks I will not be returning to boot campAt this point I would accept a prorated refund for the time I have left on my contractI am not even requesting the full amt I don't feel comfortable with the trainer/owner ***I feel he can be very inappropriate with his comments and fart noises he likes to make at timesI feel the workouts have changed from what I was used to doing for over a yearThe use of my pictures and the story attached to them where in no way related to the story I gaveI am sure they could be considered advertisingWhich I am now considering going to a lawyer I was hoping not to have to do that Regards, [redacted]

The reason *** is wanting to cancel her membership is due to her close friend who was an employee being fired. Our program has not changedAs for the pictures, her story was changed by our media writers who matched her picture incorrectlyWe have Fit Body Boot Camps in
our group so the picture is used in all sites to be inspired not to be used as fakeWe offered to write the story correctly but since she said no her pictures were removedHer contract specifically states that that when you pay in full for year that "FOR PAID IN FULL MEMBERS: ALL SALES ARE FINAL, THERE ARE NO REFUNDS AND IT IS NON-TRANSFERRABLE'
We will not be issuing a refundAnd we are more than happy to help her continue to loose weight at our facilityShe still really likes one of our trainers there and will love the new ones we have hired

I cancelled my membership and confirmed in personOC Fit Body Staff acknowledged that my membership was cancelledI then moved out of state, miles away to Michigan
I checked my credit card statement recently and found them to have been billing me for the last months despite my confirmed cancellation
Then, when I contacted the company for a refund they *** was working with me and things were moving along
However, once ** (the manager) realized how long the billing error had been going on and the size of the refund (over $1700)He claimed that I had not properly cancelled my membershipBut, that I should be confident that now my membership is cancelled - despite the fact that he had once again had not provided written proof of the cancellation
Now, the company is refusing to respond to my emails and maintaining their position, that they in fact did render services for which I am responsible

We have 3 certified trainers on staff. The trainer you used to have with us is not certified at NASM or ISSA as he told us he was. And he is the trainer you want to go to. You are welcome to call both of those certified schools and check with directly as we did ourselves 2 weeks ago. We will not be responding to these messages any further.

Review: I just renewed a contract for a year in June with fitboday. I was so excited with my weight loss earlier in the year that on Feb 5th 2014 I posted the before and after pics on [redacted]. I got the nice comment from [redacted] one of the owners Feb 5th 2014 wanting to know if fitbody could post my pics and story on the wall a the gym. To which I responded yes I was so flattered. Then I got another [redacted] message from [redacted] on Feb 6th asking me to email the pics and send my story to her at hbfitbody@gmail. I did. The pic was posted on the wall I was thrilled. I am upset because I just recently found out that my picture was posted on the website for fitbody I was never asked if the pic could be posted on the website. Not only that it was posted on three different locations. All three fake stories and two locations I have never even been to. Westminster and Irvine. One story commented on my two children. Which I don't have any children.Fitbody recently changed trainers. The workout has completly changed from when I first joined. I had requested to cancel but since I PIF and per contract was past 30 days I needed to give notice of cancellation.Desired Settlement: Refund of contract. I am willing to pay the $200 early cancellation fee
