Regarding : Unauthorized Charges for Auto renewal which was not specified in the signed contract nor ever discussed.
The initial contract between FIT_BODY Lab (Nick / Brooke) was documented for 6 months on (04/08/2019), I have the original email about the contract and also the signed contract. The services are for my son who is a 14 year old he is with FIt-body lab getting services since 8 months, the contract is for

8 sessions for 200 every month for 6 months

In the 8th month (Since ved is in School basketball team and he has extensive mandatory training sessions, we thought any more training would injure him and asked fitbody lab if we can freeze for 2 months and resume the training. For which they did not agree.

So we thought our only option is to cancel and we asked FITBODY-LAB to cancel the services from the 9th month. They canceled the services and changed us 9th 10th and 11th month and processing fees, stating that My Contact is auto renewed after 6th month.

I sent them emails asking to send me the "Signed Contract stating the auto renewal" for which they sent me a flyer which I have never seen.

When I insisted for a "Signed Contract stating the auto renewal" again there was no reply. When I told them I'm not approve all the charges they did not reply either.

Desired Outcome

Billing Adjustment I want is my money back. I'm not really sure if this is happening with nick's consent, however nick is really good to my son. Although he is CC'd in all the emails I want to give nick benefit of doubt. But I think Nick needs a better administrators so they do their business more honestly.

We are responding to the complaint you received concerning our business, The FIT-Body Lab L.L.C. case # XXXXXXXX. Mr. signed a 6 month contract for personal training for his minor-aged son. His contract clearly states and the wording is underlined indicating that the contract is for "continuous service" and auto-renews on the contract's anniversary date. Mr. son continued to receive training in months 7, 8, and 9 of his continuous service contract. All members of the gym sign 6 month contracts for continuous service and receive the gym policies and guidelines regarding auto-renewal on their anniversary date unless they inform us of their intent to cancel 5 days in advance of the anniversary date. It is also a policy of the gym that no client is allowed to train unless he/she is under contract. Thus the need for a continuous service document as required by our liability insurance policy.

Further, Mr. requested a pause/freeze on his account because he stated that his son "needed a break". We explained to Mr. that we could not grant his request because it did not meet the criteria, and that criteria is clearly stated in the contract and in our guidelines and policies each new member receives. The criteria for a freeze/pause is as stated: Deployment for active military duty, Transfer out of town for a job, or a Documented injury. We offered to help his son make up the missed sessions during the Christmas break from school when his time would be more flexible. Mr. never responded to our offer to make up the sessions. He complained because we charged him for his monthly membership dues even though his son was not attending his training sessions, which was his choice.

Mr. indicated that he may want to cancel his membership and close his account. We further explained to Mr. that he still had 3 months remaining on his contract and would be charged for those months. He requested that we provide him with the signed contract that explains his contractual obligation for the remaining payments. Mr. continued to state that he did not sign any document. We again provided Mr. with his contract, the gym's guidelines and policies for the auto-renew contracts, and the freeze policy. This information is provided to every client, it is posted throughout the gym, and hard copies are available at the gym counter.

Mr. was charged for the 3 months remaining on his contract. Mr. then disputed the charge with his credit card company. In turn, our bank and our business app informed us of the dispute and requested corroborating information. We provided the documentation requested and have since been informed that the dispute was settled in OUR favor and that the case is closed. We will not issue a refund and will continue to seek payment of the outstanding debt still owed to the FIT-Body Lab, L.L.C.

We have spoken to our company's lawyer and are in the process of filing a restraining order against Mr. for harassment, and will pursue this course of action if necessary.

We vehemently dispute Mr. assertions. Based on the information discussed and the validity of the attached documents, the FIT-Body Lab, L.L.C. believes this claim has ZERO merit and requests that it be removed from the Revdex.com website. We consider this matter to be resolved and closed.

I asked for a break they cannot give it, I said then please cancel it if I'm not in contract, they said I signed an auto renewal
I never complained I'm getting charged when my son is not able to make it due to his school basketball sessions.

1) I did not sign any auto renewal documents
2) The initial discussion with miss "brooke" at fitlab in emails never ever said there is an auto renewal clause (Email attached)
3) My Son have been with gym for 8 months I did not get any single notice that i'm in a auto renewal mode
4) Fit body lab only suggests that there are 2 words "Continuous Service" in a contract Which I'm not sure if that means "Auto Renewal" (Contract Attached)
5) I sent an email to "cancel only if I'm not in auto renewal", if Fitlab believes I signed a auto renewal contract they are not supposed to cancel the account and charge me for next 3 months (Email Attached)
6) I paid 1800 dollars for 9 months (2009)
Plus they charged me $612 (for next 3 months), and other $639.54( Which they said for other services which I have no idea about) plus fees each month because I'm disputing
7) I have attached the TX law for auto renewals.
8) All I did is dispute transactions and complain Revdex.com and respectful emails, I'm not sure how that is "harassing" and why they are expecting me not to do when they charged me $1250 for 3 months which I'm disputing.

In response to Mr. Bursulu's recent claim:
Mr. Bursulu continues to dispute that continuous service and auto-renew are not one in
the same. If that is the case, then why did he continue to send his son for training in
months 7, 8, and 9 if his contract expired after 6 months? No one is allowed to train at
the gym without a contract as per our liability insurance policy. Every client is informed
verbally, referred to the policies posted throughout the gym, directed to the website
where the policies are stated, and received a hard copy of the policies. Those hard
copies are always available at the walk-in counter. This is in compliance with 80RXXXXX
ATP-D.
The FIT-Body Lab, L.L.C. did not have to send Mr. a notice that his contract
would auto-renew because the contract is for continuous service. It is the client's
responsibility to inform us of their intention not to renew 5 days before the anniversary
date of their initial contract. This is included in the contract language.
Mr. Bulus's request to "freeze" his account was denied for reasons stated in our previous
response. Again, we reached out to Mr. to schedule make-up classes during his
son's Christmas vacation when he had more flexibility in his day. Mr. did not
respond to the offer to finish out the month. Once Mr. stated his intent to cancel,
the business office moved forward to collect the monies owed on the remainder of the 6
month contract. If it was not Mr. intent to cancel, then his son could have
continued his personal training sessions until the current contract was up for
auto-renewal or cancellation in April, 2020.
It is the FIT-Body Lab's right to collect fees that accrue for NSF payments and
chargeback fees that are charged to us because of his non-payment and continuing
dispute. Because the account remains open, those fees continue to grow and post to
his account.
Mr. refers to the $1800 he spent in 9 months of personal training for his son. The
normal rate for personal training is $65 per hour which would have been $4680 for those
9 months. Mr. received a generous discount of $25 an hour, and his coach was
extremely accommodating in scheduling the sessions, going so far as to come in to train
with the boy on the Coach's day off (Sunday). The scheduling app (MINDBODY) also
keeps track of how many sessions each client schedules, attends and cancels. We
discovered that Coach trained him an additional 8 sessions over the course of the 9
months, for which we were not compensated.
MINDBODY's business department reinstated the $612 to the FIT-Body Lab, L.L.C. and
its account. Perhaps Mr. was not informed of the reimbursement to us.
As to the $639.54 charge, we will further investigate to verify, change and/or resubmit
for payment.
If Mr. continues to dispute, then we will pursue arbitration and litigation to resolve
this matter. In the meantime, we are unable to close his account because the dispute
remains open and active.
The FIT-Body Lab, L.L.C. welcomed this family and worked hard to help Mr. son gain
strength, mobility and coordination in pursuit of his athletic endeavors. We are certain that our
company provided excellent services and received many compliments from the family about their son's athletic progress.

We usually drop my son at the gym, The only person we see in the gym mostly is nick himself. We never discussed any fees with nick as he always directs us to his administrators , his administratos were not at the gym atleast the few times we were inside the gym, I dont even remember seeing any one apart from nick and an other female trainer. All the communications happened via email, be it the initial discussions about the contract or any of the discussions after we signed contract.

I deal with a lot of companies where there is an initial contract and then month to month be it mobile bills or any other gym memberships. In fact my whole family(Myself Wife and Son ) were with Fitbody lab only for one month (no contract) prior to this contract. So if thier gym policy have changed after that, it was never communicated. So thier claim that all thier policies have been communicated verbally is not true, they definitely did not do it via email, otherwise they should have sent you proofs already.

I'm not sure why they keep saying normal rate is $65 a month, If they would have told me $65 before signing it we would have not even joined them. the agreement is $25 a month I have a bunch of emails from brooke where we agreed on $25 and also inital 6 month contract. Please ask them to provide any proof that I agreed on $65 deal.

The extra session we took with fit-body lab is not true at all, infact my son lost a lot of sesions due several reasons, for which we paid according to deal since it is our fault. Thier only proof they can produce for the extra classes is thier claim that they keep tracking in thier system (No signatures no documents). They cannot produce any proof because I never asked for it nor they never provided those services, unfortunate thing is they found all these, all of a sudden as I started disagrreing with them.

Regrading her offer for accomidating my son in december : The offer did not work for us as My son's Highschool basket ball sessions continued in december as well there are no holidays for basketball team, the calander was given to nick

Regarding the dispute status
$612 : My bank is working with the merchant or merchant's bank to obtain a permanent credit for this charge
$639.54 : Waiting on merchant
$204.00 (Services Not recieved) : My bank is investigating.

I told them did not approve any of those charges, and I aslo confirmed that only if you cannot produce the auto renewal cancel my account.
I aso told them remove my credit card info from thier system, they went ahead and charged the creditcard ayways
