I renewed my contract with Fit Factory Fitness on Nov 26, 2018.I was given a one-paged contract which included my personal information and the fee that I would be charged bi-weekly ($68.77 + HST).On Dec 8, I suffered a serious knee injury and was diagnosed as a torn MCL, meniscus, and partial ACL tear.Realizing that I couldn't partake in any form of physical activity for the foreseeable future, I emailed *** the general manager, on Dec 9, 2018 to pause my membership.He told me to fill the membership pause form.I completed it on Dec 10, 2018 and sent it back immediately.When looking through my bank statements, I noticed that payments had come out of my account for December.I emailed *** on Jan 4th, 2019 to inquire.He explained that the membership pause form meant that payments don't stop but I will get the classes back that I missed.We exchanged emails on Jan 10 and 11, 2019 and I asked if I could pause the payments as due to the severe nature of my injury I'm not able to work and have no income.I do not have enough to afford these charges.I asked if I could leave this contract on Jan 11, 2019.He replied and restated they can't pause payments but that I would get the classes back, completely disregarding my question.I emailed back instantly asking if I can opt out of my contract on Jan 11, 2019. *** refused to respond to my emails.I called Fit Factory on Jan 18, 2019 to asked if *** was available to speak because he failed to respond to my emails I sent a week prior.I was told that he was in meetings all day and I could leave my number. Two weeks passed and I didn't receive a phone call nor did I receive a reply to any of my emails.I called Fit Factory multiple times within the next week.I realized that when I initially signed on Nov 26, I didn't receive a copy of my contract so I called Fit Factory to try and procure a copy.It was clear *** was avoiding my emails and phone calls.After calling Fit Factory three times in one day because they refused to send me my contract, they finally sent me a copy through email on Jan 23 2019.After reviewing my contract, I realized that I wasn't given the second page of the contract and therefore never saw nor signed the page where it states the start and end date of my membership.I finally was able to schedule a meeting with *** on Jan 28, 2019.I pointed to the contract where it stated they could revoke or terminate the contract at any time, but he incorrectly asserted that they could not do so.He agreed to talk to the owners to see if they can make an exception and pause the payments.He said that the owners will grant me a 6-week pause on my payments because my injury should only take 4 weeks. He said their physiotherapy team estimated this. He did not disclose who was on their physiotherapy team or if they were qualified to make this judgement.I have seen multiple medical professionals, including a sport medicine doctor and a physiotherapist, and the consensus is clear: the grade of my injury is much more severe and the recovery period will be lengthy - minimum of 3 months. I have provided them with notes from both my sport medicine doctor and my physiotherapist stating the time frame is unknown at this point.I am currently waiting for an MRI to ascertain whether I will need surgery.Not only has Fit Factory Fitness not given me any options regarding my injury, they did not disclose the full contract to me nor did they give me a copy of my contract at the time of signing.The general manager has purposefully been unresponsive for weeks in hopes of me giving up and accepting the steep charges.Furthermore, they have provided no form of customer service and demonstrated a pattern of neglect.Initially, I had only intended to pause the payments as I was happy to continue my membership following full recovery from injury.However, after this frustrating series of incidents spanning well over two months over an invalid contract, I want permanently to leave Fit Factory Fitness.

Desired Outcome

I am seeking to leave the contract and gym permanently. I would also like a refund of the charges made in December and January as the contract was not fully signed therefore it is void.
