I had to contact Fit Factory because my trainer quit yes and I needed to know what happens next as I did not feel comfortable nor did I believe the other trainers qualifications permitted me to work with themAs a customer who is paying for a service I have a standard and simply on paper their other trainers were not up to parAlthough after speaking with [redacted] and finding out I had no choice I had to sign up with another trainerHowever, that was on 6/Monday and unfortunately I injured myself, attached is the doctors note I provided to Fit Factory with no recourse at all from themIt makes me sick that Fit Factory would think I would fake an injury or that a [redacted] doctor would fake a document that some very serious allegations After some unfortunate personal situations I had no choice but move to Lakeville, MADistance from Braintee to Lakeville is milesMe physically going to the gym is not feasible, in the end I am the one who cannot keep up with my daily regiment and the one who misses out NOT fit factoryI did go into the gym to speak with [redacted] and I even contact them via email and they will not work out anything with me BUT continue my sessionsThere's no other substitutions periodI had about sessions aside from the two months I had left that I was ok with loosing the money onI understood I would't get back my money for them but to loose one whole month I cannot bare nor can I understand their policy after I stated the above reasons which are ample enough to cancel the second to last month Regards, [redacted]

Hello ***,We have tried to reach out to you in order to speak further will you regarding your concernsFirst and foremost we do want to let you know we do not take verbal agreements, which it does state this in your signed agreementWe do not pressure our members into signing an agreement, and
it is up to the member if they choose to sign up for those servicesYou do have the first business days to cancel with a full refund if you do not agree to any terms and conditions of your agreementIt also states in your signed agreement we do not process any refunds after the first business days. The agreement you signed was for a term of no less than monthsYour payments are $a month for a total of sessions that you receive for each paymentThe fitness manager did tell you that if you did not like the training after using or sessions he would cancel the agreement for you and waive the remainder of your month term agreement as a courtesyNormally if you would like to cancel before your term is up you would need to pay a cancellation fee or compete all payments in order to complete your cancellation. We want all our members to enjoy the services we provide and when the fitness manager stated he would waive the remainder of your agreement it was after using 2-sessions if you did not enjoy training he would then waive the remainder of your termAgain We do not provide refunds after your first business days. You have yet to use any of your sessionsEven though you have not used any of your sessions we still went ahead and cancelled your personal training agreement and made sure nothing further would be chargedNormally you would have been responsible for more payments (totaling $1200) which has been waived. The payment of $that was drafted on 10/2/is non refundableYou do have a total of sessions that you are able to utilize if you choose or you can pass on to a friend or family member.Again in the spirit of good customer service we have waived the remainder of your term, and nothing further will be chargedBoth your personal training agreement, and regular membership agreement have been cancelledIf you have any further questions or concerns please let us know Thank you Fit Factory

We have spoken to the member regarding her issue and complaintWe became aware of the member's injury and immediately canceled her membership per her requestThe member agreed to pay the the final balance as we waived all future paymentsMember agreed to come back to use the services once she
recovers from her injury

Per your signed agreement you would have needed to cancel with in your first 3 business days to avoid the rate lock fee of $49.99, and your proper 30 day notice to cancel. You did send your cancellation on 11/3/15 making you responsible...

for the rate lock fee of $49.99, and your November monthly dues of $19.99. You are responsible for any charges that fall with in your proper 30 day notice to cancel. However, as a courtesy we have gone ahead an cancelled the membership, cleared the past due balance and made sure nothing further will be charged. However, that was on 6/22 Monday and unfortunately I injured myself, attached is the doctors note I provided to Fit Factory with no recourse at all from them. It makes me sick that Fit Factory would think I would fake an injury or that a [redacted] doctor would fake a document that some very serious allegations.  After some unfortunate personal situations I had no choice but move to Lakeville, MA. Distance from Braintee to Lakeville is 50 miles. Me physically going to the gym is not feasible, in the end I am the one who cannot keep up with my daily regiment and the one who misses out NOT fit factory. I did go into the gym to speak with [redacted] and I even contact them via email and they will not work out anything with me BUT continue my sessions. There's no other substitutions period. I had about 7 sessions aside from the two months I had left that I was ok with loosing the money on. I understood I would't get back my money for them but to loose one whole month I cannot bare nor can I understand their policy after I stated the above reasons which are ample enough to cancel the second to last month.

[redacted] contacted the Fitness Director ([redacted]) directly on 6/22, requesting to cancel her personal training agreement because her personal trainer had quit earlier that day. [redacted] let her know she would need to come in to cancel and he could speak to her about assigning her...

to a new trainer to finish using the remainder of her sessions she had paid for. After meeting with [redacted], she agreed to paying one final month of Personal Training although she had signed up for a 6 month agreement which requires 2 more payments. As a courtesy we canceled her final month.We then received an email from [redacted] on 6/26/15 (attached in the email). She acknowledged the 30 day cancellation policy. In her email she stated the reason for cancellation was due to injury, although in the meeting with [redacted] she did not mention anything about an injury and the reason for cancellation is because her trainer quit. We then emailed [redacted] a couple of times explaining the policy and trying to reason with her. [redacted] removed her Credit card information from her billing profile which prevented her final payment to go thru. The reason her account is past due is because her final payment has not gone thru due to removing her payment information. The billing company ([redacted]) we use, has been trying to reach her for payment. We are more than happy to speak to [redacted] to work something out.
