Complaint: [redacted]I am rejecting this response because: the gym has not acknowledged that they were unwilling to allow us to terminate our membership prior to this time. They also claim that they did not receive our letters of cancellation earlier in the year. We kept paying out fees because up until the end we thought we had no choice. However, there is a cancellation clause in the contract that no one who works there is willing to honor. Whether a member is current or not, they should be allowed to cancel--albeit with a penalty. We were told several times that since we still owed on the contract, even though we were in good standing, we could not cancel and this is not accurate. They are telling other members the same thing and it's wrong. If we had been allowed to cancel months ago, we would have and paid the penalty to do so. It still would have saved us time, money and aggravation. Sincerely,[redacted]

This letter is in response to the complaint filed by [redacted] dated 12/05/16 .
[redacted] joined our fitness facility November 19, 2015. [redacted] signed a contract providing membership forboth herself and her spouse, [redacted], as well as the add-on service of child care. The contract wasa 12...

month agreement.The agreement that [redacted] signed has a renewal clause that states:Renewal: Unless cancelled in the manner provided herein, or unless I/We prepay the Annual CashPrice on or before the renewal date, or I/We give 30 days written notice prior to my billing date byCertified mail of my/our decision to terminate, the Agreement will automatically renew at the rateof $75.98 per month or $911.77 per year.[redacted] and Wesley both initialed beside this clause acknowledging this.We received a letter of cancellation from [redacted] dated 11/10/16. At the time of her cancel notice beingdelivered she had a past due balance of $137.76. Her payment in November (billed 11/25/16) declinedas well. [redacted] was called on 11/28/16 to discuss her past due balance. She stated that she was in themiddle of some bank fraud issues and that she would have to pay cash for her account. She said shedidn't have the funds to do so. We talked about her account and [redacted] was ultimately told that if theaccount wasn't paid in full the balance.would end up in collections (as per our policy). She was nevertold the account would be sent that day. She then began stating that our phone call was being recordedand that she would be forwarding a complaint to the Attorney General (which she has already done).[redacted] hung up the call unexpectedly. [redacted] was not charged beyond her past due balances of Octoberand November (we also reversed one of her $25.00 NSF charges as a courtesy). She was cancelled as amember on 11/29/16 when she made her final payment in. club.I have attached the letter that f'mily filed with the Attorney General where her facts and dates aresimilar but different from the complaint filed with your agency.
