understood the cancellation requirements, the individual signed and initialed industry standard policies on the membership agreement documentIn paragraph 14, initialed by the customer, the agreement states, “Termination of Monthly Dues Membership: Member may notify FITNESS 19, in writing, at any time, of its desire to terminate this membership.” Continued in paragraph above the member’s signature, “Notice of termination is considered given, if by mail when postmarked, or if by hand by filling out a cancellation form at the FITNESS 19’s place of business indicated on this AgreementVerbal cancellations will not be acceptedSuch notice should be sent to: FITNESS CO 139, LLC, NGarfield, Loveland, CO 80538.” All members are given a carbon copy of their agreementFitness keeps agreements on file. Written notice for termination of a membership is industry practiceWe have thousands of members who come and go as they pleaseMany members go extended periods of time between visits to the facilityWe do not track individualsWe have no control over how completely or often individuals monitor their personal statementsIt is ultimately the customer’s responsibility to fulfill cancellation requirements and follwith us in a timely manner if they feel Fitness made an error. When I became aware of the situation; I followpersonally with the customer in a prompt mannerTo help the individual resolve their situation, I advised the customer provide written cancellation as stated in their signed membership agreement by January 10th, 2017, so their membership would be canceled before the next billing dateWe received a cancellation letter on January 16th, Their membership was terminated the following morning. I would like to note that Fitness does not experience high turnoverThis facility has been proudly serving the Loveland area for the last yearsI am the second manager of this location, after the first manager of this gym resigned summer to pursue different opportunities.
