If I don't get this refunded, I will tell every person I know how they scam new membersI was told during the departure where I signed the cancellation form that only the monthly fee should bee deducted the following month

Response: As stated on your agreement, Fitness 19 requires a 30 day notice to cancel a membership. You submitted your cancellation form on March 23, 2017. The cancellation form stated you would be billed on last time on April 15, 2017 and would remain a member through May 14, 2017. Also, at the top of your signed cancellation form states: “I wish to give my written notice of cancellation effective 30 days from the next billing day on my membership agreement. I understand that I am liable for all fees and charges that I currently owed during my notice period.” As stated before, when you choose to become a member with Fitness 19, we discussed and had you initial and sign the agreement. One of these initials we captured from you stated you were aware and understood there would be an annual maintenance fee charged on April 15, 2017. Response:This is in response to a contract dispute submitted to the Revdex.com on April 18, 2017 by previous members of Fitness 19 Lime Kiln Lane location. Said members will be referred to as Mrs. J and Mr. J in the following comments. Mrs. J and Mr. J are disputing their annual...

maintenance fee that was charged on April 15, 2017. At the time of their enrollment Mrs. J and Mr. J were made aware and given a copy of the following policies of Fitness 19. 1) They were made aware of Fitness 19’s 30 day notice to cancel policy. 2) They were made aware their monthly dues would being automatically withdrawn, from their EFT account they provided, starting on February 15, 2017 and continue on the 15th of each month thereafter, until member ship is terminated per the 30 Day Notice to cancel policy. 3) They were made aware of an annual maintenance fee, to be automatically withdrawn, one time a year, starting on April 15, 2017 and continuing on April 15th of each year thereafter, until member ship is terminated. On both her and Mr. J’s agreements, Mrs. J initialed by each of the fore mentioned polices, stating they understood and agreed to them. She and her husband also signed their respective agreements stating they agreed to Fitness 19 policies and procedures. At the time of enrollment they were emailed an electronic copy of both agreements to retain for their records. On March 23, 2017, Mrs. J came in to Fitness 19 to submit their 30 day notification of intent to cancel membership. Per the 30 day notice to cancel policy, a cancellation slip was filled out stating Mrs. J and Mr. J would have one last automatic withdraw from Fitness 19 on April 15, 2017. The cancellation slip also states Mrs. J and Mr. J would be able to continue to work out at Fitness 19 for an additional 30 days, through May 14, 2017, after final dues were withdrawn. Mrs. J signed the cancellation slip and the yellow carbon copy was provided to her for their records. A white copy of the cancellation slip has been retained at Fitness 19 for our records. On or around April 18, 2017, Mrs. J spoke to Fitness 19’s club coordinator disputing the annual maintenance fee. The coordinator reiterated the policy to the members and emailed a second electronic copy of the agreements to Mrs. J and Mr. J. Around that same date they reached out the Revdex.com to file a contract dispute. All maintenance fees are used for repairing equipment, adding new equipment to the facility and making upgrades to the facility. A sign is posted at the front desk one month prior to the maintenance fee being charged as a courtesy to our members. As stated above, at time of enrollment, Mrs. J initialed stating she was aware of the annual maintenance fee to be billed on April 15, 2017. We apologize for any confusion of Fitness 19’s policies. Fitness 19 will be working closely with its staff to ensure all members have a clearer understanding of when the annual maintenance fee will be charged and what the maintenance fee is used for.
