This member asked to cancel her membership. She is still in a one year contract until 2/3/2021. To break her contract it is a $50 early cancel fee, even during a pandemic. The state says that we can be open, so we aren't just going to shut down our business because this member is afraid to come into the gym. I gave her the option of cancelling her membership with the $50 early cancel fee or offered to freeze her account for 90 days. She did not like either option. I explained that refusal to pay the $50 early cancel fee meant that her membership would continue to bill normally until she pays the fee or until her contract is up. I have attached copies of her membership agreement, her signed cancel policy saying she understood the cancel policy, and the email conversation between us. The only resolution will be for her to pay the early cancel fee. We also do require a 30 day notice, so if she has a payment due within 30 days of when she submits the cancel fee she will also have another monthly payment of $29.99. If she fails to pay the cancel fee or any further contracted payments, after 120 days her account will go to collections.
