Please note also, that our contract does not require cancellation unless themember moves over 50 miles away. Shelly, Idaho is 37 miles away.Fitness Inc. is not trying to split hairs with this member. We are not bound to cancel thiscontract, and are well within our contractual rights. This former member signed a health club agreement on 12/31 /2013, agreed to pay $34. 98monthly, and initialed the Auto Renewable box (see top right hand side of the agreement, seeinstructions). Member fell behind on dues mid year 2014. Aug 2014 paid $184.92 to catch up,only to fall behind again....

Member was stil1 under contract obligation.Enclosed is a copy of original agreement.Enclosed is an accounting of monthly ledger.Enclosed are letters sent to member without response.This former member was sent to Action Collection Services on 10/27/ 15, and they notified himat that time. ACS tells me that they have his debt today @ $258.63. He recently called FitnessInc., and stated that he had been contacted by ACS in 2015.This former member insisted over the phone that he cancelled this agreement, but Fitness Inc.does not have anything in writing for this request. This is an integral part of any cancellation,and we keep records. Please see membership agreement page #2 under "Buyers Rights" forreasons to cancel. Fitness Inc. never received anything in writing for this request, nor did hequalify in any way for cancellation. There is no reason that we would withhold a cancellationrequest, if he adhered to the contract.Fitness Inc. understands that sometimes the public does not fully understand their obligations, orhow to cancel a contract. Therefore, Fitness Inc. offers to settle this in full @ $175.00, if paidbefore 06/15/2016.Sincerely,[redacted]
