Review: I have been a member of this gym since November 2013. At the time I agreed to purchase a membership, this business marketed that membership included no sign-up fees or cancellation fees, and that membership consisted of a flat fee of $39.00 per month, prorated by the number of days in the month. For example, if you joined on July 23, you'd only pay $9.10 for use of the gym for the remaining 7 days of July, and then pay the full $39.00/month begining August 1. On June 15, 2015 I cancelled my membership due to non-use. (The gym would not let me cancel over the phone, so I cancelled at the gym in person, and have a copy of the receipt). At the time of cancellation, gym staff told me that my June payment of $39.00 would not be refunded or prorated for the remaining days of the month, approximately $19.50, contrary to the business's prior advertisement. Staff informed me my membership was cancelled, but my account would remain valid for the remainder of the month of June. On August 4, 2015, Fitness System withdrew another $39.00 from my bank account. Upon contacting the gym, staff now informed me that contrary to the 2013 advertisement, and contrary to what staff informed me two weeks prior, gym policy required 30 days notice for cancellation. Accordingly, a final payment of $39.00 was required before my cancellation was effective. I have not used the gym or any of its services in the weeks prior to or after the date of my cancellation request on June 15, 2015. I would ask that Fitness System honor the terms it advertised 2013, and provide the appropriate refund.Desired Settlement: Fitness System should honor its 2013 no-fee/proration claims, which I relied upon when I chose to purchase a gym membership. Accordingly, Fitness System should: (1) proprate my June membership fee of $39.00 to reflect my cancellation on June 15, 2015 (30/39=$1.3/day, 1.3x15=$19.5, $39-19.5=$19.5), and (2) refund in full the $39.00 deducted from my bank account on August 4, 2015 without my permission. In total, Fitness System should refund $58.50, and discontinue monthly charges to my account.
