We received a notification regarding this matter on May 18, As her statement contains numerous issues I have attempted to respond to each of them belowThe client that submitted the complaint has been a client of Fitness Together *** since June During her tenure with this personal training studio she has worked with / been trained by different members of our staffWorking with different trainers has always been part of the Fitness Together *** business model and is explained and discussed when a client joinsOver the years there have been changes in pricing and packages and differentways a client can pay for themThe complainant has purchased various packages of sessions that ranged in price from $to $per session based on the number of sessions that were purchased as well as the pricing options available at the time of purchaseIt is typical in the personal training business that the larger the commitment a client makes for sessions the lower the price is per sessionAs a special service to the complainant in support of her financial needs, starting in November 2012, we allowed her to purchase session packages at the lowest rate availableIn October we had an across the board price adjustment and standardized our package optionsIn an effort to allow the complainant to pay the lowest rate, she was offered an option to purchase the largest package we sell, sessionsWe allowed her to break up her payments over a 12-month periodThe specifics of this option were described to her in detail when she signed up for this package and executed the first paymentShe had the option to choose a smaller package at a higher price per sessionA company has an exclusive right to manage its employeesThe trainer thatthe complainant is referring to ended his relationship with the company in April The specifics of why a trainer leaves are not discussed with any clientComments about the treatment of this trainer are therefore inappropriate, as she has no details from management as to why the trainer is no longer employed with Fitness Together ***The complainant signed a payment agreement with Fitness Together ***. A business operates to make money, which is why there are prices and agreementsThis is a separate matter than how she feels about the trainerThe complainant wrote her name across the acknowledgements about our operating practices in lieu of initialing each oneThese acknowledgements and her initials are on every agreement and that she has signed with Fitness Together going back to Her insinuation that the Operations Manager fraudulently signed her name is not trueWe have executed over past agreements where she has signed her name or initialed these very sameparametersThey have not changed since the company opened its doors in 2008, The reference to new payment packages is irrelevant to the agreement signedAgain, as a business we often change pricing and packagingNew packages and pricing have nothing to do with previously executed agreementsThe complainant states that the company has offered other clients the opportunity to change their plansA small business has the right to handle clients on a one to one basis and this is not relevant to herWe have had many clients who for various reasons such as illness, job change, move, have left Fitness Together *** prior to using all of the sessions in the package that they purchasedRefunds are not givenOne of the acknowledgements that is always initialed on the payment agreement indicates that the sessions are not refundableFitness Together *** is exactly the same premiere training facility the complainant has been attending for yearsWe have qualified, experienced trainers on staff to work with her and are ready to deliver the same high quality personal training expertise she has had in the past

Regarding complaint #[redacted], attached please find a copy of my contract dated 12-30-2014.  At the time, I was told that my only option was to sign for one year, and as I have been working with the same trainer for about 4 years, I went ahead.  My signature is on the document, but...

the manager, Lynn O[redacted] wrote "Joyce" across the section where my initials should have been regarding "acknowledgements."  I did not write "Joyce" nor are my initials on the acknowledgements as the contract requires.  You can see she also wrote "On File" for the specific member information too.  Recently, Fitness Together [redacted] sent an email announcing new payment packages that allow clients to buy fewer sessions, at a slightly higher rate per session.  For instance, a block of 24 sessions is $78 per session.  I wrote the manager of Fitness Together [redacted] to suggest resolving this matter by charging me $78 per session I have used, instead of $70 per session - the discounted annual rate.  Since I have used 26 sessions this year, this would mean I have overpaid by about $72.  I have paid $2,100 to date.  In this way, the gym would simply be shifting me to a newer pricing plan and they would not be under compensated for my personal training time in any way.  It is known that the gym has offered other clients the opportunity to change their plans to accommodate other changes, such as a move.The bottom line is that I am very dissatisfied. I have tried to work out a fair and reasonable way to separate.  So far this independent business owner has been unwilling to work with me to resolve the dispute.Please contact me if you have any questions.
