I originally was a member of [redacted] and then [redacted] who was bought out by Fitness1440.I cancelled my membership on 8/13/13 and was told I needed to give 30 day notice and my renewal date was the 12th of the month. I was fine paying for another month of dues but I was not OK with a $39.00 charge in September for some type of annual fee. I have spoke with [redacted], manager, over a dozen times and it is the same story. She promised me the new owners would correct the errors of the previous billing company([redacted]) who they no longer used. She was always nice on the phone and said she would call me back or email me back. She never did.I believe I will never see the $39.00 but hopefully potential new members will be careful and watch their bank accounts no matter what the gym is calling itself..[redacted], [redacted], fitness 1440.Desired Settlement$39.00 annual fee refunded via check and sent to my current addressBusiness Response Carson Fitness Corp (dba Fitness 1440) was incorporated on November 22, 2013 for the purpose of acquiring Fitness Evolution. This can be verified with the Nevada Secretary of State. Fitness 1440 acquired the assets of Fitness Evolution on November 26, 2013. This was our first day of business. Based on the dates you have provided, your complaint should be levied against the former owner of Fitness Evolution, [redacted]. Fitness 1440 did not assume any liabilities of the previous owners (Thus, Asset Purchase), nor did we receive any of the receivables (Your membership dues) prior to the acquisition date. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I spoke with a current manager, [redacted], after the November 26, 2013 date and was told Fitness 1440 would quote "make things right with me". She said it was more less a billing issue and the gym had switch billing companies. I was told things would be corrected every time I spoke with [redacted] which was about once a month for six months starting in September through February of 2014. If Fitness 1440 owners were not intending to refund my annual fee than I feel the manager of the gym would have told me as much during any of our multiple conversations over the six months.Thanks,[redacted]Business Response As mentioned, Fitness 1440 did not open for business until November 26, 2013. [redacted] may or may not have been employed at the "gym" prior to that date, but if so, she was not under Fitness 1440 management at the time. Therefore, your cancellation on "August 13, 2013" is an issue with Fitness Evolution, the owner of the gym at that time. If you provide records that show you were charged $39.00 between our acquisition date, November 26, 2013 and "February" of 2014, then we will gladly refund your money. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)It is clear Fitness 1440 took over on 11/26/13 but it is also clear [redacted] was employed between my cancellation and when I filed a complaint in 3/2014. I spoke with her multiple times and when someone else answered the phone I would ask for the manager, [redacted]. She did tell me after 11/26/13 the gym was under new management but they would quote ''make things right'' with upset members of Fitness Evolution. I called 775-887-7444 every time and I feel the Fitness 1440 employees, especially [redacted], lead me to believe Fitness 1440 would honor and rectify the issue.As you are aware I cancelled in August so I do not have records showing cancellation after November. You should stand behind your employees' promises and refund my money. I have a [redacted]'s membership contract and I have been trying to cancel this for over a year. I do not reside in [redacted] no more I reside in [redacted]. My contract is a month to month contract which money comes directly out of my checking account. The [redacted]'s gym that I signed up at is now a fitness 1440, I was not told that the company changed over to a company that I never signed up for. The management there does not take any phone calls all calls are diverted. I have made attempts emailing with no response. The email is [redacted]. Here is a copy of the most recent email that I have sent. Canceled membership, was contacted 6 months later by a collection agency I canceled my membership in September. I was contact in June saying I owed $275 in back dues and late fees. The collection agency said I did not cancel properly and threatened me with more charges and adding it to my credit reportDesired SettlementI negotiated it down to 150$ (I have the Paperwork) I just want my money back I am willing to talk to managementBusiness Response If I am interpreting your desired solution correctly, you agreed to pay the collection company $150, however, you want Fitness 1440 to reimburse you for that same amount. I signed up for personal training at Fitness 1440 in Carson City NV because of the unique qualifications of a particular trainer. I signed a six month contract with 1440, then my trainer was laid-off and I was haphazardly assigned another trainer. I was not allowed to end my contract due to this change in service.First, service changes were not documented in writing ahead of the service change. The client was not given informed consent of the changes. The National Council on Strength and Fitness says that program priority should be directed at reducing known risk for injury, disease or health issue, while addressing the desired and overall needs of the client. No consideration was given to the clients unique medical limitations and assignment of an alternate personal trainer without the specific qualifications needed by the client before switching personal trainers. The owner of Fitness 1440 breached confidentially of this specific client by discussing this particular client with other staff at 1440. I do not believe that the owner has behaved in a way that is honest, fair, and respectful of clients. I believe he consciously made statements that are fake, misleading, and deceptive. No effort was taken to clarify the obligations of this contract.Desired SettlementI am requesting release from my contract on 12/11/14, the date my trainer left the facility.Final Consumer Response The company has agreed not to charge my account for a personal trainer that I did not want. This is resolved.

Fitness Evolution/CARSON 1440 failed to cancel my account after mailing in written notification. Without coming in personally they wont issue a refundThe complaint started on Jan. 16, 2014 with a charge of $29, which was more than my membership fee. I called to discuss what this was and found out that it was an enhancement fee, of which I was not informed at the start of this relationship, and that I was still to be charged my monthly fee of $19 on my due date. At that time I was told I am not able to cancel over the phone, I had to submit the cancellation in writing. Immediately after being told I must have the written notification, I wrote the cancellation letter and mailed it in. Today, Feb.19,2014 my account was charged again for the Carson 1440 membership and at an increased price of $24.95. This came as a surprise to me because when the company switched names I was informed that all the Fitness Evolution clients would be grandfathered in. I called again today to seek a refund and confirm cancellation of the account. I spoke to the General Manger and she told me that she received 3 letters regarding cancellation but had just come back from leave due to a death in the family so she was playing catch up. I was then told that my written notification was not satisfactory and that I must now come in person to sign their cancellation document. If this had been explained when I called last month, we would not be in this situation. When I asked if I come to sign the cancellation form will my money be refunded? Because honestly this is ridiculous, the General Manager deflected and said she was just doing her job and the owner would have to make that decision because it was his to make. I then called the number from the charge off my bank account, some fitness financial company, to try and get my money refunded. I spoke to [redacted] who explained to me that my account was still consider active and unless the gym back dates the cancellation she cannot do anything about the charge. This is extremely frustrating for the consumer and not a way to handle customer dissatisfaction.Desired SettlementI would like to have my account closed and back dated to the date on the written notification. I also would like my money refunded which includes the $24.95 from Feb. 18th,2014 as well as the $29 enhancement fee that was not explained to me. It is not my fault that their former employee misrepresented the company and did not do his job explaining the membership process. I contacted Fitness1440 (formally [redacted]) when they charged my account on January 16, 2014 for $29 when I called them I was informed that is for a club enhancement fee, so I requested a copy of my contract. I was told that someone would call me back. I called again a few days later and was told the same thing. Never got the return call. Then on January 21st, I was charged my monthly fee of $19 when I called I was told to write a cancellation letter. I wrote the cancellation letter and mailed it to them immediately requesting that both my accounts be cancelled and told them that they DO NOT have permission to charge my card anymore. I also said in my letter that I wanted the $29 refunded to me. My letter was ignored. Today, my card was charged $24.95. Upon calling and talking to the general manager, she told me that she received 3 letters the same week, and that she was on leave and is just now getting to these letters. She said to cancel our contract (month to month) I have to go into the gym and fill out a form. I told her that is not what I was told, and no one had contacted me and both my cell phone and address was on the letter. For the fourth time in four weeks this gym has had no staff at the scheduled opening time, or the 15 minutes after. That seems to be a more than fair wait. In theory this gym is "24" hrs a day however that claim is totally false. However myself and the 3 other patrons at the door had no luck with the "swipe system". In fact this system did not work for the manager the morning before, when she tried to show a few of us how to use it, I on the inside had to open the door to let her in!The ownership has painted the place and added televisions, that's great, however I would be much happier with BEING OPEN when you claim. The key card system is operable, however, the card holder must hold the card in a parallel position to the window in front of the scanner. Direction have now been installed on the exterior of the window to ensure members are scanning correctly. Unable to be released from a contract with a personal trainer that is no longer with the company. I entered into a six month contract with a personal trainer at fitness 1440. Originally I had to freeze my account because I could not afford the services at the time. During my freeze I was informed that my trainer was no longer with the company. When I asked about being released from the contract I was told that the contract was with the fitness center and not the trainer although the contract says no such thing. The contract has the trainers name on it and does not imply that the contract is with the center. I am personally uncomfortable with being put with another trainer that I did not want or ask for. When I first signed up for the trainer, I did so for the specific trainer that I had. When I called to ask questions reguarding the situation at hand, I was told it did not matter, that I was to be bounced around from trainer to trainer until I found one I was comfortable with once my freeze was up, due to the contract being with the company which I was not aware of. Desired SettlementI would like to be release from my contract with the personal trainer effective immediately as well as being released from the contract with the gym without acquiring any fees added to my account. Final Consumer Response I have been talking with the general manager and we are talking about it. I agreed to try 1 other trainer despite my own anxiety towards meeting new people.
