Complaint: [redacted] I am rejecting this response because: I have not received conformation in writing that I am no longer a member of FitSmart Gym Regardless of what transpired in writing and phone conversations with FitSmart & Covenant Collections, I consider the contract initated with FitSmart on December 18, with requests of termination December 28th to be invalid due to the inaccuracy of the zip code on the return address for FitSmart The correct zip code is not Regards, [redacted] * [redacted] PS I would LOVE for complaint [redacted] to be closed Administratively Resolved with no further action(s) ASAP !!! I do NOT like dealing with confrontations & confusion and it has never been my disposition to harm anybody or anything As I mentioned to the manager, it is not to be said that I would not like to become a FitSmart member in the future It is my sincere prayer that FitSmart gym thrives and that the zip code typographical correction is made before future contracts are signed

First, Of all we at FitSmart was not aware of the issues until we got a letter from you all.  [redacted] signed a contract & did not follow the correct procedure to cancel the contract. She signed up on the 18th day of December.  She stated she was in the gym on December the 28th meaning it had passed 5 days; in which the contract do states if not satisfied within 5 days you can mail in a letter and cancel.  She misread the contract because after the fifth day there is another procedure.  Evidently this is the reasons for her mishap. There is a procedure whereas each member is to send a certified letter to the Florida office within 30 days to cancel any contract. Also speaking of our billing company with the complication, I can forward you a copy of the back of the contract she signed which it states of a letter notice of cancellation.  I did contact the billing company to see if she had sent a letter in their office and they stated she had not. She still have to follow procedure in order to cancel her contract. We at FitSmart feel really bad that she fail through the crack of being unhappy with our center...
 
[redacted] called my cell phone telling me she was on her way to the FitSmart Fitness Center. I told her I'll be there waiting on her. When she came to the center, I asked her to come in the office so we can talk. I asked her why she didn't notify me or other members of the gym of her issues. She said she never could contact no one. I then replied, "I can't understand that, You called me when I was in Virginia & you just called me a few minutes ago.” She stated oh well... I just want to cancel my contract. So, I asked her why you didn't tell me of your issues. She constantly said she just want to get out of the contract. I told her she signed a contract it's not that simple. I also told her I'll check the billing company to see what they would say. I explained to her that was not nice. She could have contacted us first, then if we didn't resolve it she had the right to contact the Revdex.com. I apologized to her for feeling uncomfortable but I wished she could have let me know of her issues first.
In regards to her complaint about the password, each member is to create their own password for security reason. Evidently she forgot her password. If she would have told one of the staff, I’m sure they would have recreated a new one for her. The trainer that she claimed was there is very knowledgeable about the system we have in our fitness center.
In regard to the horse playing she claim went on in the gym. She as a member was to tell Management of any complaints. I was not aware of any or such an incident. If that’s what went on it is not something we tolerate.
 
Upon her stating she couldn't get in the gym at 7 a.m. on Saturday is correct because our gym don't open until 8 a.m. to 6 p.m. on Saturdays & Sunday & Monday thru Friday 6 a.m. thru 11 p.m. We have the hours on the Entrance door.
 
 We are in the business of making sure each member is satisfied, losing weight, getting fit & eating right. We never want to have an unsatisfied member. We are very serious about what we do...That is totally customer satisfaction.
