I am rejecting this response because:---At Fitwall, we have many fit challenges in which clients compete in a friendly nature to collectively work towards similar goals. Clients pay $to be a part of the challenge and in return they receive measurements, nutritional guidance and accountability support. For extra incentive, we award the person that has lost the most inches and the person that has come to the most classes with prizes that vary between either focus training credits (semi-personal training) or a discounted month of their membership: This is quite misleadingNot only does a “client” have to pay the $to participate, but they also have to pay for either group or focus classes to be included with the challenge.---Over the past year, *** has paid for focus credits. She has used focus credits. She has won credits in the fit challenges: This is also untrue: I have won more than focus credits, and I have also had all classes be used before I purchased my last set of focus classesThey have always been “rollover” due to the initial contract I signed in May of *** ***, the Manager at the time has offered to attest to thatThe only reason I signed on with Fitwall was because they assured me that this issue (with trying to swindle money) would not ariseI paid for many focus classes, and the charges reoccured every monthI was not told that my “winning focus classes” wouldn’t be refunded to me when I explained I wanted to leave the gym in MARCHThey “mishandled” paperwork, causing me to pay another month, and still, didn’t mention once that I would have to get these classes done due to no refundAlso, I made it clear at the beginning of the year that there were issues scheduling my Focus classes with my trainerOther trainers made it clear that they didn’t want to train me*** overworked my trainer, having him work open to close on some days, close one night (8pm) and open the next morning by 5am, and generally just wearing the workers downShe was short staffed and it showed in the trainingsI went from doing focus classes a week to maybe 2-a month if I was luckyThe only reason I had to cut down on the classes was because they kept building up and I was denied availability unless I wanted a watered down, thrown together sessionI have been there long enough to know the differenceI showed up 5-days a week, every week; there was no issue on my end with showing up. --Per ***’s contract, her focus credits do not roll over. However, I made an exception for her and let them roll over to use when she can. Again, When I first signed up, the agreement was that they would*** can attest to that.--The purchased focus credits need to be used first since per the contract they are not supposed to be rolled over: This is untrue, the classes I have won were “used first” --We do not normally refund focus credits, however when *** decided she wanted to end her time with us I refunded the credits she purchased and let her know that the credits she won in challenges will remain on her account to use when she would like*** is not being denied service and has the option to use the credits at her disposal:I truly am being denied service if I am forced to go to a gym that not only makes my visits extremely uncomfortable, but is also giving out sub-par services that are not worth the value***, the owner makes her very presence an issueI worked very hard to achieve my fitness goals (physically and mentally), and I’ve paid a lot of moneyWhy would anyone go to a place that is supposed to make them a better person want to be treated with malice and hostility? Nobody wants to go to a restaurant to have a waiter give them poor service, why is a gym any different? Ive already paid my endThe classes that were won, were done so months before I leftI used and paid for plenty of classes in between each set that I have won.

1) *** has been a member for over year with Fitwall and signed different contracts for various services If the conditions were truly hostile and uncomfortable as she claims(and compares to the likes of bad service at a restaurant) then she would not have stayed a customer for year She has continued to be a customer because the staff at Fitwall treat her with the utmost respect and have guided her to lose 30+ pounds If it was a hostile environment and poor service as *** explains, there would be no reason to keep signing new contracts similarly how you would not go back to a restaurant with poor service. 2) Because *** has enjoyed our services for a year, there should be no reason why she cannot enjoy her winnings from the competitions she partook in The service truly is not being denied and is at her disposal to use. 3) Through her(***) manipulation and scare tactics, *** has been let out of separate contracts I agreed to let her out of those contracts which cost me $1, I did this to keep a good relationship with *** as we valued her business and appreciated her hard work in the gym. 4) *** mentions that she has also won free group training classes in addition to the focus credits Group training classes that are won are for month unlimited The focus credits that are won are credits towards a private session with a coach Since the group classes are unlimited every month and there are no credits to expire then they are applied immediately Because the focus credits expire then the ones purchased are applied first and the winnings are applied last This is a benefit to the customer. 5) The credits that *** purchased were refunded to her which is not something we had to do per her contract The credits she won in challenges remain on her account to be used She is not being denied service. 6) Finally the $1,I have let *** not pay on bills that were due to us outweigh the $she requests from a non-cash prize

we award the person that has lost the most inches and the person that has come to the most classes with prizes that vary between either focus training credits (semi-personal training) or a discounted month of their membership. These prizes have no cash value.  The value is in the free service that is being provided to further assist them in their fitness goals. Over the past year, [redacted] has paid for 83 focus credits.  She has used 81 focus credits.  She has won 8 credits in the fit challenges. Per [redacted]’s contract, her focus credits do not roll over.  However, I made an exception for her and let them roll over to use when she can.  The purchased focus credits need to be used first since per the contract they are not supposed to be rolled over. We do not normally refund focus credits, however when [redacted] decided she wanted to end her time with us I refunded the 2 credits she purchased and let her know that the 8 credits she won in challenges will remain on her account to use when she would like. The 8 focus credits that were won do not have a cash value and thus cannot be refunded with cash.  [redacted] is not being denied service and has the option to use the 8 credits at her disposal.
