I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me, just so long as the business I am in dispute with, Fitzgerald's Lawn Care, no longer continues to bill me for services never ordered, never authorized & never rendered. Fitzgerald's has told me several times in the past they would remedy errors on my account, only to begin billing me again within weeks.

On 2 occasions this company has performed services that were not authorized by me. They make assumptions that if you've done a service in the past, you automatically want to have that service again in the future, and if you request information about a particular service, they make the assumption that you are authorizing that service. Most recently (May 2013), I requested a price quote for a core aeration through their website. I received a voice message about a week later saying they recommend waiting until the fall and that we would discuss it later in the year. On August 13 I came home to find my entire lawn had been aerated. I never spoke directly with the company nor authorized the service, and I never even received the price quote before the service was performed! I immediately called and had to leave a voice message and have still not received a call back. I have requested that they never step foot on my property again.

Review: Last Summer (2014), a representative from Fitzgerald's Lawn Care knocked on our door, asking to give us an estimate for lawn care services. I agreed to let him give me an estimate ONLY but explained that we very much enjoy doing our own lawn care. After completing the estimate, I told him I would discuss it with my husband & get back with him if we wanted services. 10 minutes after he left our home, he rang the bell again, asking me to sign the bottom of the estimate to "prove to my bosses I was actually here & didn't just make it up." I signed the estimate for him.

Next thing I know, within days, I come home from the grocery store to discover lawn flags in my yard from Fitzgerald's stating they had just sprayed fertilizer on our yard. Furious, I contacted them immediately & told them NEVER to trespass on our property again & that NO service was EVER ordered or authorized. Two weeks later, it happened again. We had just fertilized the yard the day before & we come home to find Fitzgerald's had put flags in our yard claiming it had been sprayed with fertilizer yet again. I phoned them extremely irate & told them they most likely just burned or may have killed my lawn from excessive fertilizer treatments on the yard, as we had just done it ourselves not 24 hours earlier. Again, they were told NEVER come to this home & trespass on our property. When the yard didn't show any burns, & after discussions with neighbors who were home at the time, we in fact realized they were lying about actually servicing the yard at all with fertilizer at all.

We continued to receive bills, despite us telling them we refuse to pay for services we did not order. They just ignored us. Wanting them to go away & be done with Fitzgerald's for good, we paid for the 2 treatments. Within the next month, we receive a huge bill, stating they had been continually doing regular fertilizations to our yard (though we never found flags in it again like before) and had been mowing on a regular basis. We knew this to be a complete lie & outright fabrication of the truth. We take great pride in our yard & mow it sometimes twice a week it is so healthy. There was no possibility Fitzgerald's EVER did any further work on our yard, yet continued to bill & harass us via telephone about the charges. I actually would sit on my porch & watch Fitzgerald's show up at neighbor's yards & then claim on that same week they did work on my own, which I knew was a complete lie. My husband phoned Fitzgerald's twice absolutely furious & asked to speak with the owner. Both times the owner said he would 'look into it,' but failed to ever call us back. Yet, they continue to bill us, ignoring our communications that they cease this blatant fraud. Now we receive a letter that they sent our account to American Profit Recovery for collection services. They're demanding $195.03 for services NEVER authorized or performed.

This business is conducting fraud & needs to be stopped. We are sending a letter, as well, to the Federal Trade Commission, to inform them of Fitzgerald's conduct. At this time, though, we need to immediately resolve the issue of this fake bill sent to collections by Fitzgerald's in our name.Desired Settlement: We want any claimed "bills for service' to be appropriately removed permanently & recorded correctly, including from any collection agencies they have sent them to. If our credit has been effected in ANY way, they are to fix their false allegations at once.
