Review: Hi, I am sending this email because I've recently had issues with my 2004 Nissan Maxima. My car was serviced for an oil change 10/23/2013 and I expressed to the gentle who checked my car in to make sure that the fluids in my car are topped off. This gentleman ensured me that the fluids would be topped off. There has been several occasions were my fluids were not topped off. There was also an incident were my wiper fluid cap was left off. Since I have had my car Aug 8, 2011, there has been a constant issue with replenishing my fluids. I called Fitzgeralds today 11/6/2013 because my car was acting really strange 11/5/2013 I was driving my car and it did not accelerate and the RAM/PH would go up to 3 and 4 and the car would jerk. I had to keep pressing lightly on the accelerator in order for the car to accelerate. I called Fitzgerald Auto Mall and spoke with a service manager his name is Paul. I expressed to Paul that my fluids were not topped off and that my car is acting weird. He told me to bring the car in so that they can replenish the fluids. I then called back and spoke with the General Manager. I expressed to him that I asked the gentleman who checked my car in to have the mechanic to top off my fluids. The GM told me that it is not the persons job who checks my car in to make sure that the mechanic tops off my fluids. He said its the job the 3 men working the service desk. I was not aware that they are who I was to express my concerns to regarding topping the fluids. I thought it would be the responsibility of the person checking my car in. Furthermore, there has been several occasions were they did not do their job. Its my concern that there may be a serious issue with my car due to their poor work ethics. I was told that the job would be done and it was not. I am going to take photos of my fluid levels to show proof of there negligence. I should not have to check behind the mechanics, its their job to do the job correctly and efficiently.Desired Settlement: If there is a serious issue with my transmission/engine motor I want Fitzgerald Auto Mall to be fully responsible for all damages and replacements.

I am responding to your letter of November 19,2013. **. [redacted] comes in on a regular basis for oil changes, roughly every 3000 to 4S00 hundred miles. We change her oil, we don't top off the oil. We don't top off transmission fluid either. Her transmission was serviced on August 22,2011, at S2956 miles, at no charge to her. On her last visit on November 7, 2013, she said we didn't top off her fluids. We did check the car over and did a safety inspection. We made a lot of maintenance recommendations, one of which was a transmission fluid exchange. There was one time when we did leave her washer fluid cap off, but that doesn't in any way affect any engine fluid levels. We are not responsible for any damage to her engine or transmission.

On that same November 7 visit when she asked to have the transmission fluid topped off, we explained to her that the cap is locked and the fluid could not be viewed. Also that topping off transmission fluid is never recommended. We asked if she was having any trouble with the transmission and offered to drive with her, but she declined, saying she did not have enough gas to take a test drive. We offered to have a technician drive with her at the time of her next visit.

Review: Vehicle was described clear of any accidents or mechanical breakdown and I was given 5 pages of AutoCheck Vehicle History Report by Experian with a score of 88 (Above The standard 69--82). Saleman stated that the blue book value was a minimun of $13,000.00- Sticker price $10,999.00 so it was a great buy at that price. 14 days later while my vehicle was parked on the street, it was crushed by another vehicle.My insurance company [redacted] discovered that my vehicle was involved in a front collision on 09/10/2010. Claim#[redacted],damage of $5,905.00 paid by [redacted] Insurance company. Due to that accident the replacement value of my vehicle could not be more than $ 9,650.00. according to the [redacted] adjuster. Without that collision the vehicle would be worth the blue book value that I was told by the salesman.Desired Settlement: That dealership repay all tha I lost on the deal.

Thank you for this opportunity to respond to **. [redacted]'s statement of problem dated 9/13/2013. We strongly disagree that the vehicle had been involved in any prior accidents, based on several reviews. This vehicle was in very good shape. We performed a detailed servicing of the vehicle to bring it to industry standards, as well as performed a 138 point Used Vehicle Inspection. We ran an AutoCheck vehicle history on it also, on May 21, 2013. That report shows no accidents. We ran it again this morning, and the report still shows no accidents. The body looked good and the car ran well. There is no reason for the insurance company to have deducted over $4000 for a car that is going to salvage.

It is our suggestion that **. [redacted] consider taking legal action against [redacted] for his loss, or that he file a complaint with the Maryland Insurance Commissioner.

With this letter I am including copies of both AutoCheck reports.
