I was sold a car that had a pre-existing condition and the dealer was aware of it. The dealer did not inform me of any major issues to the vehicle.I purchased a 2011 Nissan Altima with a 30 day/1000 mile warranty from [redacted] at Five County auto. I purchased with an 8000 auto loan and paid an additional 1250 cashiers check late thursday evening, drove home. the next day I only drove to less than 30 minutes round trip to physical therapy and back home. on saturday I drove to service in winston-salem and after about an hr of driving (est. 1hr 19min) the car's RPM did not go past 2.5-3 and would not accelerate. I had to pull over on the interstate and turn the car off, turn it on again and then continue my trip. I informed the dealer via phone call that evening. The issue reoccured on Sunday and I stopped by the dealership on monday to discuss the issue. [redacted] stated he did not think it was a big issue and suggested I continue driving despite the fact that I told him I've only experienced it on long trips. he suggested I fill my tank up and test for accurate milage and suggested it could be an issue with a fuel pump. I expressed concern about adding milage as a troubleshooting technique do to the limited warranty. I worked on monday but on tuesday I drove the car to greensboro to troubleshoot the issue and as soon as I reached E Lee Street exit the car lost power again. I took video and sent it to [redacted] to show the issue and sound it made. I told him I would take the car to a mechanic to look at it. Wednesday[redacted] in Raleigh tested the issue by driving for 30-45mins and concluded it was an issue with the transmission but could not pin point a cause or solution. I informed [redacted] and asked what his return policy was. He then informed me that he does not do returns but would honor his limited 30 day/1000 mile warranty for internally lubricated parts, up to $500. I explained if it is a transmission issue would be more to fix the issue. I asked where he purchased it from and he said raleigh then drove it to greenville to pick up a title. I told him that the mechanic suggested he would have experienced the issue during that length of drive. I took the car to [redacted] Nissan to be looked at and to see if I had a warranty. [redacted] representatives concluded it was an issue with the control valve/CVT valve body and it would be $2457.83 to repair. The provided several documents, including tsb-ntbXX-XXXd, which included 1hr-1.5 hrs of driving would produce the issue, and the representative [redacted] stated that it could happen sooner than that and agreed that the dealer had to have experienced the issue during transport or picking up the title. I confronted [redacted] about the issue and he stated he saw the issue when conducting research. He continued to offer several suggestions that could cause the issue,contradicted the findings of Nissan. I told him I did not feel comfortable trying to repair other parts if two parties suggested an issue with the transmission. I told him that I would rather return the car and he could try the fixes without me as the owner. I told [redacted] that I believe he was aware of the issue. Initially he stated that he he was unaware of an issue, but later stated "it does not matter if I knew because you had a warranty" [redacted] has also failed to fix a paint job to the front bumper which he provided an IOU for. I was unaware of the return policy and [redacted] refuses to refund or provide the recommended repairs or diagnose a concrete alternative cause which has created stress left me unable to drive the car for long periods of time.[redacted] has also not upheld his end of the agreement regarding the paint. Nissan representatives,[redacted] tune representatives, and myself believe that due to the nature of the issue and the length of time [redacted] drove the car he was aware of the condition and did not inform me before purchase.Desired SettlementI am requesting 1. return and refund2. repair for the transmissionBusiness Response Consumer Response Even though there has been a response there has still been no resolution offered, which is the main reason why we have to go through this. There is a lack of a resolution. The only thing [redacted] has been offering are articles that suggest what he thinks the issue is. He has not isolated the issue or offered anything other than what Nissan has offered but still fails to accept that as the issue. Also, now [redacted] claims that he did not drive the car long enough to have the symptom present itself, but he told me that he received the car from raleigh and drove it to greenville and then to zebulon. raleigh to greenville is approximately 84.8 miles or 120 minutes. driving from greenville to zebulon is an additional 61 miles or 1hr. I also have a video recording of our conversation because he stated on the phone "it does not matter if I was aware of the issue" [redacted] did not show any remorse or sympathy when confronted with my concern. I received a can of paint in the mail about a week after placing a complaint with Revdex.com. It was my understanding that [redacted] or a representative from Five County Auto would correct the chipped paint before the sale and not a DIY project for me to complete at home. I did state I would check in with my attorney and Revdex.com was my preferred option because I do not want to go through litigation and would prefer to come to a fair conclusion. At this point I would like the $500 towards my repair and to be done with this business. I now know never to do business with this company.Final Business Response I will be pay the $500 towards the repair, I need a copy of the repair bill or the shop info to give them a credit card number. If you have already paid the bill just fax me the repair bill and I will send you a check. Fax #XXX-XXX-XXXX. As far as not being concerned I spoke to you or text you every day after the problem started until our last conversation when you threatened legal action. I have a copy of the WE OWE signed by you that shows we promised touch up paint, it does not say we will do the work.
