Car Company constantly harassing and threatening to tow car, Although notes have been paid. Flag City Auto Plaza sold me a [redacted]. At the time of sale I was told I could not leave the car lot without auto insurance. That was understandable, so I did purchase auto insurance. I was told to make monthly insurance payments and bi-weekly insurance payments to the car company. I did so through an employee named [redacted]. After the car company relocated (unknowingly to me) to Millington, TN I started making my car payments and insurance payments online. I always included a note in the memo as to what the payment was for. After going to online payments, I started receiving frequent harassing phone calls from [redacted] or clerical assistance threatening to tow my car due to lack of insurance payments. At this time I asked to speak with the agent I made payments through so I could provide proof. It was then I found out that she was fired as well. I had to go through my bank statement history to prove to [redacted] I indeed made insurance payments. Once he received proof he quickly realized he added the payments to my car (what I was told) payments. This caused my insurance to cancel. I had no idea I was without insurance until this very moment. My insurance cancelled in May according to the Car company yet they took payments for it. [redacted] told me this is because he just submit payments. He doesn't read the notes or memos. Although this was a mistake on behalf of the car company, [redacted] refuses to reimburse May and June's payment. He says he applied it to the car payment and will not remove it. Yet he is constantly calling me threatening to tow my car until I can send in funds for insurance. I did call the insurance company that they caused to cancel. The representative informed me that the Car company can only view the policy to make sure it is active. They cannot accept payments for insurance purposes. When I did call the car company back to speak with [redacted] (clerical rep) [redacted] was in the background making some very unprofessional statements about my hispanic husband's legal status which he know nothing about. Flag City Auto Plaza ([redacted]) is very unprofessional, rude, has poor communication skills, and has a nasty attitude.I would like for the harassing phone calls to stop. I know [redacted] cannot tow my vehicle when I am making on time payments (sometimes early payment). I provided all proof that was needed to show [redacted] that I indeed paid my insurance in May and June(when he said it cancelled). He called me again on 7.6.15 threatening to tow my vehicle unless I paid insurance. I emailed him proof that I made my car payment early which is why he missed it. I also told him that as discussed he was responsible for reimbursing so I could get insurance back since his lack of attention to detail caused it to cancelled. He rudely stated that our car was a payment behind and the money from the insurance we paid covered that. We supplied proof that the car payment was made. Yet we are still being refused a reimbursement. I am at the point of obtaining a lawyer to be sure this company is running a legit business. I am tired of the harassing phone calls and threats of having my car pulled although I am paying my notes.Desired SettlementI would like for Flag City Auto Plaza to stop sending me harassing phone calls, and threatening to tow my vehicles. My car payments have been made. They have no grounds to touch my vehicle.Business Response I am in contact with Mrs. [redacted] and emailed her a complete payment history. The same day (2/27/15) I got the [redacted] it quit and they had to tow it and they kept it for four days. When asked to switch to another car I was told I couldn't do that. I took it back to them every other week after because it was smoking and hesitating to take off. On 3/27/15 [redacted] told me the car was burning oil and he didn't know why. Each time I was told to bring it back if the problem continued. The last time (4/30/15) I was told by [redacted] that he didn't have time to look at it to bring it back another day. On the 22nd of May after my note was paid the car quit again. I called [redacted] and he told me to have my insurance to bring him the car and I asked why should my insurance bring him the car when I've brought it to him and he wouldn't look at it. He asked for the address and my phone number and told me the tow truck would call me. I never herd anything back until the 24th when we called him and passed words over the phone. He finally came and picked the car up on the 27th of May saying it was a repossession because my insurance was cancelled but my insurance wasn't due until the 25th of May. I've gone to the shop twice since then. The first day (5/29/15), he told me he would check the car out and if it was the motor I could get another car without having to give any money to come back the next day (5/30/15), with a family mechanic to check the car out. The next day when I made it to the shop he said he didn't see anything wrong with the car and that he drove it around with no problem. When we checked the oil it was milky and he said to get in another car I would have to give him $625 up front or he would figure out the problem with my car and have it back to me the next week to call Monday (6/1/15). When I called he said he hadn't looked at it to call back. I called 6/2/15 and he told me he still couldn't figure out where the oil was going to get the money for another car and he will have another mechanic to look at the [redacted]. He has held my car for 1 week and 6 days after the note was paid with no solution besides give him more money. I also gave him a trade in car which he was suppose to give me $350 for. Of the $350, $150 was for tags and the remains $200 was towards the down payment. The tags were not $150 and I didn't recieve credit towards my car or change.Desired SettlementTo solve this problem I would like it if I could get a good reliable car that hasn't been wrecked, like a few of the cars he has, with no more money down or my money back. I have no car and I've made all of my payments and on time.Business Response The City of Memphis tag is $149 and the 3o day State drive out tag is $5.50 for a total of $149.50. We over charged her $ .50 and I will refund this.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I do not accept this response because there was no resolution. I was never told that I would be paying for drive out tags and it is not stated in the contract. If [redacted] knew that I was over charged why didn't he bring this up before now or attempt to refund anything before now? There was no response to me being refunded for the car or given another car. I have [redacted] on a recording, that he was aware of, stating that he would switch the car out for nothing down and then turning around asking for something else down to get another car after he tried to make insurance an issue. I had been paying for a vehicle that I couldn't drive or they had at the shop practically the whole time because of a bad motor. I would like a refund for the amount I gave them not $0.50 that he is claiming they owe.Final Business Response Again, I would trade her out into a vehicle of equal value. If she wants something that is more expensive, she will need additional down payment.I consider this a closed case. Thank you.
