I would like to start this dispute explaining that I am a very small business and I never had any kind of problem with customers beforeI have a relationship with my clients in a very informal and personal fashion way and it has been working fine until now.I am very blessed person with a health
beautiful child and I believe in giving back all my blessings to the community in some way, and as photography is my passion, I like to make people happy giving them my time with photo sessionsReminding, a photo session specially with newborn, takes hours of preparation prior to the session, which is setting up the background settings, choosing the props to be used during the session, ordering them, washing all them, etcThe session itself takes several hours, the mommy has to feed the baby, change diapers and so onAnd the post processing part, which requires several hours on computer, editing each photo to have this result (photo #1, 2).In the last two years I have been very busy with full time nursing school, a small child and of course photography jobSo it is very important to you understand that time management was the most important factor for me during that time.I have several times volunteered to do photo sessions to people on my local church, or for people that follow me on *** and never had any kind of problem beforeAs I am learning and growing in the field of photography, I have upgraded my way to deliver the photos to my clients, it started with CDs and DVDs, and then to flash-drives, and now I deliver the photos online by email or through an custom online galleryIt allows me to deliver the photos and have a feedback from the clients very fast and effectivelyI most work with newborn, maternity and family photographyI would like to stress that a newborn session starts around $for digital photos, and it is delivered online and the client receive a photo print release to be able to print the photos anywhere they choose to do itAlso its important for the newborn session to be done in the first week or no more than weeks of the baby’s lifeI personally like to do in the first week of like, because the baby still has that flexibility of being inside of the mommy’s belly, and this flexibility is what allows those cute newborn photos that every mommy wants when they pay for a newborn session(photos #3)So, around Christmas time in I decided to offer a free session, and *** *** saw my advertisement on *** and contacted meWe talked many weeks before she delivering her baby, trying to figure out if the baby was going to be born in the time frame that I was available for the shootingIt would have to be in my school winter breakI explained to her that the session was free, the digital photos were free ( no number of photos was stipulated, it was my decision which ones and how many to be delivered)So, it was stressed to *** ***, that she would have a choice to bring her own props, use my old props, or to use my brand new propsIf she choose to use my brand new props, it was required that she pays for them (photos # ,4,5,6, 7) We exchanged several text messages going through the style that I was going to use in her baby, the props that I was going to order to use for her baby, and I gave her many options to buy the props in the site that I buy them, or to bring the money in the same day of the sessionWe had many conversations weeks prior to the photo sessionIt was very clear that the agreement was to pay for the brand new props before or at the beginning of the photo session.So, in the date of the session, *** *** came to my house, with the baby and her husbandWe went through all the details, I showed her the brand new props, and just then, she told me that she did not have the money that day, her husband did not have received his paycheck, and they would come back later with the money.I was skeptical in that point, because she had more than weeks to plan for that session, and did not bring the money or mention anything about not being able to pay for it during our texts or by phone before.But for the sake of the baby, and the effort and desire that she had in come in to the session, I decided to proceed with it and trust her that she would come back with the money.So, soon after I did the post processing, enhanced the photos and sent her a few photos to make her happy, even though she still did not have returned with the moneyAfter while I decided not spending more time on working on computer editing her photos, because I had returned to nursing school, and did not believe that she had intention to pay me at allShe had opportunity to go on the many websites and buy something to me, or sending me a check or gift card by mail, but she never didAfter several back and forth text messages I was already aggravated and said I was not going to deal with her anymoreShe was only concerning about me delivering online all the photos, but I would not spend more time editing photos, using a custom online gallery for her photos, that cost me money and time, if she was clearly not willing to pay for the props that her daughter used during the sessionNot only I spent my time, but also I spent money on those brand new props.I have a newborn contract that was supposed to her come back and sign when she returned with the money, and also she never didIf the contract was signed, like every other client does, she would not be threating me now to take me to court and charge me for modeling feesI spent so much time and energy with this lady, that a few paid sessions would not be enough to pay me.The bottom line is, I offered free session, with free photos and I did the session, and I delivered the photos to her cell phone which are good to use in the mediaThe photos with quality for print, would have being delivered if she had paid me for the props that her daughter used Also, I have suggested to her to cancel this dispute and save me the time of explaining myself and having this aggravation in my life, and she goes to my attorney and sign the contract and take the photos but she said it was not possibleSomeone would have to pay attorney fees, but she wanted to stimulate a maximum $300-for that, and my attorney cost much more.If it is necessary, I can collect letters of clients of people that I did free job before, which they all were pleased and thankful for my time and job and send to youI am not a scammer, like I am being accused.It was all with the good intention of giving back to the community and making people happy.Now, I have to worry about she taking me to court and requesting for modeling fees for her daughter, and be here explaining myself to a Revdex.com, and I do not deserve itI told her, that after been exposed to this situation, I do not trust her and I would need to pay for my attorney to review my contracts, because I want to be sure, I won’t be vulnerable anymoreMy question is, who will pay for my expenses with attorney now? How can I trust this lady again? I gave her a free session that normally would be $350, free photos, used my brand new props on her daughter that costed me money, and now I have to defend myself to not have my job’s reputation jeopardized for this situation. Complaint: ***I am rejecting this response because:In *** *** previous response, there are many inaccuraciesAll correspondence that we have shared has been compiled from my text messages and *** messenger in order for easy viewing. The first interaction was on 1/22/She states that I had the choice to use my own props, her old props, or pay for new propsThat is falseAs you can see in the texts, I was never given a choice because she wanted to move to a natural, organic style of photography and required me to make a purchase of a new outfit that I would approve beforehandEverything was originally supposed to be free as advertised and as continuously stated by her in the very beginningShe waited two weeks from initial contact to ask me to pay for props or she would not do the “free” session and photosIt was my due date and at that point I couldn’t hire another photographer so I agreed to purchase $propsShe also stated that it was her discretion how many photos and the quality she provided, but as seen in texts, she told me that I would receive 10-digital photos uploaded to a custom photo gallery on her website with the release to print anywhere I chooseOn the very same day she said that the session and photos would be totally free because she wanted to build a portfolioI questioned her advertisement after she asked me to pay for propsShe sent me pictures of items she purchased on 12/11/17 with the receipts and after a brief period, I agreed to pay for $in props, but no mention of how or whenShe stated that we went over choices for props to be used on my baby, the ones she was GOING to order, options on the site to purchase, or bring the money to the sessionThat is all falseNone of that happened and no mention was ever made about bringing money to the sessionShe says it was very clear on paying for the props before or after the sessionNo mention of when or how that was to be done was made, ever. On the date of the session, she asked me to hurry over to do it and if we were any later, she would not have timeWe did not have time to get any cash from the atm and I was skeptical of giving cash before the photos were readyI told her that I would be back with the money when the photos were readyShe said I “had more than weeks to plan for that session”I contacted her on 1/2/and the session was done on 1/27/That is just over weeksI was in labor for hours and in the hospital with a bad recovery for many daysI didn’t have time or capability to drive anywhere for cash and didn’t understand that is what she expected since I was supposed to purchase props from a website. The same day of the session, I asked her what she needed from meShe was supposed to mail me a release form and contract to bring back to her before getting the photos and needed our names and address to send it toShe didn’t respond so I sent that informationShe responded with two text pictures that have been resized to view on a small phone screen and are very low quality, non printable filesThey only look ok as very tiny size, but any bigger they are severely pixelated and distortedI said the preview photos were great, but I continued to wait on what she needed from me or direction on what to do nextI waited months before asking her on 4/11/about the photos because she said she was busy and it would take a whileShe was offended that I even asked and she said she was busy with nursing school and would FIND the files and send them to meNo mention of money or payment. No contact again until 5/30/I asked if she had time to work on the photos and that’s when the dispute over me buying props started againI told her that she never sent me links for props to purchaseShe said she sent them from ***I went to *** and we had never sent or received messages from there, but I checked againShe said she didn’t have time to find them and to just bring her an *** or *** gift card that weekend in exchange for release and CDI told her my husband was deployed and I was not in the state, but could send the *** card electronic through email or mail it and she could do the same with the release/contract and picturesTo me, that takes the same amount of time or less if done electronically, but she said she didn’t have time or want to be bothered with itI let her know that there was a misunderstanding and communication error, but I offered many times to settle the deal as agreed when I returned to the stateShe proceeded to tell me to forget about it and to leave her aloneShe did not respond to my messages after thatI had decided that if she wasn’t going to honor the agreement and provide the photos in exchange for the $prop purchase or gift card that I would bill her for the modeling services at a lower end hourly rate for industry workShe was angry and the conversation on *** took over instead of textingI gave her the option of paying the bill, honoring the original agreement ($for photos and release), or I would sue her in small claims court. She repeatedly chose court over the other options no matter how many times I askedShe said “I do not have the photos anymore”She also claimed to have satisfied the agreement with the tiny text files that are unable and not professional photo filesAfter lots of argument and me offering to send her the gift card first, then her send me the photos, she wouldn’t agree and said her attorney would handle the contract and exchangeOnce she saw my Revdex.com complaint, she reminded that offer and said that no photos would be exchanged unless I cancelled the Revdex.com complaint BEFOREHANDShe then stated that she had proof that she bought the props specifically for my daughter to use and that I must pay for them, but that is clearly as the date on those purchases shows in the text messages as 12/11/16, weeks before I ever contacted her about taking photosShe messaged me to ask if I would meet her today, 6/26/to exchange and I agreed, but she recinded the offer until the Revdex.com complaint is resolvedAfter all of her lies and the amount of time that has passed, I am not confident that she can resolve this issue without a third party involvement. In conclusion: I am still owed the 10-digital, professional photos I was promisedI am still willing to provide the $via a form of payment that is traceable as to have proof of transaction.Regards,*** ***
