response to the complaint filed by [redacted] on or about September 23, 2014. In accordance with your request of Tuesday, October 7, 2014, below is Fleetway’s explanation of its position with respect to the above referenced complaint.
On or about June 21, 2012, Fleetway entered into a Master Lease Agreement No. [redacted] and Vehicle Schedule and Disclosure Statement for Equipment Schedule #[redacted] (hereinafter collectively, the “Lease”) with [redacted]. d/b/a/[redacted] and [redacted], for the lease of one (1) 1996 [redacted] VIN No. [redacted] (hereinafter the “Equipment”). See Lease attached hereto and made a part hereof as Exhibit “1”. Pursuant to the Lease, [redacted] was required to make twenty eight (28) monthly payments in the amount of Seven Hundred Forty Six ($746.71) Dollars and Seventy One Cents. See Exhibit “1,” Schedule #[redacted]. Fleetway delivered the leased Equipment in accordance with the Lease terms.
As early as October 2012, only four (4) months into the Lease, [redacted] was non-compliant with respect to the Lease payment obligations. On at least twenty-seven (27) separate occasions, over the course of the twenty eight (28) month Lease term, Fleetway contacted [redacted] and demanded payment as required under the terms of the Lease. As the result of [redacted]’s chronic lease payment delinquencies, and in accordance with the terms of the Lease, late fees (service charges) accrued in the amount of One thousand Six Hundred Twenty Seven (1,627.53) Dollars and Fifty Three Cents. In addition to the continually accruing late fees (services charges), as of early September 2014, Mr. Horace was four (4) months in arrears on his monthly payment obligations under the Lease, totaling Two Thousand Nine Hundred Sixty Nine ($2,969.01) Dollars and One Cent. Accordingly, the Equipment was repossessed on or about September 3, 2014.
On September 10, 2014, counsel for Fleetway issued the attached Notice of Repossession, Redemption, and of Disposition of Collateral (Exhibit “2” attached hereto) to [redacted]. [redacted]’s complaint that the truck was repossessed with two payments left on an account that “was up to date” is, obviously, wishful thinking and ignores the true facts.
