On or about [redacted] Fleurys Outdoor Power Equipment picked up my [redacted] tractor for repairs. On [redacted] they called me and told me the machine would cost $1400 to repair. He suggested that it probably would not be worth that much money to put into it because he sells tractors starting at $1500. We both decided that it would probably be a good idea to just recycle it and he said he would take care of that. On [redacted] my son stopped by and I showed him my new [redacted] at which time he asked what I did with the old one. I told him what had happened and he said that he probably could have fixed it himself for much less. On [redacted] I called Fleurys to see if it was still there and he said that he fixed it and was selling it for $700. If he said it would have cost $700 to fix it, I probably would have agreed to that. I feel that he misled me into recycling in order to make a profit for himself.Desired SettlementTractor returned or $700 from sale price.Business Response As claimant stated he decided to recycle the machine. I don't how much the machine is worth to the customer, so I tell the cost of repair and the cost of a new machine, and let them decide what they want to do. I never mislead him into recycling his machine. I as the dealer do not sell used parts to repair a customer's machine. I have to warranty them and have no estimate on failure date of pre-owned parts. All repairs are done with OEM parts only. His transmission was not repairable. After customer recycled machine, I disassembled his machine and reassembled it with other used parts from other recycled machines. If the machine then works I resell them with no warranty as a salvage yard does. I spoke to my attorney after Mr. [redacted] was in and told him about this issue, and he told me that I did nothing wrong. Space is very limited here and I move as quickly as possible. I offed the machine back to him for $700 after it was repaired. I have over 4 hours and a used transmission into this machine. He can have the tractor back for $700 in working condition with no warranty. As my lawyer stated I did nothing wrong.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)He probably didn't do anything legally wrong, but I still believe he misled me by saying it would cost $1400 to repair. (My son has found a new transmission online for about $300.) He never offered another option for repairs leading me to believe it was junk and wouldn't be worth the repair. He also said he fixed it so quickly because of limited space, yet it took him over three days to tell me what was wrong with it. He said he repaired it with parts from recycled machines which cost him nothing; this is what he offered for my machine - nothing. As a reputable, moral businessman he should offer it back to me for his labor only.Final Consumer Response I accept your offer and I will pay $429.80 for return of the machine. When can I pick it up?Final Business Response You can pick up the [redacted] during the week. Monday -Friday between 9am - 4pm. Payment due at time of pick-up.
