To Revdex.com,
In response to Flex Partners Inc response to my complaint regarding breach of contract
Iinitially approached this company for both engineering assistance and prototype development through which the various concepts created and proposed by them on paper would be proven to actually work in practice as intendedIt was my stated goal from the very beginning to have a proto-type or proto-types made based on conceptual designs they were to come up with
The company states the following services on their website and printed materials which I relied on in making my decision to work with them
"Often beginning with an idea or a clinical issue needing an engineering solution, our prototypes come complete from teams possessing a comprehensive understanding of the market being addressed, medical needs, and market evaluation"
Flex Partners, IncIs a medical device design and development company serving established companies and new venture start-upsThe company provides over years of engineering design and business development experience with state-of-the-art equipment, fabrication expertise and creativity to bring your product idea from concept through commercialization. Our comprehensive range of services comprises both conventional and non-traditional means of design, fabrication and financing options to meet specific client requirementsCompanies look to Flex Partners as a trusted outsourcing partner or as their personal Virtual Engineering DepartmentOur core competencies include the following
Product Design
Engineering Analysis
Product Prototyping
Simulations and Product Testing
Intellectual Property Development
Validation and Verification
Manufacturing Support
Program Management
Business Development
In the contract under Proposed Plan #(C) it says the following
Integration of concepts into a configuration or a series of configurations that would be the basis for fabrication of new prototype device(s)
In additionregarding#of the written contract Flex Partners did not provide a cradle to grave story board as agreed
There was no mutual agreement stating that I accepted Flex Partners not to provide this cradle to grave story boardIn fact there was a mutual agreement that once a design was chosen through validation of a working prototype that a cradle to grave story board would be provided at a later date
I propose if Flex Partners has something in writing that I accepted this unfulfilled written commitment I would like to review it
There was a mutual agreement to provide prototype(s) proving their drawn concepts actually work which is why I began working with them in the first place based on their advertising such services as shown above
There are in my possession numerous e-mail communications printed which show there was a mutual agreement to provide a prototype(s)
I contend that there were several breaches by Flex Partners Inc both in the written and agreement and subsequent oral agreements
Total payment exceeded proposed amount as contract date was extended by mutual agreement as evidenced by e-mail chain of correspondence over many months
Breach of contract #(Did not provide cradle to grave story board)
3.Nothing was provided regarding packaging and disposal of absorbent component as offered in written agreement noted in #B (v) of proposal
4.I was asked to order *** *** for making said prototype(s) noted aboveI paid for and had them shipped directly to Flex Partners headquarters in Solana Beach
I was billed for a seamstress subcontracted by *** *** to create a prototype(s) and was never offered any access to any rough prototype samples until I asked for a refund many months after *** *** broke off communications
Let it also be noted as a statement of a fact that I paid every invoice presented to me promptly
Based on reasonable conclusions and examination of facts (Including many months of e-mails I have printed as evidence)it would make no sense for me to have continued working with Flex Partners unless there was an agreement early on to provide working prototypes in which I could not only validate the drawn concepts they came up with to file appropriate utility patent but also to attract investor capital with a design that worked as promised
The end result in working with Flex Partners is that they did not provide the services and assistance promised
Based on all of these facts I request a full refund!? ? ? ?
Sincerely,
