Floor Source and Design

Mr. contacted my company to receive an estimate on flooring. The appointment was set for Friday, July 25, 2019. At the appointment Mr. asked if new flooring could be installed the following week. I informed him that the carpet comes from Georgia and further informed him that the order would need to be placed that day if there was a chance of it coming in by the end of the week. I was clear in telling him that there were no guarantees it would arrive by the end of the week.

I proceeded to go over the contract and asked Mr. for a deposit on the work to be performed as is standard practice. Mr. was reluctant to do so, but I explained that this was necessary to order the carpet and to get started on the project. Mr. was presented with competing companies which ask for the entirety of the funds upfront. I was simply asking for half of the total project cost. Mr. asked if a credit card was acceptable and I said yes. Mr. signed the contract which contained verbiage regarding contract pre lien rights, collection costs and cancellation fees.

Upon my arrival back at my office, I attempted to run the card at which point it was declined. Monday morning, I called Mr. to inform him of the credit card declining and that I would need a check that day if there was any chance of getting the carpet ordered. I went back to his house to pick up the check.

On August 3, 2019. I informed Mr. that the truck with his carpet had arrived in Minneapolis, but that the driver would not be able to unload the carpet until Tuesday.

When we spoke on Tuesday, Mr. demanded his money back. I told him it would not be till Thursday when all the paperwork was processed. Mr. and I spoke on Wednesday at which point he asked what the plan moving forward was. I told him I was working on his file. He then proceeded to show up at my office while I was in the middle of dispatching. I informed him he would have to wait while I finished getting my workers to their jobs.

Once this was done, I told Mr. that I would be returning his deposit despite the cancellation language contained in the contract signed by Mr..

Mr. had set his own expectations regarding when and how his service would proceed. When his expectations were not met at his precise deadlines, due to his failure to timely pay the deposit, the deal became soured. Mr. received his money back, but not my company is stuck with custom carpet ordered by Mr..
