However, as stated in the denial letter, the representative provided “if the homeowner is not satisfied the option of hiring a 3rd party certified inspector is an option. Please note that the homeowner would be responsible for the upfront cost of the inspection Once the inspection is complete it can be forwarded, for review, to the Manufacture if in fact it is determined to be manufacturing in nature the homeowner will be reimbursed a fair and reasonable rate for the inspection and the case will be reopened.”
As a customer accommodation, Flooring is willing to send the independent certified inspector, as recommended, at Flooring 101’s expense to assess the concernsPlease contact me at ###-###-#### at your earliest convenience to schedule

No work was ever undertaken or done by Flooring101.  Flooring101 did not start this job due to unforeseen issues that arose and were not disclosed to Flooring101 or that Flooring101 had no previous knowledge of when the contract was executed, all of which was outlined in detailed correspondence...

that included the consumer's refund.  Undertaking this job would now require the performance of work completely outside the scope of the contract.Flooring101 did not start its performance under the contract and never removed or installed flooring.  After examining all the issues, Flooring101 is within its professional discretion to determine that it could not undertake the job required and requested by you.  This is a completely appropriate manner in which to proceed as opposed to performing work outside the scope of our responsibilities and possibly causing damage to your home.  We hope that you can understand our position.Flooring101 has not made your home uninhabitable because no work was ever performed by Flooring101 and you have been left in the exact same position as you were prior to entering into the contract.  No damages of liability have occurred.  In result, Flooring101 will not pay a general contractor to remedy the pre-existing conditions in your home.

As previously stated, the manufacturer has already denied the claim. Unfortunately, Flooring 101 is not the manufacturer of the product.  Flooring 101 must follow the procedures set forth by the flooring manufacturers.    However, the manufacturer provided a stipulation for further consideration of the claim; the flooring must be inspected by an independent inspector for a neutral 3rd party assessment. Normally, this process would be at the expense of the consumer, but Flooring 101 made an accommodation to coordinate the inspection at no cost to you.  Flooring 101 cannot move forward with your claim until this is completed.  Please contact us within 15 days to move forward. I am rejecting this response because:There is no reason to send an inspector out. The flooring is defective and can't be repaired. I want brand new flooring or a refund. The flooring is lifting more each day. it is unsafe to walk on. My family has injured themselves because the flooring is lifting so bad.

Flooring 101 is NOT a general contractor.  Flooring 101 is a flooring contractor. A licensed general contractor will be necessary to complete the repairs required to remedy the pre-existing conditions in the home. This is a valid reason not to perform under the contract and is within Flooring101’s discretion.

I am rejecting this response because:  This business did not complete the work it contracted to do.  The work to be undertaken was fully known to them, but they backed out of their contract for no legitimate reason.

Review: My husband and I spent nearly 18,000 dollars for carpet with this company. Upon payment, we bought the warranty but at no such time did [redacted], the sales personnel tell us a very important fact which was, "Your carpets need to be cleaned before 2 years pass in order for you warranty to be initiated or useful".There were three of us standing at the counter when we paid our bill and not one of us heard anything as important as this told to us.So, 2 years and 2 months into our new carpet, we had them professionally cleaned. At that time, they found some damage to our carpets.I then called Flooring 101 and shared the findings and was told by Missy, that in order for our warranty to work, we needed to have our carpets cleaned before the 2 year mark. So, as it was, we were liable for 1300 dollars of repair and carpet placement. Missy then told me that I needed to call back and speak with the manager about this situation.I called and left 5 voicemails, 6 messages with office personnel and literally stopped in 4 times to speak with the manager whose name is IAN.He never returned any of my calls. All these messages were over a 3 week time.One lucky day, I called again and he was in the office. He said he would check into "fixing" the problem for me and get back to me in a few days.He never called back so I called the owner in Oxnard. While on the phone with him, I couldn't believe how rude the owner was and unwilling to hear my side that I put him on speaker for my husband to listen. The owner kept yelling that it wasn't his problem, he doesn't deal with small problems like mine and then hung up.I tried one last time to find out what our options were and IAN did call me back only to say that he will call me back in three days which he never did. Bottom line, IAN and the owner were so unpleasant and rude to us that we feel the Revdex.com should know about how this establishment is treating customers. We never did come to any solution which means we are out more money than ever needed to be.Desired Settlement: We would like FLooring 101 to replace the carpet that is damaged.

I am rejecting this response because: The origination of the stain has never been a secret to Flooring 101 or Stainmaster and the fact that they are trying to put the "blame" back on the customer is indicative of how I was intially treated. Once again, their customer service falls by the way side and Flooring 101 is missing the reason why I contacted Revdex.com in the first place.

To help Flooring 101 recall, the issue dealt with their sales person not informing their customers, my hushand, my father in-law and me, of a very important detail at the time of purchase which was the carpets needed to be professionally cleaned in a certain amount of time, otherwise the warrenty is null and void. If the sales person would have mentioned this to us, none of this would be happening.
