On Oct 2016, the client paid a $5,non-refundable deposit on a $16,wedding flower contractThe deposit bound us to proceed to provide an extensive list of floral designs on the wedding date (and implicitly precluded us from accepting any other job of such scale in the weeks leading up to
the wedding)After the client paid the deposit, we promptly commenced work to carry out the contract, including research and planning As is often the case in our work, the client came to us with her own design sketches, which were a starting point to the work that a florist must undertake (well in advance of an event) to make the designs a realityThat work began from the point the client first reached out to us and continued after the deposit was paid and included researching seasonable availability of the floral products, cost analysis, labor requirements, and suitability of plant species to fulfill the clients’ color pallet and desired applications In this particular instance, the applications included bouquets and centerpieces, but also an indoor eight foot (8’) hanging floral chandelier and floral walls, as well as outdoor installations. The outdoor installations included a twelve foot (12’) wide wedding arch and floral decoration inside and around a 30’ wide fountainPlanning for these designs and their installation is critical to ensuring a successful event and requires specialized knowledge and skill, that come with years of experienceFurther, as part of the preliminary undertaking for this project, we conducted a site visit at the wedding venue, with three team members from our company, taking measurements and planning logistics with the client and other vendors. On November 9, as the above described work was well underway, the client emailed all ofher wedding vendors to announce that she no longer wished to get married in the United States, due to her being upset over the outcome of the presidential electionShe told vendors that she was either canceling the wedding altogether, or moving forward with a much scaled-down versionWhile the client had abandoned the original contract terms and committment, we also responded to her cancellation announcement, indicating our willingness to try to work with her, should she desire to continue Six weeks later, on December 26, the client contacted us to inform us she wished to continue with her wedding, but to negotiate a new package of flowersOver the next day, we exchanged a draft of a new agreement; we were forced to withdraw from negotiations, however, when it became apparent that we would be unable to meet the clients’ significantly revised expectations and proposed pricing reductionWe informed the client that notwithstanding the non-refuncable nature of the deposit paid, we were prepared to refund half of the deposit, retaining the other half as (partial) compensation for our work on the original contract terms, for which the client no longer wished to proceed. In January of 2017, we contacted the client for her mailing address to send the deposit amounts offeredThe following week the client emailed a response to us, rejecting the proposed refund and demanding that we return all all but $to her, which sum she indicated represented compenation for our work undertaken through the date of the contract breachIn an effort to demonstrate good faith in our business delalings, we offered the client an additional $500.00; contemporaneous with that offer, we received the clients’ complaint to the Revdex.com, demanding a return of the deposit in the entiretyUnder the circumstances as decscribed here, we believe our proposal to resolve the matter was both fair and reasonable
